state supreme court any moment now as we learn the prosecution's star witness, michael cohen, has a date. he will be on the stand on monday. we're waiting to see if the former president speaks before going inside the courtroom. judge merchan is denying the gag order modifications turned down late yesterday and trump could be could remark on a lot of this. we have a quandary are foreign policy. an ultimatum. threat to withhold aid from israel prompting republicans to draft articles of impeachment. dana has the day off the day after her big birthday yesterday. live today. not our birthday today but we're here. good morning, great to see you, i'm martha maccallum and this is "america's newsroom." a lot going on today as you pointed out. court about to get underway and also this big interview resonating from president biden who has threatened to withhold

weapons from israel if the nation decides to invade rafah. that decision has enraged a lot of people on both sides of the aisle in many ways. and some saying it amounts to a quid pro quo. >> bill: rafah is the final stronghold of hamas along the egyptian border. four battalions of hamas fighters said to be in that town. prime minister benjamin netanyahu that israel will defeat the terrorists with or without american support. >> i've known joe biden for many years. 40 years and more. we often had our agreements but we've had our disagreements. we've been able to overcome them. i hope we can overcome them now. we will do what we have to do to protect our country and that means protect our future. if israel has to stand alone, we'll stand alone. but we also know we aren't alone. we have so many decent people

that it needs, all of them. but he does not want certain categories of american weapons used in a particular type of operation in a particular place. >> many progressives have pressed the administration to withhold support, there is bipartisan opposition to biden's decision to withhold certain bombs and artillery shells if israeli defense forces invade rafah. >> you have the kind of enemy that has no conditions or morals or decency, or any kind of a bottom. and i don't think we should have any kind of conditions. >> senator fetterman added he hasn't seen any israeli conduct that would justify adding conditions to military aid for israel. republican senators say they'll try to reach a bipartisan agreement to reverse the president's decision. >> we are going to look at what tools do we have.

two tours of duty in saudi arabia and iraq. we have one true ally in that region, israel. keep in mind that is is shall -- we have got to support israel and reject the leftist approach to destroy the very fabric of our country and our beliefs and our background. it is that simple. one of the strongest things i've seen from a diplomatic sand point when president trump moved the embassy to jerusalem. a shot across the bow to the entire world to let everyone know that we side with israel and if you mess with our allies as we say in texas, if you mess with the bull you'll get the horns. because of that, the world was a safer place. we were all left alone because we picked a side. joe biden right now wants to have his cake and eat it, too. and you can't split the baby on this. you have to support our only ally in that region and if we didn't have the feckless leadership we wouldn't be voting to spend billions of our tax paying dollars to make sure we didn't have a conflict.

it wouldn't exist if we had peace through strength and that's what we had during the trump administration. >> martha: based on your military experience, the mission was to take out hamas to eliminate the threat. >> yes. >> martha: there are still four battalions, the highest ranking in rafah. hamas is the way they operate. surround themselves. hostages are in close proximity to him as well. my question for president biden and for you in this instance is how do you get rid of hamas if you hold them back from using these precise guided weapons in rafah? >> it's time to take the gloves off and let israel do what they need to do. hamas has sworn to wipe israel off the map. israel has shown a lot of restraint. they could do a lot worse and they haven't. it's up to us again, like i said, pick a side, allow israel to do what needs to be done to

protect themselves and their sovereignty so they can continue to exist. hamas has vowed to destroy israel. they vowed to destroy the united states. why are we even allowing this to happen? >> bill: you wonder if hamas survives in the end. think about that possibility. october 7th, go back to october 8th in hamas survives. want to talk about politics. a poll about african-americans and how they feel about joe biden. traditionally pretty good vote for democrats when it comes to african-americans. they found this in june of 2020 they had 74% for democrats favor. now it's 62. i don't know what happens. maybe this can change. that's a 12-point difference there. in june of 2020 overall vote was 72%, now 68. here is what we found. one in five black voters who turned out for biden say they're less certain whether or not they will vote at all this year. >> yes. >> that's a very big problem for the democrat party. if you can't attain at least 80%

of the black vote, guess what? you have a problem and you won't win in november. i want to tell people this. black issues are american issues. we're voting our pocketbook. the highest inflation i've seen in any lifetime. the worst border crisis i've seen in my lifetime. people are having a hard time putting food on the table. as a black man and black for my entire life i care about what all americans want, a thriving economy to provide for my family. we had that under president trump for four years. now we don't. and now we want it back. it is that simple. this is one of the few topics in the entire country we have had back-to-back presidents. we know what each man can do and now we have a rubber match. let's go head-to-head and i think will want trump's economy more and better than what we have seen in the last four years. >> bill: we shall see. you've been black your entire life. >> good morning, bill and martha. it was donald trump's long time lawyer and fixer who would always defend his boss. on monday he will testify against him. i have learned that yes, michael cohen is set to take the stand here at manhattan criminal court on monday called by prosecutors to testify and detail the alleged scheme to pay off stormy daniels and pay back cohen. madeleine westerhout is out the stand. she told the jury yesterday how trump's checks would arrive from trump tower in new york city and then the president would sign them in the oval office. she testified that she set up the meeting one month into trump's presidency with trump and michael cohen. reports have claimed she was in that meeting and set to testify that she heard trump and cohen talk about that deal but i have

been told she actually was not in the meeting. she was sitting at her desk that was just six feet outside the oval office door. she testified on the stand yesterday she cried saying she thought that trump was a great president who was being treated unfairly quote, i thought it was really important to share with the american people the man i got to know. i don't think he is treated fairly, she said. he is amazing. i just found him really enjoyable to work for. she said trump and melania have a close, loving marriage. quote, i believe they have a relationship of mutual respect. no one could put him in his place but he was my boss, but she was in charge. their relationship was really special. cohen is expected to detail the alleged payment agreement in which stormy daniels was paid off to stay silent in which michael cohen took $130,000 out of his home equity account and

rally. i hope you'll be there in wildwood, new jersey, a big crowd and we'll be saying a lot. we'll be able to campaign on saturday. nerve the less we have horrible gag order. jonathan turley, the predominant question in the manhattan hush money trial of former president donald trump is not one of guilt but something far more basic. is the district attorney alvin bragg's case a joke? is it a prank? is it a farce? on thursday the answer became clear, it is all of the above but it is also an abuse of our justice system and assault on the rule of law. that's jonathan turley. although it's a long story, this

case is highly -- presided over by a very conflicted judge, conflicted like i've never seen before. who refuses to take himself off the case and it should be a mistrial. their objective was to humiliate and smear trump and they got the detail of sex that had nothing to do with the criminal charges at issue. had nothing to do -- >> martha: we'll see if we can get it moving again. former president trump citing jonathan turley's piece calling the case an assault on the rule of law as we have seen really throughout this. the former president using this opportunity to get his feelings out there and to keep it within the parameters now of what he can talk about and he can clearly talk about the judge. he is very conflicted. that's outside of the rules around the gag violation. that's fair game. talking about a rally this weekend which he would make the

was never done before in the history of the world where the world was turned off. it went -- we were spending 4 1/2 trillion dollars when we went into the pandemic in federal spending. the pandemic sent it into the 6 trillion level and that phased out right when biden came in. remember, he kept a lot of those programs intact but he has maintained that $6 trillion level throughout his -- he has upped the ante. baseline number and his regulations, war on fossil fuels sent oil prices up. we see gas prices that went up from the low $2 levels up to now it's scheduled to be $4 a gallon in september. that's what the eia is saying. bottom line is, this is biden's fault. he doesn't want to admit it. he sees no signs of changing. in fact, it could get worse

because his 2025 budget, which he has forecast is settled to be at 7.3 trillion. not only is he not going back to the 4 trillion level he is doubling it up to 7.3 trillion. it is going to get worse if he is reelected. of course, the 2025 a lot of the trump tax codes phase out so he is going to come in with a lot more taxes. a lot of them is corporate and capital gains taxes, a big hit to the stock market if you have a 401k, you will be in deep trouble. he says the rich. the whole stock market will go down as people sell stocks because they don't want to pay 50% tax. that will bring down the whole level for everybody. a lot of middle class people have stocks in 401ks. another term of biden would mean more and worse of the same. if you think what we've had over the past 3 1/2 years is bad. >> martha: david, thank you.

witness. more on that in a moment. want to bring in jonathan turley and jonna spilbor. here is the question. irony in here, jonathan. they asked the judge and merchan has rejected trump's request to subpoena mark pomerantz. who is that? he is a former prosecutor in the d.a.'s office in new york who left his job and then wrote a book about trump's real estate history. the judge writes that the requests are, quote, far too broad and amount to an improper fishing expedition into general discovery. they seek information on topics that are not relevant, end quote. i think trump's attorneys have been arguing that for a week now, have they not, with stormy daniels? >> yeah. we just spent two days with them trawling the entire ocean of lurid details with stormy daniels.

for this judge to express concern that maybe this is a bit too broad really, i'm sure, produced a couple of muffled chuckles in the room. pomerantz is an interesting character because he was brought in to make this case. he and another prosecutor resigned after bragg decided to throw a flag on the case. remember, bragg's predecessor declined the theory. pomerantz and his colleague pushed it and bragg also had misgivings. pomerantz did a public campaign to pressure bragg to bring the charges. his own office told him you shouldn't do this. this is still under investigation. you are a former prosecutor. you are undermining your own office. but pomerantz was unrepentant and it worked. bragg knuckled under and brought the charges and why they wanted to bring him forward.

i am not surprised by the judge's ruling. but coming after the stormy daniels catastrophe, the r rationale is a bit glaring. >> martha: it feels like the things the defense brings forward will all be part of their appeal case if there is a conviction in this case. would this be substantive in terms of an appeal that this witness was denied when other witnesses could also be considered broad? >> it will be cited. this is going to be the weaker of the challenges because it is very hard to knock a case out on selective prosecution. i have tried it as a criminal defense attorney. it is very hard. judges don't like to get into motivations. show me there is no crime here. they can, there is no crime here. the reversible errors are mounting in this case. one of the earliest ones was

question because we're not lawyers. and i just want to -- trump is talking about the legal system being on trial during this case, everybody watches it. everybody around the world with the former president. you both would agree and made the argument many times here. here is what the judge at the end of the day yesterday said denying the modification of the gag order. he said my concern is not just protecting daniels, my concern is protecting the integrity of these proceedings as a whole. now, i listened to what you guys have said and listened to trump and say the gag order is unfair and it's illegal. the reason the gag order is there is because the judge said he can't trust trump to go after the witnesses while they testify. and therefore the prosecution does not share the witness list with the defense, with one exception, michael cohen who will be there monday and that just happened right now. the judge says i can't keep filing the guy. i can't shut him up.
