>> kayleigh: all eyes on the border today as president biden and former president trump head down for dueling visits as immigration is the top issue for 2024. this is "outnumbered," i'm kayleigh mcenany, with harris faulkner and emily compagno and host of the michele tafoya podcast, michele tafoya, and former gubernatorial candidate lee zeldin. there is president biden boarding air force one on route to brownsville and former president trump is going to eagle pass, texas. just 46 apprehensions this week in brownsville compared to 2100 in eagle pass in last five days. i wonder why biden chose brownsville? you're looking at it. we have bill melugin, but we
9:02 am
begin with griff jenkins with the latest. >> griff: the latest is president biden will soon be at brownsville border patrol station accompanied by dhs secretary mayorkas and will dpet operational briefing from the chief of the border patrol and officials who will bring him up to date and learn 5:00 a.m. this morning, 100 migrants crossed in this area. exclusive footage shot by fox cameraings, more than 100 migrants being processed at camp monument, mostly central american migrants, some from venezuela. many of them criminal migrants that have been in the news recently. i want to talk about the difference between eagle pass where bill melugin is and brownsville, where i am. you can see on the comparison less than 50 in this area, zero
9:03 am
crossings on monday and illustrates the fact the president is coming to one of the least most trafficked areas in the country. i was able to speak to the border patrol chief jason owens who will brief the president. no one knows the situation better and he talks about the number we don't puts enough emphasis on and that is gotaways, those that evade apprehension and disappear into the dark of the country. here is what he had to say about it. listen. >> i know so far the known gotaways, folks we've been able to detect and not been able to get to and apprehend, 120s,000 already this year. unknown gotaways is what we don't know, nothing more than a guess. i'm worried it could be a substantial amount, i won't know that until i have resources and manpower before i can cover the areas not covered right now.
9:04 am
>> griff: to flash back to the fact brownsville was ground zero nine months ago, may of 2023, title 42 was ending, shooting hundreds of migrants crossing at the time. this is one of the least trafficked area because of the wire and the obstructions the state of texas has put up to drive the numbers down and it is numbers surge in arizona and california. latest number of crossings across southwest border, 6500 in last 24 hours, most in the arizona and california areas. back to you. >> kayleigh: keep us updated, thank you, griff jenkins. today president biden to the border. he set off a bomb and he has essentially going to stand in the debris of the bomb he set off and try to say my predecessor donald trump set off
9:05 am
the bomb vm we'll fact check that. here is border numbers, they are elevated around 2021 at the south sector and you can see in arizona and texas. record highs on president biden's watch, harris. >> harris: so i want you to notice something else about the numbers. it is winter time and they often dip down. remember numbers were higher going into january, people were freezing and they were trying to get them into tents. sometimes you see that slow down. the place it has slowed down the most is where the containers and razor wires. no arguing fact going to an area that used to be the epicenter and is now benefiting from what the governor has done in texas, now we see the president of the united states. i don't know if he's planning to take a victsry lap around that, a few weeks ago he was fighting to take that down. can you imagine what brownsville
9:06 am
would have looked like if those things did not exist? the border patrol council told me migration wests, the cartels know. they have detection and know where we are putting resources and they are flooding people and we are starting to see undocumented minors coming across, along with fentanyl in arizona and now california. so biden can run, but he can't hide. he can run for president, he can't hide from that. >> kayleigh: yeah, the most c confounding white house decision-making. you want to magnify chaos you created and you want to elevate your rival. by biden going there today he's highlighting trump's trip across all major networks who would have otherwise ignored it. the part that is most confounding, if you go to chaos, bring a deliverable, declare an
9:07 am
emergency. he is not intending to do that, bolster resources at the southern border, they are seeking to blame trump for lack of action at the border while tying the former president to the disruption. this is a blame trump trip. >> lee: what can i do? you are feeling urgenty and know this is number one issue for so many americans and decide you can't avoid it and decide to go to the border, show up with action. you are showing a chart what it was like under president trump, what it is like now, the numbers and there are policies and explanation that dps to it. president trump in office ramped up the construction of the border wall. there was no ramping up of catch and release. they were implementing remain in

>> harris: former president trump has been kicked off another state's ballot. this time in illinois. u.s. supreme court agreed to rule on whether trump has immunity in jack smith's election interference case, dispute that will have political implications for entire nation.
9:17 am
shannon bream is live in washington, d.c. shannon. >> shannon: the supreme court does not enjoy being in the middle of political issues, it is juggling several cases that could impact this year's campaign. in addition to the illinois judge who booted the president from the primary ballot, super tuesday, two other states made the same decision, all on hold pending a decision on whether colorado had a right to do what they did. the judges heard the argument on the eighth, the decision could come any time. whether votes will actually get counted or not is up to that decision, we are waiting from the justices and could come any time. in many respects, legal team for trump could argue they got a win from the sprem court yesterday by virtue of justices deciding to take up the case if he has

are in below, or dismissed on appeal. rest of states might be interested in taking him off the ballot, like maine and colorado. what happens? >> lee: supreme court will have to weigh in here and hearing arguments on states so far, we saw this is not just 6-3 divide, this could be 7-2 decision and 8-1 or 9-0 decision. there seems to be bigger support than the 6-3 breakdown. i don't want to hear about attacks on democracy when you see an attack like this. no greater threat against democracy than joe biden and democrats saying americans don't have a right to choose their own president in november. this is the greatest threat to democracy that is imaginable. >> harris: also like a really big deal about election interference, why doesn't anybody call it that? i call it that.
9:20 am
>> emily: perfect segue, i spoke to a loyal fox watcher who said my biggest concern is the fact no one assuage election integrity and election interference. why don't the questions seem to be not answered or addressed in the public sector? that map perfectly illustrates one legal argument, patchwork effect, how can you take away from people power to have a candidate for national election on every single ballot when it clearly is here in consideration in some states? it is fascinating question, i think largest continued slap in the face by left is knee-jerk quote behind donald trump's name, the threat to democracy when greatest threat is if this occurs. >> lee: this is clearly election interference and proven to be when you see tears on the other side over the last 24-48 hours.
9:21 am
>> emily: yes, yes, yes. >> harris: pop up the map, notice gold, those states are pending with this. talk about patchwork, we will go into election season, colorado has taken name off the ballot before supreme court weighed in, if the votes don't count, neighbors next door, their votes didn't matter, they might vote for somebody else. do you think it gives some advantage to one side or the other? >> michele: i'm not a lawyer, i got a masters in marketing leadership. let the market decide, let consumers, people, voters decide. one judge in illinois made this happen. one election official in maine

who made this happen. supreme court of colorado made this happen. these are not voters. taking someone's name off a ballot, deleting a choice. you better love america enough to want to defend democracy by allowing the people to choose what happens in november, not these little handful of bureaucrats or judges. >> harris: and it brings to the point, why people distrust this process, you look at that map and think, the united states is not united when we vote? real quick question for you. when do we reach the point too close to the election? like is that being talked about, do you think in the white house? calculus being, if we could speed this up a little bit. >> kayleigh: it is being talked about openly. i heard an anchor say everyday counts, like toward what?
