jonathan diller shot and killed earlier this week during a traffic stop. he was just 31 years old and leaves behind a wife and a 1-year-old son. president biden also in new york for a fundraiser tonight with former presidents obama and clinton. new york city mayor saying biden called him to offer his condolences for the death of officer jonathan diller but let's bring in leo tyrell here with me onset in los angeles, but first national correspondent brian yunus live at the funeral home in new york. brian. >> reporter: it's been raining all day but it's let up. now the hundreds if not thousands of mourners are lined up outside here. can fact this line wraps around the entire funeral home as far as we can see from our vantage point and they are here obviously to honour officer jonathan diller and to offer condolences to his family. he leaves behind his wife

monday when he was shot. shot in his stomach below his bulletproof vest. the suspected shooter had 21 prior arrests and had to speed and charged with first-degree murder today. also charged with attempted murder khaki tried to shoot his partner but the gun jammed. tributes have been pouring in all day and there is a memorial outside the precinct he worked out in queens new york. eire long island there ribbons lining the streets to honour him. last night nearly a thousand people showed up if raised online $2 million if not more his mortgage has also been paid off for their family and the new york city mayor is expected to be here any moment to offer his condolences. grace. >> trace: brand live for us thank you. let's bring in leo tyrell civil rights attorney and fox news contributor. you kind of look at what happened there the former president being there.

andy. >> yes. trace the important thing about those statistics and i know statistics wash over people sometimes when you come at them but the key there is that only a very small percentage of crime that gets committed actually results in arrests and prosecution. and, even when you're dealing with career criminals who have lengthy rap sheets these 2 characters multiple arrests, 1 of them had 21 arrests and the other 14. convictions, times in prison. that's only a small percentage you can be sure of the crime waves they've been involved in and responsible for. a very large percentage of crime , especially urban crime, is committed by a very small scented of recidivists -- repeat

offenders. they have to be behind bars there is no way to keep our country or city safe as we're saying -- seen. >> you spent the early part of your group and people behind bars and couldn't terrorists. andy i am wondering from your vantage point now, what is the remedy? what is the fix for what we are seeing happening on the streets? i point out again an 11-year-old-year-old chicago boy was killed by a man who is serving a 16 year prison sentence and they let him out. he went to the ex-girlfriend's house, pregnant, the 11-year-old trying to protect his burnt mom and is killed by this career criminal who should have still been imprisoned. >> huh the tragedy of this trace back when i was a young prosecutor we were still having a crime wave in new york and having a lot of crime in cities that the country. then we had a revolution in how you do law-enforcement.

and from the early 1990s until about i want to say probably 2015 or so, you have record drops in crime. we had an amusingly and flourishing society precisely because we had driven down crime to levels people would've said were impossible in the 1990s. so, it would be 1 thing if you and i were having this conversation in the 1970s and were saying gee what do we do? the fact is, we lived through it, we know what to do and we know what works and law-enforcement. but progressive politicians and not letting those policies be incremented. you have to have intelligent policing that follows data and that has police deployed in the places where crime is spiking before crime gets out of hand not afterwards. and you have to stop this voodoo of impact analysis that makes you decide, you know, law

enforcement or the system is racist because of the number of people who get arrested disproportionately into their supposed group. crime isn't racial, crime is recidivists and it's in small pockets of areas. those people regardless of their race or ethnicity have to be detained and they have to be detained for a long time. if you don't, they end up being responsible for many more crimes then they'll ever be arrested for. >> yes, very quickly andy lastly i think as you surveyed the length -- survey the landscape do you thank the countries tired of this? dew you see change coming clean because i see some of these far left prosecutors being put back in office again and again. >> yeah, and they get reelected by k. by their own communities. i wish i could tell you i saw a sea of renaissance on the horizon but the fact of the matter trace is this got much

it is local and it is the individual das, prosecutors are in these local jurisdictions that needs to be called out. i have covered the death of 2 other police officers there in new york. i have covered rivera and another officer who were both ambushed in new york. it's a very sad day when you think about it for a second. a traffic stop by law-enforcement officers should not be the death penalty. you had this young 31-year-old officer, we need to say his name jonathan diller. a 31-year-old police officer, a hero who was out there who is leaving behind a wife and a

1-year-old child. this is vary tragic but it goes back to 1 thing trace. we need to respect law-enforcement officers and we need to put in place laws that take these individuals off the street and keep them off the street. >> trace: yes you're exactly right. you have a unique perspective of this because ted we've talked about these crimes for 25 years. before that you are a police officer before you became a lawyer. you know this from every angle and i'm wondering when you hear that this person who allegedly killed jonathan diller had 21 arrests, 9 of them for felonies and as andy was saying you know that's not the length or the extent of his criminal record. >> absolutely right. 21 years of crime and longer. this was a career criminal.

the other driver was there with him, lindsay jones. career criminals. the problem we have in our society is that we can only hold these people in jail for so long the recidivism rate dealing with these lawbreakers are just off the chart. i take my hat off to any of these law-enforcement officers who go out there and try to serve and protect us and they deserve our respect. and i'm just hoping some days trace the law-enforcement officers, the prosecutors and the judges, they will all come together in these various jurisdictions and tried to do the right thing to protect and serve the members of that community as law-enforcement officers are doing. >> but how do we convince them to serve when that's the whole thing? how do we convince officers i

have a nephew who is an officer in san diego, how do we convince them when no 1 is backing them up including their superiors. >> you know, it's an excellent question and i've got to tell you to nephew and other law enforcement officers they get out there and doing their job and serving and protect us, it's the most disrespectful job that anyone can probably have. we have to take our hats off and be ready they're encouraging them. members of the community, when you see that police officer walk up to him and establish a rapport with them. talk to him or her. that is what is needed to help root out someone's criminal element. the majority of people in america are law-abiding citizens and they don't want to be under the guise of dealing with the

hearing and former president donald trump's election interference case in georgia since prosecutor nathan wade step down because of his relationship with the dea there and he will list she is still on the case. now the former president's lawyer is trying to get the charges thrown out. the senior national correspondent is there for us with more, jonathan. >> reporter: hello trace. we expect a decision from the judge at a later date he spent today's hearing arguments from prosecution and defence regarding a defence motion to dismiss the indictment against former president trump. trump attorney stephen saito argued the former president's efforts to overturn his 2020 election loss were protected speech. >> it is unconstitutional to force and accuse the president of of the -- former president or anyone else to stand trial on protected speech. it's not just that he lied over and over and over again as the council points out by listing

the instances in the indictment it's that each of those was employed as part of criminal activity with criminal intentions. >> this was indeed the first hearing of the georgia trump case since march 15th 1 special prosecutor nathan wade resigned from the case as a condition for district attorney fania willis to continue prosecuting it. >> he was more involved than think with witnesses and negotiating plea agreements. for important work but it's not the kind of stuff we would see in the courtroom and arguments day in day out. i don't anticipate, you know, anything really changing in terms of how the district attorney presents their case in the courtroom. >> so, with wade out willis is still the top prosecutor in this case but expect an appeal from the defence. they said the judge's ruling did not go far enough since he gave the dea the option to stay in
