for the first time in days it appears there is oil and gas leaking out of that well in the gulf of mexico. but just a small amount and not enough to stop testing on the new cap system. nbc bay area's kristen dahlgren continues to lead our team coverage of the crisis. kristen, is the new -- is this the new normal oil leaking but not really gushing? >> reporter: well, it may be, laura. you know, i was hoping again to have more information for you. bp holds these technical briefings every day at this time we were on the call waiting for someone to come in and check in with the operators and then we got word they had canceled it again. they're not giving us the latest information this morning. what we do know is that they've been watching for these bubbles of gas and oil around the leaking well since sunday when
5:43 am
they first noticed them. admiral allen, the incident commander, says that he doesn't think they are consequential and so it doesn't appear like it's enough, that it's a big enough problem for them to try to do something about it to open up the caps. the testing continues, the cap remains on. the seepage we talked about yesterday that was two miles away from the well site, they say they don't think that is related to this well so that's a little bit of good news. they continue to monitor the situation. at some point they have to decide between leaving the cap on or closed or opening it back and going back to containment. there is new word from bp about what they're calling now the static kill and they say that might be an option to permanently kill this before the relief wells are done. yesterday was the first time we heard anything about that from them. it is similar to the top kill procedure. they would put mud and cement down into the well from the top. they think this might work better this time around.
5:44 am
they have the cap in place and also some lower pressure so they say this is just an idea they are starting to look at and starting to think about. the government so far has said it thinks the relief wells are the ultimate solution. those will be done sometime toward the end of the month. so once again, laura, a lot going on. we're trying to get to the most updated information but won't hear from bp today until 3:00 p.m. eastern time. >> all right. we know you'll keep us updated though. thank you very much, kristen. new british prime minister david cameron is having breakfast with vice president joseph biden at the white house right now. the two will have a working lunch with the president a little later and there is a lot to talk about. one of the major topics will be what role did bp play in getting the convicted lockerbie airline bomber out of prison? the scottish government released the libyan last august. doctors claim he only had three months to live. that bomber is still alive. cameron was opposition leader at the time of the release. he agreed to meet with four

senators today who will ask him tough questions about the release. seven californians died in the lockerbie bombing in 1988. a foster city company is playing a part in an aids breakthrough. it is a vaginal gel containing an aids drug and is the first hope of protection for women whose partners do not use condoms. in tests the gel reduced the risk of hiv infection by 50%. experts say even partial protection is really important especially in poor countries. time now is 5:45. you're watching nbc bay area morning news. >> we are going to check traffic and weather in just a few minutes but first are we beginning a new era when it comes to medical marijuana? today oakland city leaders could approve a plan to set up marijuana factory farms. nbc bay area's christie smith is live in oakland with what is behind the controversial move. >> reporter: good morning.
5:46 am
well, you have to remember here that the city just laid off 80 police officers and also they're facing a huge budget deficit. so what caught the city council's attention is the number of jobs that could be created and also taxes that would be paid if medical marijuana can be big business. so allowing four medical marijuana factory farms in an above board way would benefit workers and the people of oakland according to the city council. last year oakland's medical marijuana retailers raked in about $28 million. under this plan operators would pay about $211,000 a year each. the problem is as opponents see it that this is a steep price for mom and pop growers who have been fighting to legalize this all along. there is another obstacle here, the fed, but still oakland is moving forward. council members say there would still be room for small growers but this would establish what they're calling, quote, the only

legal model here if you want to weigh in on this the council meets tonight at 5:30. reporting live in oakland, christie smith, nbc bay area news. governor schwarzenegger might get a hand delivery today, a bill that would give farm workers the right to overtime pay. nbc bay area's kris sanchez is live in san jose with why now and why the governor is going to sign that bill. kris? >> reporter: good morning, brent. for about 70 years now dairy farmers and ranchers and growers have been exempt from paying overtime to workers unless they work more than ten hours. that is something that could change today. senators and farm worker advocates will try to hand deliver a bill to the governor as you mentioned. right now farm workers only get overtime after ten hours of work in a day or 60 hours in a week. the bill which passed the assembly and senate would entitle them to overtime like the rest of us after eight hours or a 40-hour work week. the united farm workers union says it is time to treat farm workers the same as we treat
5:48 am
other workers in our state. farmers, though, say they can't afford this and some have said they will get around it by hiring additional workers at regular pay, thereby hurting the very people that the bill is meant to help. many growers say they will put the pressure on the governor to veto this bill although the governor has not made his position clear. once he gets it in his hands he has 12 days to either sign it, veto it, or just let it become law without his signature. we'll have to wait and see. he has not made his position clear as i mentioned. in san jose, kris sanchez, nbc bay area news. >> thanks a lot. a common but illegal drug that couples use to increase their sex drive and pleasure could turn out to be the best medicine for war veterans. a new study in the journal of psycho pharmacology says 80% of patients treated with ecstasy no longer show signs of post traumatic stress disorder. and there are no side effects. researchers say that drug puts patients at ease letting them talk freely about the events that haunt them.
5:49 am
an iraq war veteran from san jose says he would use the drug but only after more tests. >> they say it might help and i say that's a good thing but i think more trials need to be done on that. i wouldn't really use a street drug, you know, to treat somebody. that's pretty bad. it's illegal number one and not necessarily good for a person. but if it might help, i think it would be good. >> the study followed 20 vets with chronic ptsd for almost two decades. researchers hope to get the drug approved by the fda in order to help treat the condition. we've known for a long time the relationship between at&t and apple has been a bit uneasy. details are emerging about just how uneasy. >> "wire" magazine looked into this fairly deeply and said there were screaming matches but the most bizarre thing they've found is that at&t has suggested to apple that ceo steve jobs wear a suit to meetings with at&t's board. now, at&t was told apple

hey, there is another benefit to eating fish. a new study says older adults who eat fatty fish at least once a week may have a lower risk of serious vision loss from age-related macular degeneration. researchers at the john hopkins university in baltimore conducted the study and they say the results support the theory that omega iii fatty acids found in fish may affect the progression of age related macular degeneration. nothing fishy about it. there is a new way to measure kids' body fat that might make the ordeal a little less embarrassing and easier to do. doctors usually measure body fat by calculating the body mass index or bmi using their height and weight. but some doctors say the measurement is not always accurate. studies show that neck thickness and obesity are also related in adults so a new study from the university of michigan says instead of checking the waist line measure the thickness of the neck.
5:52 am
that might be a better way to see if your child is obese. >> lots of people can do it. it's easier to replicate. it doesn't require the child being undressed. >> doctors say the study is promising since the process of measuring a child's neck is much easier to do. >> can you do it for adults? i'd like you to turn toward each other and measure each other's neck. >> yeah, nice. >> throttle. is that the word? >> too much work. that's real work. out to the roadways we have one issue. this is southbound 101. as you're coming to the area approaching santa rosa, a little bit to the north, reports of a motorcycle accident and the ambulance has been called but no details on the injuries or whether there are any. but a motorcycle is involved. so we're watching this and actually the accident itself is blocking two lanes. i thought there were only two lanes at that point. chp updates say there are two lanes so the third lane is
