in the washington swamp important, very important oral arguments today at the united state supreme court on presidential immunity a decision here will not only have an immediate impact on the weapon night doj quest to prosecute trump in hundred 93 days but also lasting ramifications or as neil gore said, the justice put it we are writing a rule for the ages the question at hand can a u.s. president to be prosecuted for his actions in office, is there absolute immunity, is their limited immunity? can obama be charged, for example,, for killing americans in a drone strike which happened overseas? can george w. bush be charged with allegedly lying to congress about iraq if a far left prosecutor decides to cook up charges? can joe biden be charged for killing a family afghanistan
6:05 pm
during his deadly withdrawal? here is how trump's legal team put it earlier today listen. >> the implications of the court's decision here extend far beyond the facts of this case could president george w. bush have been sent to prison for obstructing an official proceeding or allegedly lying to congress to induce war in iraq? could president obama be charged with murder for killing u.s. citizens abroad by drone strike? >> sean: only the constitutional judges on the court seem to favour limited immunity or absolute immunity but in other words that would be a huge win for donald trump official acts carried out by a president would be immune from prosecution however a president could still be charged for personal acts like taking bribes russian oligarchs joe has dinner with café milano take a listen.
6:06 pm
>> if an incumbent who loses a very close highly contested elections nose that a real possibility after leaving office is not that the president is going to be able to go off into a peaceful retirement but that the president may be criminally prosecuted by bitter political opponents will that not lead us into a cycle that destabilizes the functioning of our country as a democracy? >> do you agree that there are some core functions of the executive presidential conduct that congress cannot criminalize? >> yes. >> is that a form, you call it immunity or and can't do it but what's the difference? >> does the president have immunity, are you saying there's no immunity presidential immunity even for official acts? >> yes justice thomas.
6:07 pm
>> sean: do you really want your president thinking, any president at any time thinking about his own personal legal exposure on every official decision that they make most presidents, especially ones without any moral courage like we are witnessing with joe biden and israel would be utterly paralyzed he kind of is but naturally the left-wing justices who are probably eager to see trump behind bars they propose this obscene hypothetical scenario which by the way is not what people have been talking about in reality that's not what the discussion is put to throw it out anyway it's listen. >> at the president decides his rival is a corrupt person and orders the military or order someone someone to assassinate him he is that within his official act for which he can
6:08 pm
get immunity? >> he can depend but that could well be an official act. >> it could and why? because he doing it for personal reasons. >> sean: under limited immunity the present was still be charged for committing that illegal act because of personal benefits this leaves us with three main questions what will the justices ultimately decide decide, when will they make the decision and will it completely up and the weapon night doj charges against all trump will they remanded back to a lower court? jonathan turley allen dershowitz langone straight ahead but first more disruptive hate filled protested a more clashes with police and some universities now have thankfully restored order like the university of texas who issued a very clear directive our university will not be occupied, good for them, other schools refused to enforce their own rules and it keep their students safe as they let far

>> sean: fox news contributor jonathan turley is with us as well jonathan turley we appreciate you being with those we will get your take first on the argument before the supreme court today on the issue of immunity i always thought the better argument was limited immunity not absolute immunity putting all of that aside i thought a lot of interesting points were brought out by the justices if i may and i think that if you look at the comments of clarence thomas who said what about presidents that have been leading to efforts abroad or arguments about barack obama and killing drone strikes americans i thought those opening arguments by the trump attorney was a well thought out argument or the same thing with george w. bush and the argument they made there, will the -- will this apply to all future presidents will it be in the back of their
6:16 pm
mind as they make life-and-death decisions which is a big part of their job. >> i thought that these were pretty penetrating questions from the justices that three liberal justices made very clear early on they were going to vote with special council but the remainder of the justices were concerned about arguments on both sides they didn't like the sweeping aspects of the trump team argument but they also did not like the sweeping argument of the special counsel and chief justice john roberts delivered a haymaker on the dc circuit quoting a line from them which basically said that these acts can be prosecuted because they are being prosecuted and that circular language really sort of produced some chuckles in the room but roberts was asked a very serious question, how can that be the standard for presidents, it looked like they were trying to sort of grope in the darkness and find a third
6:17 pm
option, something that gives protection to presidents while not giving them carte blanche. >> sean: i agree i did see your expost about wavering rebuttal which i agree with you, that was a little unexpected and frankly an opportunity missed in my view. >> i was very surprised when chief justice roberts turned to trump council and said rebuttal and he said no thank you and that is something that you rarely see there was a lot still on the table and i don't know of any circumstance quite frankly where you ever pass on rebuttal in the spring court. >> let me ask you this i don't see a definitive ruling against trump, i know that it's not wise to maybe listen to oral arguments and think about how these justices ultimately will rule i think ultimately a majority of justices, and this
6:18 pm
is my impression they seem inclined to ruled the former presidents have protection from criminal charges but not absolute immunity i don't know if that means remanding it down to a lower court i don't know if that means that they will give instructions to a lower court earth they will just outright decided right there, what are your thoughts? >> if this trajectory continues for oral arguments it was a good day for donald trump because there were five justices that were clearly not buying into the dc circuit approach that does not mean that they are going to say that trump is immune to prosecution but at a minimum if that is the case they would likely have to remand it to the district court to say we need you to develop this record of it further if they do that it is hard to see how this could possibly be tried before the election and if former president trump is made the next president then jack smith may never see a

jury in this case it could and the prosecution. >> that and of course the other case at the hearing unrelated to donald trump involving people with january 6th that could also impact the special counsel's case against trump as well, professor jonathan turley thank you sir here with moral harvard law professor alan dershowitz is with us, fox news legal analyst gregg jarrett, greg we will start with you tonight i will let you pick it up at any point, i have always felt that limited immunity was the better argument from what i got out of the oral arguments and from what i was gleaning from what the justices were asking they seem to be inclined to go that way but that was my impression you know far more than me. >> i think you're right brett cavanaugh for example pose the question what is to stop a creative prosecutor from using a vague statute to criminally charge a president especially a
6:20 pm
prosecutor from the opposing party and gore search warrant about prosecutor is misusing criminal law to target political opponents and alito warned of a slippery slope with a loser in an election always getting prosecuted like in banana republic's so it's been clear to me that this is the court that will grant some form of immunity because they were focusing so much on the nixon versus fitzgerald case that did give presidents immunity from civil lawsuits with certain conditions and i think that the court may extend that immunity protection to criminal prosecutions because of the same reasoning applying in the alternative they may say well we are going to send it back to the lower court with guidance on immunity parameters and allow that court to craft the rule for for the review but either way i think that dj six trump case in washington get
6:21 pm
sent back down and jonathan is right that process is time-consuming bracing for hearings it seems impossible now that a trial could take place before the election. >> sean: professor i'm dying to get your thoughts on this did you glean the same thing that we cleaned? >> first i want to say that show and i stand with you and with the pro-israel christian and jewish students at columbia and i would be willing to go there and speak to them and within with you or without you, i stand behind them number 1 number 2 i was shocked that trump's lawyer waved rebuttal, i've done about 250 appeals in 249 of them i have always argued rebuttal the only one i didn't was a case where it was clear that we had one and we didn't want to muddy the waters, the only point i want to add to jonathan excellent point is this, i think
6:22 pm
that jack smith has an option and i wonder if yes thought about it he could actually achieve what he wants to achieve , as sleazy as i think it is trying to mainly get a down and dirty conviction before the election if he did the following, a fee tomorrow had the grand jury reindict donald trump only charging private acts not acts that are immunized trump's own lawyer acknowledged publicly on the record that it would be constitutional permissible to indict and try a president for private acts and of the indictment as it exists today is a combination of jumble really of private acts and public acts so jack smith would probably have the option of going back and getting a new indictment and thereby moving the supreme court decision by simply taking the position that trump's lawyer made and using it
6:23 pm
as the basis for prosecuting he may lose that case obviously because i don't know whether there is enough in the private act to warrant a criminal prosecution but that is an option that i know i don't think he knew else has thought of so far that jack smith could do i don't want to put any ideas in his head because i hate this prosecution and i think it's unfair i think it's unconstitutional that it's wrong but it would be interesting to see if jack smith try to take that concession and run with it, i don't know what the court would do. >> i'm not sure if i would have made that concession, but with all that said. [ simultaneous talking ] >> sean: do you agree this has no chance of being tried before november at least is that your take? we've got ten seconds each. >> i think it's just impossible to get this done, it's inevitable that the supreme court, regardless of their precise decision they have to
6:24 pm
send it back down to the lower court for findings or fact at the very least by the trial court judge. >> under the current indictment it can't be tried before the election but if they manned the indictment to include only the conceited public-private events it is possible but very unlikely >> sean: thank you both, when we come back the economy wreaking havoc on more americans than ever before probably the worst economics statistic i could ever give you we will explain that straight ahead

catching up with him it's a shame it's all the way down from 1.6 and i'll tell you nobody thought it would be possible it looks like it's heading down from there. >> sean: now that is an accurate and realistic and true picture of the economy we take a look at the numbers shall we, 1.6 percent gdp growth as president trump pointed out, plus 1.7 million full-time jobs have now disappeared in the past five months alone according to government data look at this mortgage rates no chance of them going lower by the fed so they go back higher over 7 percent making homes even less affordable and get this, this should every american needs to hear me closely here 26 percent of americans, 26 percent of people that you know told gallup they have struggled to afford food in the past year here is another bad part, at we are the

a joke couldn't even afford fast food i made my own food every day but this is our fellow 26 percent of americans struggling to put food on the table and joe biden saying it's the best economy ever how out of touch can he be? >> i think he's wildly out of touch and the reality is most americans aspire to the american dream that you would i have lived my parents came to the counter with no my four years ago by founded multi- billion-dollar countries and i'm worried that american dream won't exist for our kids and their generation and the numbers coming out now back that pop under this administration on one hand you see inflation ticking back up on the other hand gdp growth has flattened there's a word for that it's called stagflation what put jimmy carter of the white house and i think that joe biden is now at risk for good reason of being the jimmy carter of our day but the reality is this prices have gone up mortgage rate and interest rates have gone up to supposedly combat that inflation and yet wages have remained flat
6:33 pm
so no matter what the bidenomics professors say americans at home especially americans struggling to make ends meet and struggling to live the american dream understand the impact that has had on them it's no surprise you see the poll numbers where they are with the economy and the border not culture war issues but the economy and the border at the number 1 number 2 concern for all americans and i think that is where it should be. >> let me get your reaction to these bloomberg poles because i think that they are if i am joe biden i would be pretty alarmed you have trump and wisconsin 44 trump arizona 4942 georgia 4943 pennsylvania up by one north carolina 5141 up by ten nevada 5143 the only state he was down in, swing state, i'm not even sure i buy that part because i think that michigan sent a pretty loud message that scared the hell out of joe biden and scared him enough to give up and

to remain biden if these numbers continue to persist through the summer these people have always been one step ahead and the other thing is this cannot just be a 50.1 marginal election first of all we need decisive mandates to have both the senate and house, decisive control and let's be honest a landslide minus some shenanigans is still a decisive victory that's the kind of margin we need to be shooting for, complacency is not an option so i don't think what's getting these poll numbers cheering right now is particularly helpful or constructive get down to work actually deliver victory actually state what we stand for without just worrying about the other side that's our going to win this election. >> sean: we stand for voting early and voting by mail that's important matching or surpassing ballot harvesting issues of the democrats and i'll add another issue people get mad at me but i'll take the heat you had better understand where the country is on abortion i believe that the repeal of roe v. wade had a big impact on 2022 republicans have got to

>> president joe biden: are you ready? >> sean: here with reaction former white house chief of staff frank previous and a host of tommy laren is fearless tommy laren i just can't get over the pause thing tommy first of all he has to encourage the crowd to say four more years and then it says pause he supposed to shut up well he reads it and then the white house puts out the official transcript saying in audible, that was pretty audible to me, reaction. >> i checked the transcript today and they did in fact put schumer leaders so at least there was some honesty in today's transcript but i have an idea for whoever's running the biden circus over there in the future just turned the teleprompter around so that we can read it for ourselves i think that would be a much better idea it would give us much more of an idea for what he is supposed to be saying and maybe that is the true solution here sean, just let us read it for ourselves he clearly can't

most of us can luscious do it that way from here on out. >> your take orion's, you look at the swing state polls including your great state of wisconsin and trumpets up by four they are in the latest bloomberg poll which is such an important state and joe biden like michigan had 50,000 democrats in the democratic presidential primary vote uncommitted reaction. >> thank you that is funny stuff but on a serious note since you have turned it serious this age issue is hayes achilles' heel there is no doubt about it and you can see it because if 75 percent of democrats say that joe biden is too old to be president of the united states that is a foundational issue it goes to enthusiasm that goes to volunteers it hurts them beyond the border beyond the lawlessness beyond the economy
6:55 pm
the age issue is about mental acuity diminished faculties as the report laid out and you can see it in the choices they're making not just putting these crazy things mattel proper but not doing a super bowl interview why not? it's on cbs it's an easy interview you're not can it do it, why not do a two-hour press conference like president trump did take every single question anyone can throw at him until it's over, the last thing it's not about age, this is about having the ability to do the hardest job on the face of the earth, i sought every day we saw the oval office i saw the situation room i saw in the tank over at the pentagon this is not easy and it is how he is acting that makes americans nervous 75 percent of his own party. >> sean: tommy is convinced that gavin newsom will take his
6:56 pm
place what is your take? we have about 20 seconds and put in tommy to the test every day. >> a committee meeting at the convention all of the delegates will be the biden delegates, it only happens if joe biden wants it to happen if he says i'm out then it will happen. >> sean: tommy you are out on a limb i think it's an educated guess we will see thank you more hannity is next
