>> trace: when it comes to new york versus trump, where is the crime? we are live outside the new york supreme court with more on the former presidents legal cases. >> good evening trace up your during the last hour or so the cross-examination of former american media ceo and president david pecker again. trump's lawyers asked him about his relationship with the former president which dates back years. pecker said that he alerted trump about possibly damaging stories as far back as 1998. long before trump got involved in politics. he said it's a mutually beneficial relationship or from -- for both men. he also suppressed stories including celebrities involved in politics like arnold schwarzenegger. during his it... pecker said that he said the motivation behind suppressing stories about was to protect the

thursday about that. trump was not able to attend supreme court arguments about presidential immunity today. if the court operates as a normally does, justices will hold a -- hold a closed-door vote tomorrow. they can send it down for more action. the timeline certainly will be watched closely as the november election approaches. >> trace: that could delay things quite substantially. live for us in new york. let's bring in attorney... it's interesting because you look at this whole case and we get the notes out from the court. we have producers inside the court and some of the reporters inside there and they are sending us notes. the word conspiracy pops up time and time again. there is no charge of conspiracy >> you were supposed to put your strongest witness on first. if this was the strongest witness for the prosecution they are hurting bad appeared he testified he didn't deal with trump related to this issue, he only dealt with michael cohen. where is the criminal intent?

>> you look at this and david pecker, this was the opening witness for them. the pecker quote is this, we did not want the story to embarrass mr trump or embarrass or hurt the campaign. again if you look at the list of crimes, it's not a crime. he was hiding stories about arnold schwarzenegger, they kill stories all the time. >> that is not a crime. this witness essentially put on everything trump's attorneys were arguing. catch and kill is not a crime. paying hush money is not a crime. where is the crime? this is going to be very difficult for the prosecution. it's confusing, when there's confusion that's reasonable doubt. >> trace: the gag order, the hearing is pushed in next week. it's interesting because a lot of legal analysts have said this is a one-sided gag order. michael cohen can talk on his podcast and the former president cannot say anything. what do you make of the gag order? >> i think it's unconstitutional

unilateral. michael cohen is a witness in this case and if the idea is we don't want to take the jury pole, you don't want to intimidate witnesses, why wasn't the gag order imposed on all of the witnesses? trump is the one who's on trial. he should have a right to defend himself is the point. let me say this, this case should have been stayed pending trump's appeal of that gag order. the first amendment is a pivotal constitutional right that he's been deprived of. i've never seen a gag order like this. >> the supreme court heard the immunity case for the former president. the headline here from the wall street journal, the supreme court focuses on the presidency not trump. he goes on to say oral arguments aren't always a signal of ruling but it sounds as if a majority is... that are part of his official duties. the key then is distinguishing between official and private actions and the justices may

send the case back to the trial to consider the facts regarding the charges and evidence against mr -- mr trump. this could delay things even if it doesn't go fully his way. >> i think most likely the court will issue their opinion in june and there's no way that if this gets kicked back to the lower court which are likely well, that will be resolved before the election and that's a win for trump. remember he's been trying to delay this pending the election and if unc can get the charges dismissed against him. >> trace: thank you be appreciated. and cite israel protests now spiting to college campuses around the country and some of the confrontations between protesters and police are becoming physical and more hateful. the senior correspondent is live at columbia university. good evening. >> really... many campuses become -- becoming scenes of violence. one of the worst was a university in today. some demonstrators came on to

campus, they were removed using teargas, tasers and even some rubber bullets. some screamed as they were carried out. officials were quick to say that these protesters were not part of the campus community. they were not every student. all of them were outside agitators coming onto cause trouble. here tonight we are concerned about possible violence, a heavy police presence surrounding columbia. they were competing marches today. one pro-israel, the other anti- israel. some of the flyers said be prepared for a fight. we haven't seen a fight here but we could see one as the deadline to remove the tense approaches and the effect is really being shown all over. they are going to have to cancel their graduation at usc for fears of security. it -- same thing could happen at columbia just two weeks away. >> trace: steve thank you. the fox news at night

commonsense department understands that two students were question during an anti- israel rally at nyu. the question was simple, quote, what is the main goal with teitz protest. the answer was so intriguing it caught fire on social media. , fire with common sense. not because it was rational, reasonable and involved high-end college credentials but because it was honest. the answer was i think the goal is to showing our support for palestine and demanding that nyu stops. stop what you asked? we don't know because the students stopped speaking until she finally gathered her weights and continued her thought, saying i honestly don't know all of what nyu is doing. truth as she doesn't know anything nyu is doing. she turned to her friend and asked the friend what nyu was doing and the friend replied quote about what he or so they know how to chant, how to dress

$200,000 about $7500 a year it goes up. so much for not taxing those who make less than $400,000. >> that is a really hard hurdle to scale. in a normal year republicans typically have to make the case that we want corporations and job creators to pay lower taxes not higher taxes. that is sometimes a tough message. this year biden is taking away all those problems and making republicans arguments for them. these tax cuts did benefit the majority of americans and i don't know how you can possibly defend taking them away. that's a tough message. >> trace: back to the middle east if i can. biden risking losing somewhat -- left-wing voters. they are winning the white house there has to be a shift in its approach to issues such as israel's war in gaza and the southern border. >> we have seen the progressive wing of the democrat party

become an incubator for these times up -- these types of radical policies. we are watching how this is affecting college campuses all over the country. at the same time when president biden is in new york talking about microchips and raising money with celebrities, republicans went to the belly of the beast. they went to columbia and they were standing up for all of these students who are facing this discrimination, this hateful speech and this harassment. it's very clear where the republican party stands on this and where democrats stand. >> maybe trump takes new york. here he is today talking about some hard hats. >> normally a democrat will win new york. biden is the worst president in history and we have some very bad people here but we have the greatest people and they are right behind me. they all want us to run and we're going to run very hard in new york. we have a good chance of winning new york in my opinion. we will give it a shot. >> trace: i have about 20

speed to the university of southern california has cancelled its main commencement ceremony amid the disruptions caused by ongoing anti- israel protests on campus. christina coleman is live with that story. >> university of southern california is effectively closing its campus during commencement next week -- next weekend requiring tickets to access the school and events there and subjecting guests to screening and bag checks. they said it would take too much time to give roughly 65,000 students a guest through these new procedures. they will still host dozens of other commencement activities and receptions as they have in previous years. the cancellation of the main graduation ceremony is the latest development in a saga that began ten days ago in... made a move of cancelling the graduation speech of this year's valedictorian sighting safety concerns. however, the valedictorian

maintains that the speech was cancelled due to her pro- palestinian views which many have called anti-semitic. earlier this week the majority of u.s.... following the university's decision. >> it conveys to muslims on campus that the university will not stand by them. it will not stand by them when they are slandered or advocating for palestinian human rights. >> nearly 100 pro- palestinian protesters were arrested last night on the campus protests have intensified at colleges across the country. demonstrations earlier this evening growing tense just a few miles north. pro-israel and pro- palestinian groups clashing at ucla where protesters set up another encampment and similar scenes played out today at stanford, university of minnesota, i university in atlanta and george washington university in our nation's capital. on of those schools have

announced changes to their graduation security or have decided to cancel their speeches so far. >> trace: thank you. let's bring in california policies centre attorney... thank you both for coming on. i would like to get both your take on the usc cancelling the commencement ceremony. what do you think about this? >> it make me very sad for these kids. it's 2024, these are the same kids who missed on -- missed out on their high school graduations because of covid lockdown spirit they can figure out how to provide security, give the protesters of free-speech area, let them do their yelling and let the kids have a ceremony. also you are reaping what you sow because this valedictorian was a minor in resistance to genocide. she was taught all of this at the school. >> you've been in southern california for a long time, your thoughts on this. >> this is the consequence of the leadership that is lacking

any moral compass. it's ultimately the beast that's been created. it's sad for the students and the expenses they lose out on this opportunity because they don't give into the demands of a few agitators. >> i think i found some of that $24 billion that the state wasted on the homeless thing and they have no idea about. $1 million, technically 1,008,944 is what a new permanent supportive housing for the homeless project in santa monica will cost per unit. they've given it 19 names so they can charge more but a million bucks for every -- there's no way to pay for this so they will have to raise taxes >> it's objectively insane. the fact that the city approved this really just boggles my mind. i think what they could do with that money is they could probably get at least five to

ten times as many people sober and off the street with treatment. get them off the street, maybe they can get a job and pay for their own housing. >> you know they are coming for you because they don't have the money to pay for these things. they have to have the money somewhere so they come after businesses, homeowners. it's just the process in california. >> when i look at those numbers that's what i think. look at this budget. 20 percent of this total cost is going to soft costs. they are typically the permits and fees. they don't say what those soft costs are for. we know that that's going to get siphoned off by all of the bodies. this is also a wet project appeared they do not have to discontinue any drug use, they can continue using drugs and they will not be suffering any of the consequences. >> trace: the washington free beacon writes the following. as california, voters sour uncashed reparations, they push

subsidized property taxes and expedited to business licenses instead. julie what do you think? we're going to give everybody business licenses and then pay some of their taxes off and people like the chef you just wait. >> everyone should have an opportunity for an expedited business license. it shouldn't take a very long time for anyone of any race to get a business license. but if my memory serves, california was never a slave state. in recent history we did in turn japanese people in california. i'm confused as to why this is a priority. it doesn't make any sense to me. >> the state has no money. putting these projects aside, unemployment is insolvent. businesses pay money to unemployment insurance and that money is gone. that's a ponzi scheme by its definition. we should be talking about getting the state and a real budget surplus and then we will have that conversation. >> trace: you are very funny.
