vegas and that's where abc seven news sports director larry biel is once again. >> tonight. larry i got to tell you, you guys look great in the red tie. >> and the red dress. fans tastic i've got to i got to step up my game here. clearly it's really loud because we're at the nfl experience. and there's a few thousand fans behind me and a dj who's hitting very high decibel levels. but a few days ago, i told you about an event that joe montana was involved with. it's called run freely. org and the organization was started by my old espn buddy kenny mayne, who's frankly, just one of the best humans on the planet. and the goal of run freely org is to raise enough money so that veterans can have prosthetic legs delivered to them, free of charge. it's all donation based and joe montana agreed to take part in this,

which is absolutely fantastic. so here's the way it went. a select group of fans would catch a pass from joe and they jog about ten yards. you see the young lady there catching the pass. and joe, of course, because he's joe montana. he hit everybody in stride. this guy right here at the end after catching the ball he goes go seahawks! and joe was like, are you serious. it's go seahawks. so they all got autographs and best of all this event helped pay for a new prosthetic device for a veteran in need. now joe montana was not available today. but a couple of other would be quarterbacks snuck into the nfl experience before it opened. let's just say we're ready to pump you up. come on, larry, come on larry, push push push push push. >> one more, one more, one more, one more. ah >> okay, i got it. >> um, you want it.

are saying it's long overdue and they believe this will be the year they get it done. now we've compiled our reporting on the 40 niners run to the super bowl in a new streaming special. the road to las vegas. you can stream it on demand right now on our website or the abc7 bay area app. >> aftershocks are still being felt in hawaii after a magnitude 5.7 earthquake hit the big island. the earthquake was centered on mauna loa, the world's largest active volcano. no serious damage has been reported. there have been at least 15 aftershock s, a magnitude 4.6 earthquake hit malibu this afternoon and could be felt across the los angeles area. there have been several aftershocks, but no serious damage reported. some residents got an early warning a few seconds before the quake hit los angeles woman says she got her own early warning from her

dog. she says the pooch freaked out for seemingly no reason. and then seconds later, the quake hit. since it. >> the suspects arrested for murdering a tv station security guard in oakland will face new gang enhancements in the case. alameda county district attorney pamela price says the gang enhancements have been added against all three men accused in the deadly shooting of kevin nishida. he was killed while guarding a news crew back in 2021. >> the previous prosecutors who charged the case under my predecessor made certain mistakes about who was responsible for the murder of kevin nishida and failed to include some charges that we deemed appropriate. >> two of the suspects were charged individually, while authorities searched for 29 year old leron gilbert. for more than two years, gilbert was captured near kansas city last month. >> a stolen plane land on a half moon bay beach. the video of it landing a bay area driver's damage claim denied by caltrans.

near half moon bay yesterday, and while the investigation is underway, abc seven news south bay reporter dustin dorsey spoke with an aviation expert to learn more. >> this new video shows the dramatic moments when a small aircraft came in for a beach landing. this is just south of poplar beach. around five thursday evening. authorities say 50 year old miami man luis gustavo perez stole the plane from palo alto airport and brought it down 27 miles away in half moon bay. aviation expert max trescott says this type of landing is no easy feat. now this person obviously had some flying ability taking a story off is probably more difficult than landing a citabria, and in fact, the takeoff for a citabria is considerably more difficult than most small airplanes. >> so yeah, i think we can safely assume that this person had some pilot training of some kind. >> the plane belongs to advantage aviation flight

instructor rachel webster. we reached out to webster about her stolen plane. we did not hear back. one of her past students, boris teksler, hasn't either have not heard from her in the past couple of days since this happened, but she's a wonderful instructor and a great cfi. >> i think she's a professor at berkeley as well, so she, uh, she teaches and she i took flight school from her, and she's fabulous. when we got to the airport where webster's plane was registered, we found this hole in the fence. >> police on scene told us the hole was not here yesterday, but we don't know for sure if this was how the plane was stolen. >> i heard that yesterday. it's a pretty shocking thing to think that a plane would get stolen out of, uh, palo alto airport here. >> a shock, but trescott says this kind of plane does notrillionequire key to start them and stealing the plane may not have been hard to do. >> the owner flew the aircraft earlier in the day, and when the owner arrived, the airplane was untied and the cover had been removed, which was quite a surprise. uh, so the owner then flew the aircraft and then later

in the day the aircraft was stolen. so clearly somebody had started to steal this airplane earlier in the day. >> authorities tell us the investigation is ongoing and there's no update at this time. juarez remains booked at the san mateo county jail, arrested for theft of an airplane in san mateo county. dustin dawsey, abc seven news in florida, at least two people are dead after a small plane crashed into a car on a busy highway. >> it happened around 315 this afternoon on interstate 75 near naples. this video shows that horrific moment or the aftermath , as large flames and smoke poured from the wreckage. at least three people, though, survived that crash. >> we recently told you that caltrans paid fewer than 4% of the claims for damage caused by potholes or other road issues in the bay area between between 2020 and mid 2023. >> a fremont man whose claim was denied decided to do some digging, and the reason for the denial might surprise you. >> really might. abc seven news i-team reporter melanie woodrow

is here with the story. >> melanie, dan and kristen. this one is a doozy. as you said, a fremont man allegedly was victim to falling concrete from the richmond-san rafael bridge, something we saw back in 2019 possibly happening again this summer. cal trans now is saying that that driver or telling that driver, rather it's not liable. this ram truck may have been a real lifesaver this summer. marco villetti says a chunk of concrete nearly took him out while driving over the richmond-san rafael bridge, and he hit me right about here. >> it just scared the hell out of me, shattering his windshield. if it did come through. i mean, it was like aim straight at my and my chest out. it will probably kill me instantly. >> the impact showering him with shards of glass. >> i was lucky i was wearing my sunglasses and i didn't get any glass in my eye. otherwise i probably would have been blind. >> now villetti can't believe what he's seeing. more than five months after he filed a claim

with caltrans for damages to his car, the agency wrote back, letting him know based on its own investigation, it determined it's not liable to me is total negligence from state of california. >> it's a state owned bridge and they should own up to it. >> abc seven news data journalist recently crunched the numbers and found caltrans wasn't owning up to most claims, proving less than 4% of claims filed between 2020 and mid 2023. the rejection letters are vague, so villetti called to find out why his claim was denied. caltrans left him this voicemail in response or debris type claims you have to have prior notice of debris falling like falling into your vehicle. >> essentially, it's like debris. debris claims are fairly difficult to prove because we need to have prior notice. essentially you need to have prior notice of condition and then address it timely in order for caltrans to be liable for damages, prompting villetti to call back and leave a voicemail of his own if i get something coming down from a bridge, how can i get prior authorization? >> should i call ahead and say, hey, uh- 7:00 on a thursday

night, we're going to have a piece of concrete coming down from your bridge before for that. that is totally ridiculous . >> in turn, he received this one. >> unfortunately, we have already conducted the investigation. um, again, if you wish to dispute the claim itself , you're welcome to do so through small claims court, something villetti is considering. >> what do you say to that? i mean, if this is the way we are in the state of california and sorry to say, this state is doomed a week after the incident, villetti bought this recording hoping to catch caltrans on camera if it ever happens again. >> we pay taxes and we expect them to maintain the bridges. we expect them to maintain the roads, a caltrans spokesperson tells me. >> you can call up to find out why your claim was denied, but that option is not explicitly stated on those rejection letters. and you only have six months from the time of the incident to amend your claim with caltrans. but in the case of that person i interviewed, by

yes. abc7 news meteorologist sandra patel is here with a lovely forecast. absolutely. and kristen and dan, we deserve the sunshine that we're seeing right now. let's take a look at our view from exploratorium camera, where we are just seeing lots of blue skies. and that's exactly what you want to see. plenty of sun outside allegiant stadium in las vegas this sunday for super bowl at kickoff 55 degrees bright and sunny weather and fourth quarter. we are expecting 49 degrees. little breezy, mainly clear though if you are going to be taking part in outdoor watch parties this sunday. inland areas in the low 60s at 2 p.m. really light winds as temperature falls off by 7 p.m, so you'll need that extra layer down to the 40s around the bay from the low 60s to the upper 50s by 5 p.m, and by 7

facing a harmful spirit. they then ask the victim to put their money in jewelry in a bag so it can be blessed. the crooks then switch the bag for a similar one with worthless items. police say two seniors have been victimized of thousands of dollars in recent weeks. >> make sure that you are not at all turning over your valuables to any strangers. make sure that when somebody approaches you who you don't know to not hand over anything to them, that might be valuable to you. >> the suspects include a man in his 50s and two women between the ages of 30 and 60. officials say victims should not feel embarrassed to report these crimes. not at all. the people doing the crimes should be embarrassed for doing that well. >> plan to bring people back to union square. it's focusing on just two blocks and will cost $6 million. is this what it takes to build a better bay area and the call for more funds to fight climate change and future flooding

getting ready to watch your team play the big game? or still sad they didn't make it? either way, scan to save big. is investing in is the powell street promenade refresh, which consists of transforming two city blocks at a cost of $6 million. abc seven news reporter lyanne melendez is in the newsroom with a look at why it may be leanne, perhaps a little late in the game. >> well, you know what they say. better late than never. now we're not talking about the chandeliers here. these are the first couple of blocks leading to union square, which right now are in need of much attention on so many levels. now the reason they want to make those improvements is because everyone knows that first impressions matter. riding the powell-hyde

cable car line is a way for tourists to go through the imaginary gates of the city, leading to union square. so yeah, esthetics matter. union square was once home to some of the region's most prized retail space. not so much. these days we saw so many for lease signs and boarded up businesses that we stopped counting. a few people here refer to it as the tumbleweed corridor. it's hard to imagine the impression all those empty storefronts are leaving on the estimated 28,000 tourists that. visit the powell street corridor every day. >> i would probably either choose to move or choose to come into the office less so. that definitely has a critical sort of effect on the workers and residents alike. so here's the city's plan for phase one of the promenade refresh. >> remove the aluminum parklets, which, according to the city, have reached the end of their useful lifespan, can instead replace them with what they describe as a simple, clean and

elegant new and wider sidewalk that will bring more attention to the cable car. david irregular here is not on board with the idea. >> a lot of the things that they're talking about, it just don't make no no sense to me at all. you know why it tastes something out that's supposed to beautify the city? >> the city will invest $4 million to begin improving just those three blocks on powell. between market and geary. think of it as a down payment, because a lot more money will be needed to revitalize the entire area. >> ultimately, it's going to be a, you know, many more millions of dollars to do the kind of capital improvements that that area deserves. another $2 million was approved in order to lure and help businesses move into those empty storefronts on those three blocks, except that, as abc seven news found out already. $500,000 of that money has gone to another business owner outside of the corridor.

the mayor chose to spend a half $1 million on two facilities in union square for celebrity chef tyler florence. we were delighted that mr. florence chose union square. it was not a part of the deal. it was not a part of the board of supervisors intention and has really reduced that pot of money to where it's not really there's not enough of it left to do the job that we wanted to do. >> the mayor defended her decision to use the money outside of what was initially agreed. >> it's not about what is enough , it's when we have it. it's available for us to do something amazing. we want to do it. and tyler florence and what he's been able to do has been extraordinary in terms of the revitalization of union square. this holiday season was magical, and we want to keep the magic going. i'm going to work same. >> suppose the end goal is for the new corridor to bring

tourists and people living or working in san francisco to union square, but here's what we discovered. the local foot traffic seems to be staying clear of the area. >> i'm from france. >> where are you from? uh, i live in, uh, in, uh, bethesda, maryland, where tourists. >> definitely another virginia. woodbridge to specific from texas. >> maybe we do have to rely more on on these tourists or sort of out of towners, or just folks who may be traditionally weren't coming through our downtown previously as part of the overall project, cars on the initial two blocks of powell will continue to be restricted. >> according to the municipal transportation agency. that saves on the wear and tear of the cables because the cable cars were not designed to operate in stop and go traffic. >> nick, i think it's really the perfect time to make these sort of low hanging fruit investments, um, to ride that wave and hopefully that leads to larger investments across the city. >> so when is this project expected to begin? well, right now the city is still going through the design. the review and the public comment phases.

so we know that could take some time. but at the earliest it would start in late 2024. in the newsroom, lyanne melendez, abc seven news. all right. >> thanks, leanne. >> thanks, liane. well lawmakers and environmental groups are pushing for money to combat flooding and sea level rise. >> they unveiled the plan at cooley landing in east palo alto as the king tide was rising. assembly member diane pappin of san mateo is coauthoring a bond measure for the november ballot. backers are hoping to make up for hundreds of millions of dollars in sea level adaption funds being cut from the proposed state budget. money, they say, is critical to protecting low lying areas from flooding. >> that happens because wetlands during high storm events, they act as a sponge. they can hold water that would otherwise threaten to overtop levees and when they're combined with levees and other types of protection, they can protect people and property and habitat advocates. estimate the san

whole operation, and he said they expect $120 million to be wagered on this super bowl. and that's not even counting what's going to go on my expense report. if i lose. oh, yeah, we've let them know what's coming. >> all right, super bowl ads cost about $7 billion for a 32nd spot. it's a lot of money. but that's actually cheap compared to what some actors are making. stars can get 1 to $5 million to appear in a commercial. last year ben affleck got $10 million for a dunkin donuts ad. even a cameo from a lesser known star can run $25,000. i saw one uh- preview of a spot that's coming with christopher walken. you know, sandee, everybody watches the game, but we all also watch for these great ads. and i know they cost a lot of money, but they are as much a part of the day as the game in many respects. >> absolutely, dan. i mean, people wait to see those ads. i just think it's really cool. and
