to this case because there is a lot at play tonight, let us start with j.r. stone looking through the new surveillance video and questioning the security guard. >> in the 12 plus years i have reported on stories in san francisco, i don't remember it district attorney ever releasing investigative interviews with someone involved in a shooting like this. but that is what we saw happen today. this n showing a situation that unfolded in a san francisco walgreens last month, security guard michael anthony confronting 24-year-old benko brown suspected of shoplifting according to police. a scuffle ensues and then a short time later the security guard can be seen shooting and killing brown. district attorney brooke jenkins is saying on monday she will not file charges at this time due to insufficient evidence. >> there is nothing to rebut his statements regarding the fact that he acted in self-defense.

>> video interviews with security guard were also released by the da office monday. >> whole time we were wrestling she was saying she was going to stab me. and that is what really put the fear in my heart. she walks towards the door but then she turned around and went back towards me and that is when i already had my weapon drawn. and then she lunged towards me and that's when i fired one shot. >> during this interview with police anthony referenced having to keep brown in a choke hold tight position so brown would not harm him because anthony said he did not have any handcuffs or other way to restrain brown. legal analyst stephen clark commented on that. >> i think what is very problematic is the use of the chokehold. what appears to be done here by the security guard on mr. brown, that in and of itself can be

deadly force and you have seen that time and time again in police use of force cases. >> clark says what is likely to be closely looked at going forward is video of the scuffle in the use of force on brown during those moments and before the fatal shot. da jenkins says that video is just part of this case, witness accounts and an interview with the security guard were all used in her determination to not file criminal charges. >> we have to believe that the time we charge a case, a jury of 12 would convict. not let's just charge the case and see what happens. >> security guard anthony going into more detail about what happened and has happened in the past. >> it is just a few items. it is not worth fighting over normally i would let the individual go with it. but this time it was different because she wanted to fight me back. i do not want to do that.

>> i did group protective services, the -- company the guard worked for to get their side of the story but did not hear back. j.r. stone abc7news. >> the reaction has been swift since the video was released, a protest was held tonight right outside the walgreens where he died. >> the protest then turned into a march going down to san francisco city hall. abc seven news reporter suzanne is in the newsroom getting a sense of the community tonight. >> some demonstrators say they believe the security guard acted inappropriately and wrongfully and agree that shoplifting is a crime, they say that in benko brown's case it should never have ended with a death. street in san francisco monday evening, demanding district attorney brooke jenkins change her decision to not file charges.

they believe benko brown's death should never have happened. >> it is time to press charges. >> the video was horrific. >> demonstrator nancy robles saw the video and is upset at the da and security guard who fired the shot that killed brown. >> she is claiming that it is self-defense, we saw the video we know it is not self-defense. >> brown's family believes the security guard should be prosecuted and the attorney who represents the family says >> i look at the state closely a number of times there was no weapon on benko he was not charging at him there was no aggressive move he made. >> the shooting that killed brown happened in san francisco's supervisor matt's district. >> i would reiterate my condolences to the family members and friends of benko brown. i know that this is something that needs justice. >> dorsey read the report and watch the video. >> i appreciate the district attorney being transparent more

transparent than the law requires. the da was forthcoming have confidence that the district attorney made a decision based on the law and facts. >> san francisco supervisor aaron peskin says he was troubled by the video and he will ask the board of supervisors to join him in calling for further review. >> i am personally asking both california's attorney general as well as the united states department of justice to review the evidence in this case, this is not who we are. stealing a bag of candy does not warrant death. >> attorney birth supports that idea. >> i think another set of eyes on this is a good thing because there has been so much public scrutiny. >> others say it is important to have faith in the system. >> it is important to me that we honor the integrity and legitimacy of our justice system and let it play out. >> and attorney john burr says he is going to go forward with the civil case on behalf of brown's family now that he has

24 hours, you will notice that 5:00 in the morning there's going to be widespread gray, temperatures in the 50's as we head towards noon. inland areas are already popping up into the 70's and 80's so it is going to warm up into the upper 80's to low 90's away from the coastline by 7 p.m.. it is comfortable but cool near the coast as we head towards midnight, more fog and low clouds so it is warmer here for a day and it is going to be warmer in yosemite. mid to upper 80's all week, concern is flooding as the snow melts rapidly. flood warnings and advisories up and for the yosemite area. there is a flood warning in effect for the yosemite national park, this era snowpack at epic levels. it statewide 327% of average and with warm weather like that you will see rapid snowmelt and concern for flooding. i will be back with a full look at the forecast coming up. >> that warm weather in the yosemite valley is forcing some partial closures in the national

park, ranger say the melting snow and rising water level of the merced river is a significant safety concern. many yosemite visitors are now being turned away including a group of friends traveled there from switzerland. or than 6000 miles away. >> is a big part of our coming here this morning and getting kicked out, it was kind of disappointing for us. we are a bit disappointed. >> that's understandable, park rangers say it while they hate to kick people out of campsites it is better to keep people safe from potential flooding. >> abc 7 is committed to building a better bay area and that means working through big issues like homelessness, tonight at 11 we are finding a breakthrough in the bay area's largest city, san jose. improvements are set to -- on coyote creek after flooding neighborhoods more than five years ago in 2017. valley water is starting a flood protection project from keeping it from happening again, before

improve public safety and cleanliness and help watch out for unpermitted street vending in the mission. and our final building a better bay area breakthrough is in oakland tonight where we are to celebrate the new class of bright the area minds. oakland unified held its 22nd annual oscar right celebration of african-american academic excellence awards. the event celebrates nearly 2000 middle and high school students who made honor roll, organizers say they hope to inspire other students who did not make the honor roll this year. >> they see their classmates doing it and it will create that momentum and the encouragement for them to follow along and move forward. by having this event it creates more motivation for more of our students and our scholars to reach these goals. >> these are some bright hard-working kids, students had to achieve at least a 3.0 gpa to be honored, recipients were given a metal that translates to

in the u.s. the cdc said the government supply expired last week. people can still get vaccinated for free with the pfizer or moderna shots as long as federal supplies last. dan: more than 3000 schoolteachers are expected back in their classroom tomorrow after a tentative agreement was reached. the new deal includes pay raises for teachers and a calls for adding more librarians, counselors and additional preparation time. >> it has always been important to me to move to a culture stability and achieving equality for every student, family and employee in our district. we have moved the needle significantly in that direction today. dan: the union is declaring victory with regard to their common good goal saying the agreement includes assistance

for on housed students and resources for thriving community schools. >> san francisco is about to launch its newest change in 70 years. the agency is also adding sunday meter hours from noon until 6:00 p.m. the changes will be made in six phases starting this summer. this will make parking meter hours more consistent citywide and will generate revenue to help sustain community service. dan: we have heard the idea of a four day work week that we found one bay area town trying it out for real. >> the city of los alstom altos is leading the way. we have a look at how it is working out. reporter: the city is allowing employees to choose their own work schedule. >> they did not want a rigid

schedule and as long as we can make that work with being open to the public and available, we thought we should give it a shot. reporter: city workers have three schedule options, the traditional five days or nine longer days over two weeks to get every other friday off for the most popular option, a four-day work week, 10 hours each day. >> we have seen immediate improvements in our workforce, the morale, people's satisfaction with their jobs. reporter: the city created the program for their employees after the pandemic and it has been fine-tuned over the last year. we spoke at the city clerk who started working in april. schedule flexibility was what she was looking for. >> it is important to have those days to decompress from work. reporter: melissa thurman was glad to see this opportunity provided from a local government agency. >> they are telling you that

interesting happening in alberta, canada where wildfires are burning. i want to turn your attention to where the majority of the smoke is traveling. it is heading down towards the united states but as i show you our side you will notice how the smoke is drifting in towards the pacific northwest and northern california and the upper parts of the atmosphere. the smoke has been visible here locally aloft. let me show you the smoke forecast. the smoke is expected to impact much of the northern purest states of the united states, the midwest and even parts of the east coast. if you have travel plans you might want to keep this in mind as the smoke is heading in our direction. already seeing some of that allow -- aloft. we saw fog down below but notice
