you know, we're not perfect. >> that's as close as steve jobs got to apologizing for the antenna trouble that caused them to drop calls. jobs held a rare news conference in cupertino to answer questions with what was wrong with the phone and the solution. >> we want to give even a free case. every iphone user will get a free case. >> abc7's sean alston is live outside the apple store in union square. a lot of people are headed to apple stores to get the cases. >> they are available in stores as well as on-line. not everybody reported experiencing problems with reception, but after spending nearly $300 for the phone, why not take advantage of the free cases?

it didn't take long for some to get their free bumper cases to take care of reception problems. at the apple store he bought a new rubber casing. he will be reimbursed for the $29 he spent. >> do you think less of apple now? >> no. i i didn't have a problem with the new iphone. i am just doing it because i got the e-mail saying it would be reimbursed. >> one person who has a problem with the way it played out is apple's ceo, steve jobs. he took to the stage in up coulder tino trying to downplay the bad press. >> we think there is a problem , but we think it is affecting a small percentage of users. and we think some of the problem is inherent in most every smartphone. >> jobs began his presentation with a you tube video that partially blames the media for the publicity. >> ♪ the media loves a failure

♪ and a string of successors >> behind the video is jonathon mann who created the song in his berkeley bed m roo. he posted it thursday afternoon and got a call from apple asking to use it. >> when i screamed with delight i said, absolutely. >> a satisfied iphone 4 customer who said he was not paid by apple, mann considers his video a satire of the situation. >> what it boils down to is if you don't want one, don't buy one. if you have one and you don't like it, you have 30 days to bring it back, and they will give uh complete refund. i don't see what the bid deal is. >> he teaches -- she teaches and got the iphone, and says consumers may think twice the next time steve jobs rolls out a product. >> the next time he says it is the best product ever, it may linger in consumers' minds. but really they are so beloved by their users.

>> incidentally she will be getting her free case as well. new buyers can get the free case up until the end of september. jobs said again today if customers were not happy with the phone they could get a full refund. john alston, abc7 news. >> thanks, john. meantime, investigators are another step closer figuring out how gizmoto got their hands on a prototype without apple's knowledge. they approved a deal for gizmoto to hand over documents. in exchange, prosecutors will return a computer and other items seized in an april search of the home. police are investigating whether any theft occurred of the iphone prototype. gizmoto said they received it from an anonymous source after an apple employee left it at a redwood city bar. the investigation continues. a small grass fire sent a huge plume of smoke into the sky. th is a view of the towering column from our traffic camera in san jose. a lot of smoke.

the fire started around 7 and burned four acres near highway 87 and kertner avenue. the photos were sent to us at you report at kgotv-tv .com. one witness said ash was falling from the sky. no homes were threatened. crews had the fire out by 8:45. police rai -- are investigating a drive by shooting in berkeley. a man in his 30s was found slumped over the wheel of a car parked near russell not far from the berkeley bowl. police say the shots were fired from a dark gray or maybe blue nissan maxima. the victim's identity has not been released, and there is no word on a motive from the shooting. it was berkeley as third homicide of the year. a community policing strategy has lead to a drop in crime. it is called zone enforcement. that's where officers are deployed to neighborhoods where there has been an

increase in crime. in the first six months of the year there was a 10 percent drop in violent crimes compared to the same period last year. property crimes dropped 12 percent, and there was one less homicide. an important change for the bart police department tonight. after a deadly shooting and controversial verdict and the riot that followed everyday citizens will have a say in the way bart police respond and it could improve service and safety. here is abc7's laura anthony. >> today is a historic day for bart. >> with that, the bart president announced the establishment of an over sight commission for the transit agencies and the embattled police force. >> we are pleased that we are doing an important job of trying to restore public confidence. >> the oakland assemblyman sponsored the bill that created the commission. it is as a response for the january 2009 shooting death of

the unarmed passenger oscar grant. last week a los angeles jury found the former bart officer guilty of involuntary manslaughter in grant's death. >> we feel sorry and responsible in many ways for the tragic death of mr. oscar grant. >> the 11-member panel will likely help set police policy and training procedures as well as doll out punishment. it is to officers who violate the protocols. the police chief welcomes the extra scrutiny. >> if you are not aware, our military organization has civilian oversight. >> some think such oversight could prevent another event like this. >> we hope to never have another oscar grant event again. >> it probably has no impact at all in terms of oscar grant. >> john burris represents grant's family in a $25 million civil suit against bart. he thinks the commission is a positive step.

>> if there is accountability for the officer's action, then you have -- you are more likely to make sure they don't engage in inappropriate behavior. >> the adjudication of any disciplinary actions can now come to this body. they can review almost anything, and what that brings to the table is the transparency that was so lacking in january of 2009. >> now, the new commission will begin it work on january 1st, 2011. that's exactly two years to the day after oscar grant was killed. in walnut creek, laura anthony, abc7 news. a young man from napa was among four soldiers killed in action this week in afghanistan. 21-year-old specialist chase stanley died wednesday when the truck he was in ran over an ied. he was assigned to the 27th combat airborne engineer battalion which is based out of fort bragg, north carolina. dozens of firefighters could receive layoff in thees

as early as monday. the firefighters belonged to one of three unions yet to reach an agreement with the city. the police officers' union approved a contract earlier this week to avoid lay of yos, but they did not agree to all of the city's demands. san jose is struggling to balance a record $118 million deficit. meantime, a judge today ordered ac transit and its largest union to go into arbitration to settle a contract dispute. the bus drivers and the mechanics' iewn union called for arbitration when the ac transit board imposed a new contract after talks broke down. the agency is facing a $56 million deficit. a new contract would have saved $16 million. and state employees apparently will not have to take a big pay cut in minimum wage. they wanted salaries reduced to $7.25 an hour until a state budget is signed. but a judge today sided with the state controller john chung who said it would take

69,000 hours to reprogram the state's aging payroll system and cost as much as $11 million to do so. the ruling guarantees that wages will not be cut before september. by then the state is expected to have a spending plan in place. >> in all of being caught in the middle of this trap of legislative politics, we are finally being recognized as being the tax-paying everyday citizens we are for the state. >> at this point the state budget is now more than two weeks overdue. the sonoma county sanitation district is being fined $348,000 for violating california's water code. the violations are linked to 37 sewer overflows between january of 2007 and last january. the district says that money would be better spent with upgrades on the sewage system instead of fines. the fine is scheduled to be reviewed at the october 13th public hearing. good news so far in the gulf. there are no signs of any leaks from bp's busted oil

well. this is a live view from bp's camera in the gulf of mekz. -- gulf of mexico. the cap that cutoff the gushing oil is still holding, but pressure readings are lower than engineers expected and hoped that 6700 pounds per square inch. they thought it would be more like 7500psi. this could mean the reservoir that feeds the well may finally be depleting. that's a good thing. but if the pressure drops suddenly, that would not be very good. >> it means that there is a potential leak there. now, remember if there was a sudden drop in pressure, at that point you get a heart attack. that is the nightmare scenario. >> keep in mind this cap is a temporary solution. bp is drilling two relief wells, that's the key. once those are ready, the busted well will be sealed with a mixture of mud and cement and everyone hopes the leak will be stopped once and for all. a lot more to come here this friday night as -- friday

that's why managers are trying something new this weekend. >> it is a win-win situation. >> park place will be the first restaurant to host the taste of compassion. for $24, they will get a two-course meal and the nonprofit west valley community services will get half the proceeds. >> that will help fund our homeless and hunger prevention services. it provides service to the community by people coming out to get food themselves. >> the restaurant expects the partnership will bring little financial payoff at first. >> it is a way to get exposure. >> the taste of compassion was a year in the making. organizers already have 10 restaurants from all over the south bay lined up to part pate. the restaurants host for two days a month and then rotate from cupertino to los gatos, saratoga and san jose. thousands are counting on this campaign for their own survival. >> if it wasn't for west

valley community center, i would still be out on the street. >> west valley needs to raise $150,000 to save two programs, a mobile shelter for men, and a food pantry for west san jose families. >> stress, a lot of stress. >> it will impact me, but i'm looking at the next person whose life has been turned around that needs that helping hand. >> that help is coming one meal at a time. in cupertino, lisa amin, abc7 news. the artificial turf in california parks and schools is about to get safer for children. the state reached a settlement with two major artificial turf companies. they agreed to reduce the lead in their products and replace old turf with high lead levels -- with high lead levels for free or at a discount. they say the danger comes when the turf start to break down. >> you get essentially dust

that formed out of the turf as it breaks down, plus the pigment. so that dust will have lead in it. >> and this settlement will cover the cost of lead tests at daycare centers, schools and playgrounds that bought turf after october of 2004. if you are concerned about the safety the -- of the turf at your school or park, click on see it on tv. there is a number you can call to get test results or to request testing if you are concerned. the construction of the fourth bore on the tunnel has turned into a treasure hunt for paleontologists. according to our media partners at the oakland tribune, they are sifting through the dirt and the rock from the tunnel excavation and looking at fossils from millions of years ago. th is the first time cal trans has called in paleontologists at the beginning of a bay area freeway project. they never had to do this before. so far they found a tooth likely from a camel and remains of fish scales, plants

and other bone bits. pretty interesting stuff. they did not expect to find that there at the dig site. let's focus on the weather forecast. the weekend has arrived. the heat is not quite as bad as we first thought, apparently. meteorologist sandhya patel is here with the forecast. >> that's right, dan. we did see some heat inland, but the temperatures didn't make it to where we expected. it was up to 100 in antioch. mid-nineties in concord and livermore. the fog was back with a vengeance and the onshore breezes. the wind coming off the cooler ocean waters and brought the temperatures down today, believe it or not. a 41-degree difference between half moon bay and antioch. tomorrow we are looking at a 36-degree difference between coast and inland. i want to show you from the time lapse perspective what it looked like. the view at sunset, look what is in the foreground. the marine layer, 8:31 p.m., and that marine layer has deepened in the last 24 hours. it is now running 1500 feet

deep, so it has made its way into santa rosa, mountain view is reporting gray skies. temperatures in the 50s and 60s across most of the region. 83 in antioch. the fog spills into the bay tonight. warm inland this weekend, and it is turning cooler next week. so the temperatures fell a few degrees today. still going to expect that tomorrow. here is the main reason for it. the fog is pushing in over the bay by morning. and we are expecting slower clearing with a stronger breeze again tomorrow. so tomorrow morning first thing in the morning we are looking at mid60s inland. the coast side in the mid60s, and just the far inland reaches will wake up to clear skies. the fog never quite leaves the coastline. it is keeping the temperatures in the 50s and 60s. you will need the sweater or jacket. if you are inland it is nice and sunny and warm as opposed to hot. we will go with 90s inland. here are your specific temperatures, 83 in cupertino. 88 in los gatos.

san jose, low 80s. a nice, sunny day once the gray burns away. 77 in redwood city. 83 in lossal toes. upper 50s at the coast. so not exactly beach weather. daily city, 58 degrees. downtown san francisco, 64. in the north bay you will see low 80s around santa rosa, napa. remember, you will wake up to overcast in the morning. in the east bay,69 for new oakland. 78 in union city. head inland and you will still find the summer warmth, just not as hot as we were expecting. 94 in antioch. 92 in livermore. around the monterey bay, 65 degrees in monterey. this weekend, by the way, sunday is the aids walk san francisco. it could not be better conditions than this. 57 to 60 degrees on sunday. there will be fog around. west wind 10 to 15. but the fog just makes it easier to walk on sunday for the aids walk san francisco. so summer warmth inland, mid-nineties. coast side upper 50s to low

have probably not seen it before. the berkeley revolution hoed a team from puerto rico to participate in the north american uni cycling championships or known as the u-games. the shorter one starts along the embarcadero around 9:00 a.m. in san francisco and an 18-mile race called the tour of san francisco that traverses the city starting at 1:00. pretty good. i would like to see the tour de france go to one week. >> not a lot of dunking in that game. >> a little tricky. how much hang time?
