shows a cop slamming a woman to the street. there is more to the story than that. we'll have it coming up in a live report. >> i'm meteorologist kristine hanson, we've got fog out there this morning. i'll show you when the sun will show later. >> good morning. we're off to a good start, bay area freeways, no delays at the bay bridge toll plaza, but there could be potentially big delays for a.c. transit riders. >> thank you so much for joining us. i'm eric thomas. >> and i'm kristen sze. san francisco police are dealing with a new video scandal. an officer surrendered his badge after a video shows him slamming a handcuffed mother face first into the pavement. >> terry mcsweeney is live at the station with the details on this. >> reporter: first of all we should point out he has been assigned to desk duty and that is standard procedure when an

officer is under investigation. let's take a look. this video happened on sunday, two officers stopped a woman, she had a baby in a stroller with her. she is also a suspect in an assault. she is arrested and handcuffed. she is belligerent. police say she is drunk. she is handcuffed led to the squad car. watch as she resists officers, finally one officer tosses her to the street where she lays still for a few seconds before starting to move again. the child in the stroller throughout the video can be heard crying. the officer -- the ambulance arrives after the officer called for one. the woman is taken to san francisco general. she also bites a paramedic. the issue is whether the handcuffed woman and in custody needed to be treated in that way.

there might be more to this story we can see even though there were eyewitnesses from a camera above. there may be going on the ground. that is what the investigation is going to be looking in to. chief george gascon promises there is going to be a thorough investigation. after a contentious meeting, oakland as voted to become the first city in the nation to license wholesale pot cultivation. they voted to approve a plan to license four large scale marijuana farms. four permits will likely go to the largest growers because the permit will cost $211,000. they say bigger is safer but smaller growers fear it will nudge them out of competition. they are considering a sales tax on marijuana, a hearing on that is set for tomorrow night. a second and final vote on the wholesale pot proposal is

expected next week. this morning the los angeles times is reporting that schwarzenegger could make history for a nominee to supreme court. governor will name appellate court judge as the next chief justice. he would become the first asian-american to lead the state's judiciary and she would give the smipt a female majority for the first time in its history. 50-year-old sacramento native is a graduate of the u.c. davis school of law. and if approved she would replace ron george. san francisco police are looking for a woman who has gone on a bank robbery spree. this image is from one of the two bank of america. first was on balboa and 38th in the richmond district. second was last friday on diamond heights boulevard.

the woman is either white or latina, about 5'3" weighing 130 pound. san francisco police want to hear from you if she looks familiar. >> in vallejo, little league baseball coach that punched an umpire was booked in solano county jail on assault. they report that he told the paper he was defending himself when the umpire charged him when they argued a close play during a seventh inning during a game. bail was set at $5,000. he faces a maximum fine of $2,000 or up to a year in jail. >> san francisco board of supervisors approved a city budget late last night after lengthy negotiations with mayor newsom. it closes a $483 million deficit mayor newsom submitted a budget june 1st that included sharp cuts to most city departments and layoffs of hundreds of city

workers. they reached an agreement and restored $44 million to city programs and job creation and mental health services. they must take a second vote next week and mayor can sign or veto the measure. looks like the weather is going to be good today. >> maybe indoors -- i think you have to head to palm springs, 104. that is the sizzling temperatures we can find statewide. central valley coming down to the 80s and low 90s. 58 degrees in redwood city. 53 in san francisco. 55 in fairfield. overcast near the coast that is extended around the bay, late morning burnoff. coastal layers very thick. however, we'll start to see the

charging more for beverage containers. they cooperated with the investigation without admitting any wrongdoing. >> opponent will sign a financial reform bill today that gives federal regulators new power to close failing banks, monitor consumer loans and control dids. they say the regulations will build markets less prone to collapse. opponents call it overregulation. here is more from rob nelson. >> ben bernanke heads to capitol hill today to give his report card on the economy. he is expected to down-play the odds of the economy slipping back into recession despite signs of the recovery is losing momentum. he will offer new steps to bolster the economy if necessary. >> $700 billion bank bailout is winding down but a government watchdog says taxpayers are still propping up the financial industry. federal support for banks have increased 23% the last year even

though the crisis has past. report also slams the administration's house can relief program says it has not put a dent in foreclosure filings. bp is selling assets to help pay for the cleanup costs in the gulf of mexico. they are selling $7 billion worth of assets to another oil company. part of it will go to a fund to pay cleanup costs and damages to local businesses. that is your money scope report. i'm rob nelson. >> it's now 5:13. >> microsoft pushed the price on the motion sensing game controller. it will cost $150 when it goes on sale. it recognizes gestures and voices so you can control games by moving or speaking. it will come packaged with one game. sony is developing a similar system. >> do you hated getting off the couch to grab a drink during a

even if it's yogurt or ice cream it's summer. you know. we do have overcast skies in san francisco and we have seen this a lot the last couple of mornings and it's getting deeper. about 2200 feet deep. it's hugging the coast and inland areas up around 80 and 580, everybody getting fog this morning. you have to get quite a ways inland and even inland areas are feeling the affects of it. 58 in oakland. 52 santa rosa. couldn't find any visibility problems. we have 400 foot overcast and 7 mile visibility. our fog will give way to sunshine later this morning, especially around the bay while it hugs the coast throughout the day. cooler temperatures as a result of the deepening fog. cool air drifting from the gulf

of alaska, this may break things up tomorrow. again, this shows we've got a low pressure out in southern california, so a little bit of fog and cooler air and cooler temperatures we're forecasting today. >> still plenty of sunshine after the fog clears. 75 in san jose. these temperatures are one or two degrees cooler than yesterday. not much sun but 57 in the sunset. city should see a little bit of sunshine, needing sweaters and jackets with the breezes 10-20 miles an hour. still warm well inland with low 90s. hercules, fog gives way to sunshine for east bay. still chilly, 80 in morning hill and here is way it looks the next seven days. just a tad warmer tomorrow and friday and then we'll stay nice

all the way through the weekend. frances, i know we were looking at the golden gate bridge. it may be a little damp. >> as you mentioned we're seeing some of the overcast conditions. as you can see traffic is light but it's not slowing anyone right now. you can see most of the span right there. just the overcast conditions. check out interstate 80 in berkeley, only 19 minutes from the carquinez bridge down to the maze and, of course, no delays at the bay bridge toll plaza. check out the south bay, headlights move on northbound 101 and connection ramp to northbound 680 is all open. it was scheduled to be closed through 6:00. and northbound 280 and that is highway 17 right across your screen. you can get the latest traffic conditions and drive times by going to our website at

good morning, i'm teresa garcia live in oakland where a shot out chp car tells the story. 580 shooter headed back to court this morning. we'll explain what he is facing and who the targets were coming up. >> after hours of debate, oakland city council approves a plan to create four large scale growing operations. >> and we tend to see a break in the overcast but cooler temperatures forecast today. >> it's still looking good on the freeways. 680 outside walnut creek a little more traffic on the road but nothing to slow you down. a.c. transit delays and we'll have more on that coming up. >> and san francisco police are investigating one of their own officers. they are looking at new video to see if an officer used too much

force to a handcuffed suspect. it's 5:29. i'm eric thomas. >> and i'm kristen sze. our top story, the gunman who shut it out on 580 with chp officers has a court appearance this morning. they say based on new information on where the suspect is headed, they prevented a potential blood bath. teresa garcia is live in oakland with details. >> they it could have turned into a horrible situation. if you look at chp cars behind me, it's such an intense picture to see out the blown out windows. these are the bullet holes as a result of the 12-minute gun battle between the suspect and four chp officers. with so many rounds exchanged, it's amazing the injuries were not worse or fatal for that matter. this morning, byron williams is being held without bail. he is headed back to an oakland courtroom.

he'll enter a plea of attempted murder of four chp officers. williams is two strike felon on parole for bank robbery. they say he is anti-government sealot. he said, quote, he hoped to start a revolution. he was on his way to kill workers at americans civil liberties union and tides foundation. >> this person is obviously a very unfortunately unbalanced soul that he might engage in as they kinds of behavior. >> it's diabolical even. >> in this video you could hear the intensity of the gun battle. chp is calling its officers heroic for their work. chp says the gunfire unleashed after the they saw the suspect reaching for a gun. williams was shot several times

but suffered less injuries because he was wearing a bulletproof vest. you can see the holes, so much repair that has to be done. he could face federal charges. f.b.i. is investigating the contents of a binder found in his truck. all they are revealing that it had the word california on the binder there. after a contentious meeting, oakland has voted the first city in the nation to license wholesale pot cultivation. they approved a plan to license four large scale marijuana farms. four permits will likely go to the largest growers because the permit will cost $211,000. one company owner says he has a 57,000 square foot warehouse waiting to be used. they say bigger is safe but small growers feel lower priced pot will nudge them out of

competition. they argue that it will dilute the quality of marijuana. >> there will be a big difference in the product. it would be the difference between a fine wine and a bottle of mad dog 2020. >> it's centralization and makes it easy for oakland to regulate and tax. >> oakland lawmakers are considering an 8-12% sales tax on marijuana which could generate much needed revenue for the city. a hearing is set for tomorrow and final vote is expected next week. >> 5:32 a san francisco police officer has been transferred to desk duty while the department investigates whether he used too much force in the arrest of a handcuffed woman. it involves an officer and shows a woman who officers say was drunk and pushing a baby in a stroller. they believe she was a suspect in an assault they were

responding to. she shouted obscenities at the officers while they were trying to get her in the patrol car. she then turns toward her baby in the stroller where one officer appears to push the woman's face into the pavement. she was taken to san francisco general hospital and on the way she bit one of the paramedics. >> a.c. transit is hoping most of its drivers will be on the job. 200 union members have called in sick the last two days. it comes after the board imposed a new contract on sunday. a.c. says it will help cut the deficit. a hearing is set for july 30th to have that contract rescinded. the owner after an evacuated apartment building in pacifica has failed to meet another deadline to repair an eroding a cliff side or demolish the building. they report the owner of the building at 320 esplanade he has

83 in tahoe, still hot in the san joaquin valley and even hotter in southern california. a chilly start for the day but a nice ending to it. complete forecast is coming up. thank you very much. it's 5:44. >> stories we're following, oakland city council voted to be the first city in the nation to license wholesale pot cultivation. they approved to license four large scale pot farms. a final vote is expected next week. >> a suspect involved in a 12-minute shootout with police is expected back in court to enter a plea. he is accused of attempted murder and they say he was on his way to san francisco to kill officials with aclu and tides foundation, the organization that says that it promotes

economic justice. >> a police officer has been transferred to deck duty while they investigate. ples say the woman was drunk and yelling obscenities and right there, the vad is showing one of them pushing her face first into the pavement after failing to get her in the patrol car. very latest is coming up at 6:00. federal aviation officials say 30 people were injured, one critically after united airlines headed to los angeles hit heavy turbulence. the flight from dulles was diverted to denver where it landed safely. most of the passengers were taken to the area hospitals, suffered moderate injuries. they were bounced around in the wide body cabin when it was over kansas. >> i saw at least two people hit the ceiling.

a girl in front of me hit the ceiling. >> everybody was actually very calm and it was over before you knew. >> it rest of the people took off on another flight to l.a. they are looking into what the altitude was when the turbulence started. senate is expected to begin voting in about two hours on a bill to extend unemployment benefits for 2.35 million americans. democrats overcame a republican filibuster with the support. bill would allow unemployed workers would receive 99 weeks of benefits. republicans demand that it be off set by cuts in the budget. >> london times is reporting that bp chief will step down in late august or september. he has been under intense pressure to resign in the wake of the gulf oil spill disaster.

they say the resignation would make it easier to fend off buyout threats. they are down playing that the well is buckling under pressure. >> now that the oil spill is contained, bp is considering a new way to kill the well. a government decision about the plan could come as soon as today. >> if it's approved to do so, it's hundred percent chance we'll go ahead with it. >> the plan is called a static kill, forcing 200,000 gallons of mud and cement through the ceiling cap. they tried a similar plan in may but this time the cap has stopped the oil and it continues to hold. >> there is some minor leaks in and around the blowout preventer and the stacking cap itself. >> incident commander says five small leaks are most likely seep fragile a nearby well no longer

in production. it's an encouraging development in an oil spill that has now extended three months. >> a louisiana meeting tuesday night, people avoided their frustration with no money coming in and an exclusive interview, david ram con told diane sawyer he is frustrated, too. >> when you see the pictures of the oil pouring out of the underground well and doing environmental damage, damage to wildlife and beaches. that makes you angry and i want bp to sort it out. >> bp says it's selling $7 billion in assets in north america and egypt to help cover costs. >> there is a potential new concern. thad allen are watching storms around puerto rico to see if they will impact the gulf. bp has now acknowledging it posted on the website an altered photo that exaggerated the

activity at the command center. it showed workers monitoring a bank of ten video screens displaying underwater images from the gulf but a bp spokesman admitted two of the screens were actually blank in the original photo and a staff photographer used software to alter the images. company put up the unaltered picture on monday after a blogger wrote in about the discrepancy. >> water continues to pour out of a man made lake after a dam break. a 16 foot high section of the rubberized dam burst open last night. it sent thousands of gallons burke g usual that a dry river bed. warning signs begin wailing within minutes and they rushed to warn people of the rushing water. no reports of injuries and no structures in danger. lake can hold up to one billion

>> overcast around the bay this morning. we'll see a little bit of morning burnoff especially inland areas but it will be cooler today. we've got a cool weather system that has dropped down out of the gulf of alaska and these systems produced all the rain, but it's going to move across and some of the cooler air will mix down to the surface and start to see a break in the overcast tomorrow. here is the gray area of fog along the coastline right now. it calls for afternoon sunshine, 80 in saratoga. 77 in san jose. menlo park, los altos hills, 71 and 72. 57 in the sunset. chilly day in san francisco, you do need a jacket or sweater. 58 in bodega bay. 58 in hercules.

you can see some upper 70s and low 80s. and 61 in monterey. it will warm up the next couple of days. let's check in with frances. good morning. still looking pretty good on bay area freeways. we have a liet live shot where you see the golden gate bridge, overcast conditions but traffic is fine across the span. it's fine on 101 all the way along the peninsula down to the south bay where we have a live shot of 101 at the 880 interchange. headlights move northbound about half-hour ride from gilroy up to this intersection. just a reminder for a.c. transit riders, bus drivers may call in sick today leading to big delays. bart is a great alternate this morning. check out drive times, not much problems.
