spending down from the election interference case in georgia in the interest of democracy. with him, fani willis can go forward. some are slamming the judge's decision, scott mcafee. >> the ruling to me seems nonsensical. i don't know how you can disqualify mr. wade and allow ms. willis to stay on. this is another example of a two-tiered justice system when it comes to president trump and those around him. >> and mcafee said that they fell short of an actual conflict of interest, but he had harsh words for willis and her behavior, that she demonstrated a tremendous lack of judgment and acted unprofessionally when she testified last month. he suggested he would be for a gag order to prevent willis

from talking about the case. willis has been defiant and saying in response to the resignation letter, you have endured threats against you and your family and unjustified attacks in the media. and her problems are far from over, some legal experts say she may run into several challenges ahead from jury selection to delays. >> i think the decision not to remove her while legally wrong is really a coup for trump because it opens up the possibility of appeal of this, which is delay and that's what his main strategy here is is delay. >> willis is also facing other investigation including from georgia to d.c. where house judiciary chairman jim jordan is investigating whether her office misused federal funds, edward. >> thanks, this is not the last we've heard of this, i appreciate it. meanwhile, georgia state senate is pressing forward with its investigation of willis and

allegations of misconduct. and a chairman of the committee leading that probe, joining me now. by the way, we reached out to both fani willis and nathan wade. they're welcome to come on the show anytime for an interview. where does your investigation stand now? >> well, we're doing a factual investigation of the explosive allegations of troubling behavior by a prosecutor. improper conflicts of interest and also, financial irregularities. the problem with in is that it just undermines the public's confidence in the fairness and the impartiality of our criminal justice system. we're going to try to get to the facts, and dig into the evidence here and we also welcome mr. wade and ms. willis to testify in front of our committee because they have a lot of explaining to do and they're welcome to do that, but we're going to look to see if there are ways to change georgia law to amend current

laws or create laws to provide rules, guardrails against this type of improper behavior by prosecutors. >> i'm interested, you heard testimony about cell phone data showing that nathan wade had 2,000 calls and 10,000 text messages to fani willis, the location of those really matter in this case, right for you? >> location, that evidence came before our committee and i think most of that was excluded from court. all along the way, ms. willis has been trying to be an obstructionist on the evidence. she tried to quash every subpoena and seeking this information and prohibiting them from getting into evidence and she refused to testify in the divorce case where she would have had to answer underoath the nature of their relationship, and it very quickly settled after that. intimidated, in fact, mr. wade's spouse by saying it was an interference or an obstruction of justice for her to even ask for miss willis' testimony in that case.

we saw the cell phone data and it's real hard to explain 10,000 texts and phone calls and cell phones showing she's at the same location where she's at 11:00 p.m. and there's a lot of evident that the judge didn't get to see that establishes that relationship and when it began. we don't care so much about that it doesn't matter when that started in my view, it continued at some period of time while he was hired directly under her supervision and with her having sole approval of his invoices and bills up to $35,000 per month for his assistance in this investigation. >> so i'm curious, you know, what is the end result of your investigation? so the judge found an appearance of impropriety, but chose to split his decision. could you remove the fulton

county d.a.? what's the end result of this? >> no, no, that's beyond the scope of our authority. our charge is to get to the bottom of the facts. to explore the evidence, find out what, you know, what conduct occurred here and are there any financial improprieties, but more importantly to find out are there changes in georgia law to restore public confidence in criminal justice. the judge expressed his frustration. the defendants had not met their burden of proof. there wasn't enough evidence to support a clear conflict of interest. and that's the financial conflict of interest they're referencing. they found out that there was a lack of truthfulness on the part of ms. willis and i loved the term in the-- in his order he said there was an odor of mendacity. i had to look that term up to make sure i know what mendacity meant. i know veracity is truthful,

and mendacity is the opposite. we have the judge saying her arguments are unbelievable and the lawyers have a duty of candor and truthfulness to the court is unbelievable and she's unprofessional in her testimony. that's why he was trying to give her an out and suggested strongly she remove herself from this case and her entire office, but at the very least, to get mr. wade off the case, which fortunately, at least he did the responsible thing and agreed to resign immediately. >> senator, i appreciate it. thank you, we'll be checking back with you. >> a pressure to be with you, happy to keep you updated, thank you. >> well, that's not the only trump legal matter, the judge in florida overseeing the classified documents probe denied trump's request to dismiss the case while the judge in the new york case

agreed to delay the hush money case. and joining me is constitutional law attorney. the trump team says some of the evidence in the dump exogg rates the former president. in the hush money case, could the prosecutors do this, dump a lot of this, the evidence, some of it benign, to hide what really matters? >> prosecutors have a duty to turn over evidence, including exculpatory evidence. there has to be justification to turn over evidence late because if you're doing that outside of the court's order that could risk the case. certainly, there's always a lot of preparations for criminal trials so i'm not surprised that this would cause a significant delay and probably not the last one. >> so of the two cases, the new york hush money case and the classified document case, which

one do you think is more concerning for the former president? >> they're both very strange cases because they have significant legal issues. many people have said, and i agree, that the new york case is a very weak case. there's questions about the inclusion of felony federal offense toss take the case out of what would have typically been a misdemeanor case which would have been barred by the statute of limitations so i think that case is weak on its facts and the law. the constitutional case, i have issues with it, i don't think there's enough attention given to a president's authority over classified information over something that's never been worked out by the supreme court at this point. >> sure, in that classified documents case, we say the current president is not being charged and some of his documents when he was a senator decades ago. no reason to have any of those. all of the documents in the trump case from when he was

president, is there a double standard? >> not just a double standard, there's no question that the biden case is a prosecutable case and that's why robert hur had to go to such lengths to explain the prosecution when he had probable causes on the elements. certainly, there are executive branch employees that are prosecuted all the time for incidental redeposition for classified documents and that's something that can be the case in biden's case. so, yeah, absolutely, double standards, one way to put it. >> the latest on the hunter biden legal saga, a federal judge pencilled in for the gun trial june 3rd. hunter rejected a request to attend a hearing on capitol hill next week. what do you make of the refusal to go to the house hearing. >> frankly, i'm surprised he's talked at all. he probably should have take p the fifth, and the trials that are overlapping with the testimony and conduct

discussed, but of course, he wanted to have the public hearing and now, he is backing off of that request. unsurprisingly. it's not going to look good. as much as the left and democrats want to say there's been no evidence linking joe biden to any of hunter's business transaction, the reality there's been plenty of circumstantial evidence come out. it would not help his father and i don't think he would want to take that risk. >> hunter biden originally asked for a public hearing. so how does this look now that he's refusing to appear in an open hearing? >> it looks like he has something to hide and of course, they can offer any justifications they want that he's already answered questions and it's a side show, but the reality is, it would not help his father and that's the bottom line was, why he testified in the first place. >> katie, we've got to ask smarter minds than me about this, all of this legal stuff, it's all running together. i appreciate it, thanks for your insight. >> thank you. >> could the trump and biden legal mess help a third party

the crisis in a moment. first, to the latest on the ground at the border with g garrett tenney in eagle pass, texas. >> yeah, those got-aways keep a lot awake at night. fbi director christopher wray said we don't know who they are and what their intentions are for being here. what we do know, the last three years, 1.8 million is the estimate number of got-aways that we've had. that's a conservative estimate. the border patrol tells you the number is likely double that. over the last year alone, 58 people on the terror watch list have been caught trying to cross the border. this week outside of san antonio, ice agents arrested this man on the most wanted list for the colombia national police, for four murders, extortion and drug trafficking. and video from laredo, texas,

troopers chasing down a cartel smuggler trying to bring in several people into the country. you'll remember just a few months ago, thousands of people a day were crossing the river in shelby park and walking into the country. now that texas installed the barriers, you're seeing the cartels shift their smuggling operations out west to places like lukeville, arizona, where you can see it is a lot easier to get people into the country. this was late yesterday. our cameras caught smugglers cut an opening in the border wall there in lukeville and more than 100 people pour through. whenever this happens, border patrol comes by, patches the holes up. just as fast, cartel cut open new one. most of themselves turn themselves over the border patrol. they typically aren't the ones they're worried about from the security standpoint. it's those coming across and don't want to be caught. edward: be careful with all of that. my next guest is one of 14

democrats to denounce biden's border policies in a house vote and democrats for border security task force which he co-chairs. texas congressman henry cuellar, welcome to the show and thanks for joining me. >> thank you so much. edward: what do you hope to accomplish with the border security task force. >> we need to make sure that both democrats and republicans work together to secure the border. with all due respect to the republicans, they don't have all the answers and the democrats, to work together and our goal is to secure the border. edward: so the resolution says that president biden purposely violated united states immigration law. has -- and has operated an open border agenda. why do you think the president then has allowed this to happen? >> well, you know, the resolution was written by-- with all due respect, by republicans, so they certainly

put certain language there. do i agree with the high numbers that people have coming in, the people that are turning themselves in 0 so the get-aways. we don't know how many get-aways have been. i don't like the high numbers. december to last year to now the numbers have been cut down. if you look at the history how migrants go to the border, first, it was south texas and then eagle pass, it was el paso and arizona, california. the cartels are very agile, so they'll move over to wherever they think there's less resistance. >> i'm curious, moaningman, if nothing changes, would you vote again for president biden in the next presidential election? >> yes, i will. look, he wanted to support the senate. he worked on the senate bipartisan border deal and our republicans don't want to consider it. so he's trying. yes, i would support him.

do i agree with him 100%? and nobody-- if it's a republican don't agree with trump 100%. yes, i'll support president biden. the senate deal is something we need to take a look at. >> the house passed one three years ago and we've seen these surges coming wave after wave after wave. now in an election year the president is deciding to push this. isn't that a little suspect? >> you know, the hr, i think hr2. >> yes. >> that the house put together. they didn't talk to any of us. look, i'm at the border, i don't come in and take photos at the border for a couple of hours and then take off. i live here, i talk to border patrol. i talk to ice. i talk to cbp, the folks at the bridges. i want to make sure that we do something. if you look at the last two

years, homeland appropriations, added $2.4 billion to cbp except for two republicans are still in the house, two republicans are still in the house every single republican voted to add more money for border patrol and add new border patrol agents, add technology, they voted against $2.4 billion the last two elections, the last two appropriations so again, look, you just can't say it's the democrats or the republicans. we need to stop playing politics in congress and do what we need to do and secure the border. edward: congressman, in the last 30 seconds, they want to process more no talk on slowing the flow. and what's your thoughts, processing, or slow. >> we need to see if they

>> we're following breaking news in pennsylvania this morning. police are telling residents in falls township in bucks county to shelter in place right now

after multiple people were shot. the report says the suspect is believed to have carjacked a silver honda crv and may still be armed. so far, police haven't disclosed the exact number injured or the extent of injuries. we're told that the bucks county st. patrick's day parade was closed, was canceled and several local businesses in the area are closed temporarily. joining us now on the phone is pennsylvania congressman brian fitzpatrick. a former fbi agent who now represents the district where this shooting happened. congressman, i understand you were at the parade before it was canceled. what else can you tell us about the situation? >> so it looks like we're dealing with one armed person who broke into separate residences, it appears to be targeted rather than random. it may have been family members, but the report, three

people dead, one victim transported to a local hospital. and helicopter for the jersey state police are tracking this person. go ahead. edward: this is very concerning for the people in your district and, first of all, what are you telling them? yeah, finish, please finish your thought. >> obviously, it's still an active situation. the suspect has not been apprehended. he is driving a stolen vehicle. as you reported, a gold honda crv. we need everybody to be on the lookout. large manhunt is underway and all the bucks county police departments have been requested to support in the search. and new jersey is assisting in the area and we've been given the name of the suspect, but i'll let the police report this individual, but it looks to be a male, age 26. >> sure, yes.

on the younger side. what was the situation? you said you were at the parade when this happened. was this an orderly sort of cancellation? how close is the parade to where this incident happened? >> well, the parade actually had not begun yet. it was scheduled to start at 10:30. it was at my alma mater and everybody was sent there. and very, vermilion hills and el elderberry, the crime scenes are literally along the parade route. this is close to where the parade would have been going through, just about an hour later. >> representative brian fitzpatrick from pennsylvania. we'll let you gather what you need to do and talk to them on the ground. thanks for that. >> so more scares in the sky this week. a panel from underneath a boeing plane apparently fell off on a flight from san francisco to oregon yesterday and now, it landed safely.

and they still haven't located the missing piece. this just days after a boeing aircraft was force today make an emergency landing at lax due to reports of mechanical issue. so, here to discuss all of this is travel expert bobby lori. what do you think? would you be worried about getting on a boeing flight right now? . no, actually, i wouldn't be. from the beginning of the month we've seen a flying tire, a runway roll off and a missing door since january and the mishaps, some of these we never would have known about, but they've been in the news because of the various boeing max's. and right now there's a microscope on smaller routine situations that airline usually solve on a regular basis. edward: the white house secretary refused to say if the president had confidence in boeing planes, instead they have confidence in the n.t.s.b.

to investigate these incidents. so what's going on here? you still okay? >> yeah, we're definitely still okay. now, we do have the f.a.a. and the doj currently investigating the boeing 737 max's, but all of the emergency landings in the past month or so have been on different aircraft types. some were boeing, some were airbus. in some situations we were looking at a blown tire on united, which was one of the news worthy incidents that came out of the last two weeks with american airlines. and we had a blown tire on that. the statement from the white house is right on par with what should be happening right now. the n.t.s.b. taking a look at what's happening and what's causing this, this small increase in incidents. >> so, bobby, in the last 30 seconds that we have, if you're boeing, how do you turn around the safety image issue around this? >> yeah, there's going to need to be a lot more transparency

prize for the least popular candidate in the history of a major political party. >> on the latest fox news poll, trump leads biden by 3 points. but troubling for the biden campaign. rfk13%. and there are votes that 0 r would mostly take away from biden. and voters who voted uncommitted, 100,000 in michigan and nearly 20% in minnesota and washington state which held a mail-in only primary, nearly 8% voted uncommitted. kjc was asked about that at the white house. >> the president gets a readout of the meetings. he hears directly from the officials who have sat down and had these important critical conversations. we tri to keep them private because we want to make sure of the leaders who are attending

these meetings can feel freely to say, have the freedom to say what it is they want to tell us. >> now, edward, if aaron rodgers is named rfk, jr.'s running mate it wouldn't be the first time a quarterback or former quarterback would have been a running mate. bob dole selected jack kemp. edward: a politician at the time. >> and gerald ford. edward: exactly. as rfk, jr. gets set to reveal his running mate on march 26th in oakland, california. could a pick like aaron rodgers or jessie ventura help or hurt him with voters. joining me to discuss it, a pollster, justin and carly cooperman. look the at polls, the national poll shows that rfk, jr. is getting 13% of the vote. is that enough to concern both

candidates? who does is siphon from? >> it's enough to seriously concern president biden, that's the real siphon. we're seeing when rfk is introduced into the polling, numbers tend to go away from biden and not a lot need to go away from biden to make the rfk, jr. campaign damaging, really about 5% or more and he's starting to nudge well above that. 13% is significant so it's a very real concern. edward: carly, what do you think? does he siphon from president biden? >> yeah, look, this is a concern, absolutely. we -- i think that the biden administration is watching carefully. they don't want to see support for third party candidates, whether it's rfk or anybody else continue to peel away support from his base. that being said, i think that the polling we're seeing right now is basically a peek of where this is going, historically with third party candidates, we tend to see going into the spring and the

summer, it peaks, but ultimately voters kind of go back to their respective parties and as dissatisfied as democrats might be with joe biden as their nominee, they're more dissatisfied making a vote that would help donald trump. i think a lot of democrats come back to biden at the end of the day. >> do you think that voters would go for either of the vp picks, aaron rodgers or jessie ventura? >> i don't think it really is going to change the equation broadly speaking. there's absolutely a part of the electorate that's dissatisfied with trump and biden and the favorability is low, poll after poll, voters want alternates and other choices and that being said, that, again, i don't think that any of these vp's are going to bring rk's support that much higher, but i think at the end of the day, you'll see republicans and democrats going back to their respective party

nominees. edward: justin, no labels is said to be in discussion with former lt. governor, jeff duncan as they weigh a unity ticket. where does joe manchin fit in this and will the third party help push-- help or hurt in this push for the-- to be president? >> the no labels ticket really is most likely introducing a candidate who is going to siphon from trump. so, we're going to have these kind of nullifying effects on other side. i completely agree with carly about the ebb and flow of the effects over time. and see how this pans out and will this cycle with any other with independents or third party candidates, but it does look like they're going to go with more of a right leaning candidate and then their challenges, they have to find someone, i think, with existing name i.d. and that's what's really quite compelling about kennedy is he has the name. that's what makes him attractive, what makes people opt for him, not that he's so well-known. it's the name. how do you find a right-leaning

candidate with name i.d. and who's willing to annoy candidate trump? it's pretty lonely path. edward: annoy and take his ire, you know what happens when folks try to go against him. carly, president biden is facing more and more protest votes over his handling of israel and gaza. how do you think that plays out? i know you said you think the democrats will come back in. we're seeing this in battle ground states in michigan where the voters may not come back. >> i do think ultimately at the end of the day, those voters are coming back. look, there is a left leaning part of the democratic party that's unhappy with biden's handling of the war. that being said, you can't have a u.s. president who's not showing strong support for the state of israel. biden is trying to recognize how the voters feel in terms of the nuanced approach he's taking and he's calling for an approach in israel that's

in right now about a shooting in falls township in bucks county that's left at least three people dead. police are looking for 26-year-old andre gordon who has allegedly shot and killed two individuals inside a home and then shot and killed someone else and investigators say he then carjacked a silver ho honda, and police are telling folks to shelter in place. >> joining us is on the phone is former las vegas police officer randy sutton. we heard from representative brian fitzpatrick whose district this is, it may have been targeted to two houses. and then the person ran and it may be more dangerous when you have somebody who runs with basically nothing to lose? >> well, the fact that this individual carjacked a vehicle in order to make an escape shows this is poor planning on that individual's part.

now about a shooting in falls township in bucks county, that's in pennsylvania. it's left at least three people dead. police are looking for 26-year-old andre gordon who shot and killed two individuals inside a home and shot and killed someone else. investigators say that he carjacked a silver honda crv at the dollar general parking lot. joining us is former fbi investigator bill daley. i want to know, when does the fbi get involved in this? this physical location is very close to trenton, new jersey, close to state lines. >> yeah, sure, once there's a-- any interstate involvement, the fbi could provide that assistance because of the nature of the relationship with versus police departments in multiple states. so, although right now, it appears to be, you know, a state crime, a local crime and a police action, the fbi would be able to get involved once there is some kind of interstate activity and perhaps even, as they start to see

whether he has roots in the trenton area as you suggested, perhaps being able to support any investigation or maybe need to see who else who knows him. where he might go. going into new jersey or other resources that may help in this investigation. i think as you said earlier, and as your other guest pointed out, this is a very fluid situation and it's primarily a manhunt. we have crime scenes where he committed the murders, but he also have an evolving situation where they could find him. that has now invoked local authorities to put off to the st. patrick's day parade which would have passed by near proximity to the crime scenes, but more so because he's on the loose. edward: and we want to point people to the screen right now. that's the picture of the person they're looking for, andre, in this case. you know, bill, is this a situation where you have somebody clearly with nothing to lose. he's already killed three people and carjacked a car to get away.

he's not thinking about anybody else's safety, is he? >> no, i mean, at this point we have to consider, always say armed and dangerous, but certainly i would say someone who has -- has already committed these murders and probably is on the run and he's going to be highly volatile as far as police or local citizen interactions. for citizens to report what they see and not to take steps to intercede and be on the look out for them and he may be looking to take another vehicle if he thinks this vehicle, which has now been reported quite widely is being looked for by police. he could be looking for another vehicle. citizens need to be aware of that in and around surrounding areas. it's a very, as we said a fluid situation, and they need to find him and stop him before any incident takes place and wrap up the crime scenes, who the victims are, did he know
