on air. >> steve: stay tuned to see if he does. >> brian:ats a cliff hanger, like "dynasty" 1978. >> lawrence: final hour of "fox and friends" starts now, our morning is better because you are our friends. >> brian: new york judge in donald trump's civil trial is ordering to monitor the trump organization for another three years. >> ainsley: the former president has until monday to post the $450 million bond. he says he has been denied by 30 insurance companies. >> steve: and judgement in westchester county, new york. >> lawrence: laying ground to seize property like a golf course and his industrialing estate.

matt, you have been practicing law for a long time. average-day american that looks at this -- >> brian: average american does follow the law. >> steve: they don't comment on the law. >> lawrence: exactly. >> brian: go ahead, counsel. >> lawrence: you are my wingman, clean up my mess. >> lawrence: is this typically the way a process like this would work? >> it is good to be with you all this morning. you are dating me. this is the process people watched play out with this judgement for almost half a billion dollars seems unfair to a lot of americans and it is untethered to anything. you can't point to the amount of the loss or the amount victims were harmed or there is no relat

relationship, they just picked a number. attorney general of new york and this judge determined this was the number and they are going to start grabbing his properties if they can. it is unfair and unamerican that it really calls into question if anybody can get a fair hearing and a fair trial anymore. >> steve: matthew, it comes down to due process, he's gone down that court case was determined. now he's going to appeal it. the judge says you want to appeal it, put up the whole amount. but he has not run out the legal string yet. seems like it is not fair he might have to sell a bunch of stuff at fire-sale prices if ultimate court decides this case says that fine that half a billion was way out of line. >> right, steve. it could make him sell things at a price that is not appropriate
5:05 am
or assets are worth less. they are pressing him so hard to get him at a disadvantage. it is really just seemed like this court has been pressing so hard without the due process. without constitutional rights like eighth amendment right against excessive fines, those things don't seem to apply to donald trump. americans need to take cloear note of what is happening, it could happen to any citizen. >> ainsley: especially in new york, if you are a conservative. this just shows how important the judges are. supreme court is very important and now we realize local judges are important, too. they are going to determine the amount he has to pay, whether or not he goes to prison. do you think when you look at this case, he did anything wrong, matt?
5:06 am
>> i don't think he did anything wrong because if you think about what the alleged crime was or the alleged behavior, it was estimating his assets as the wrong price and wrong value. look at mar-a-lago and suggest it is worth somewhere, certainly worth man than the court assessed, less than $20 million and some houses around there are almost a billions dollar, including the land. the whole thing seems to be a railroad situation by this judge and the new york attorney general. >> brian: what happens next? by montday, i believe a five-judge panel will decide if the thousand-page appeal on the $t $twour 450 million is good enough to knock it down.
5:07 am
they have a list of people who asked for less and get less. these are bonds so he doesn't leave town. he will not leave town and we know he's got a monitor there already. what are chances of those judges deciding it is excessive, let alone the appeal? >> they could secure this ju judgement in different ways including agreement between the parties. the appeals court is in no hurry to decide by monday, it could decide today or in three weeks. that puts donald trump and his companies in a tight spot if they have to come up with half a billion dollars. he'll have truth social go public, that will give him a cash infusion, i think there are opportunities and he will move
5:08 am
beyond this monday deadline no matter what happens and this case will be decided on the merits, which everybody wants because they see how unfair the judgement is. >> steve: mat whitaker, thank you for following the law these many years. >> brian: one question, looks like fani willis wants to get her case going by summer. knowing the trouble she's in and scrutiny she's under and the judge will let that appeal go through, is that possible? >> she may want that, i don't think complicating factors of that case will allow to go to trial by summer and ultimately that case will go beyond the election in 2024. >> ainsley: thank you so much. >> brian: i'm looking at political playbook. it is about the court case, see if something happened? hope thing is about why did merrick garland wait so long to
