the border crisis cost him his business. welcome to you both and thank you for your time. debra, what will the presidency in your city today? >> well, depends upon where he goes. i've been told the area he is going, he will see nothing. he picked a very beautiful spot. perfect for a photo op. if it's the area i believe, i grew up out there and rode horses along the border. beautiful, like i said, beautiful area. nothing is happening in that particular area. it is a disrespect to brownsville residents that he has chosen, if indeed that's the spot, it is a disrespect that he has chosen to waste his trip looking at absolutely nothing. there are plenty of other areas in brownsville where he could go and witness the damage done. he could see the tons and tons of trash left ott the riverbank. he could look at the new hot spot for crossing in the

south-most area in brownsville. this trip is just so pointless and the fact that bill melugin mentioned the white house never reached out to the governor, or to the border patrol union speaks volumes about their purpose of being here. a dog and pony show. >> bill: for our viewers screen right it was may in brownsville. it was nine months ago. you saw the numbers coming across back then. let me move up the border to justin. how did you lose your business there in eagle pass? >> so with the border crossers coming along we had just started up running and as soon as this crossing started i had a whole bunch of illegals and i say illegals by the bunch, 20300. it wasn't safe for the kids and parties happening at eagle pass. i wasn't going to take a risk for the kids and get them

injured or hurt or anything. >> bill: i can understand that. debra, what your dad was a cop, right? >> yes. my dad is a brownsville police officer currently. >> bill: your sister is a border agent. you said something about immigrants wandering the streets with nothing to do. i think that is a bad formula. explain that. >> absolutely. you have hundreds and hundreds of illegal immigrants here in our streets with nothing to do. i've dropped my son off at school multiple times just to see young men, illegal immigrants, wandering the fenceline of the school. as a mother, as a resident, as somebody who has grown up in a law enforcement family, you can most moat assuredly bet that's a recipe for disaster. nothing to lose and nothing to do. >> bill: everywhere where it's

i would hope the american people would see how serious this president was or is about fixing this issue. >> gillian: i don't know, brandon, are you happy? is it better that the president comes for the second time in this term or would you prefer he is not there at all today? >> i would much rather use facts than rhetoric. when you listen to karine jean-pierre and says from day one president biden put out policies. the only policies that he put out was amnesty or a pathway to citizenship for these people to cross the border illegally. nothing in any of his policies that were border security measures, nothing. when we look at actual facts and the explosion of illegal immigration under president biden, we have to understand that if we don't get this under control we'll continue to have the laken rileys of the world and it's unfortunate. she paid her life for president biden's ego rather than what is best for the american people. we have to get everything under control and the only way we can

do that is policy. not money, not more technology or infrastructure. it's policy. if we had that policy we could control the border and go after the cartels and do all that's necessary to protect the american people. >> gillian: what do you want to see president biden say when he is there later today? >> there is nothing that he can say because of where he is going. the reason why border patrol agents are so up set about this visit is because he is not going to any location where he is going to be able to evaluate what he needs to do. what are the policy and programs that need to go into place? he won't be able to do that in brownsville. san diego, tucson, if he would have come to eagle pass, would have went to the trouble locations he would have been able to get a little bit more understanding and evaluate the situation to come up with it. he is not going to do that. he can't do that. he has repeatedly said he

doesn't have executive authority to control this. if he did something today everybody would recognize the past three years are all on him. >> gillian: to your point about location, brandon, former president obama's dhs secretary on "fox & friends" this morning saying it makes perfect sense biden would go to brownsville. that's historically the epicenter of the border crisis. what do you say? >> no. mcallen would be historically the epicenter of border crisis, not brownsville. you have to look at specific areas. everybody thinks that the border is a one size fits all, that we can control with operations the same way we do everywhere. that's not true. we have to look at specific areas. that's why we're broken into stations and why brownsville has its own border patrol station and mcallen and eagle pass has two border patrol stations. you have to go where we see the traffic and where the problem is. if you don't do that, you are not going to be able to get a proper evaluation. >> gillian: we have to leave it

>> bill: some breaking news a mile from the white house. washington, d.c. police responding to a shooting in the southeastern district of d.c. housing authority officer shot in the stomach a bit earlier today. that's in the navy yard neighborhood. the officer has been transported to the hospital, stable condition. we're monitoring that for updates. in orlando, florida overnight police responding to a shooting there. one person is dead. multiple others injured. motive is not certain as of this hour. >> gillian: tracking wildfires now scorching the texas pan handles. smokehouse creek fire will be the second largest in the state's entire history. officials confirmed the first death from these fires, a grandmother from a small city in north texas. casey stiegel joins us from dallas with the latest details. >> good morning. officials say that lone fatality is an 83-year-old woman from the

community, a small community up north of amarillo. the surrounding circumstances with that death unclear at this point. look at this video out of the region. stunning and heartbreaking. northeast and northwest of amarillo five different fires still burning. the largest according to the forest service has grown to some 850,000 acres and is 3% contained. that's larger than the entire state of rhode island. emergency management officials say 40 homes have burned on the edge of the small town called canadian texas, other cars and property reduced to ash. >> we have lost everything. this is the only pair of pants i've got, the shirt, that's it. >> emergency has been declared in 60 tech as counties. crews from across the state are responding. the ft. worth fire department shooting this chilling video of

the flames in hutcheson county as folks work around the clock to try to get this under control. >> a lot of those volunteers left homes and businesses and families to go out and fight fire and do evacuations leaving their properties at risk. we owe them a great amount of gratitude. >> the scope of damage is not fully known at this point as officials tell us they're very much in active build firefighting mode. they haven't really been able to do thorough assessment. they're just trying to get a handle on the situation, bill. >> gillian: we're tracking those fires closely this morning. >> bill: hunter biden went behind closed doors. said yesterday his father was not involved in his businesses. republicans say the first son's answers don't explain the evidence stacked up against him. democrats are rushing to the biden's defense. >> what we just witnessed over the last hour was, i think, a deep sea fishing expedition.

was sitting next to his father when he was sending it to a chinese business official demanding money. nine days later $5 million showed up. 327 different emails that joe biden had with hunter biden and his business associates that the i.r.s. whistleblowers provided and numerous business associates of hunter biden that have testified about his involvement. in fact, one of them said he was not just a participant, he has an enabler in the entire process. so the biden family has been staying to one tune and that's to protect the brand. >> bill: whatsapp to paraphrase, i'm sitting with my dad. i want the money wired now. what he told you however he was either drunk, high or both and that his dad wasn't even in the room. i don't think you can prove his dad was there. does that matter? >> you know, the i.r.s. whistleblowers tried to do geo tracing of that cell phone back during the investigation and were denied anything that could

lead to the president joe biden and even denied asking any questions of joe biden. that's what the justice department obstructed throughout the process according to the i.r.s. whistleblowers. we need to find that out. the excuses to say you are drunk or high or you don't recall. it is very similar to his father not being charged criminally because he is not mentally fit. >> bill: my question was does it matter whether you can prove the president was in his presence or not? you think you have the financial record to show the exchanges happen. maybe it's a mute point. part of his statement from yesterday. i did not involve my father in my business. not while i was a practicing lawyer, not in my investments or transactions, domestic or international. not as a board member or artist, never. can you prove that that statement is a lie? >> the i.r.s. whistleblowers proved that statement is a lie. they proved on numerous accounts

where joe biden met with hunter biden and his business associates in the white house, on trips to other countries, the four seasons in washington. numerous examples. what they said is completely counter what the whistleblowers said plus you had tony bobulinski said he sat down with joe biden in 2017, named the time, place and location and spoke for more than 45 minutes discussing the relationship with the chinese energy company. the only people that are denying everything are the ones with the last name biden. >> bill: appreciate your time. last night on sean hannity's show you gave this an eight out of ten. what two were missing then? why not a ten out of ten if you thought it was so great? >> i would say if he completely answered all the questions it would have went a whole lot great. when people don't want to tell the truth, they say i cannot recall.

we were living in in the late teens in this country. where you had the president of the united states speaking in the most vile terms about people who were foreign born. >> and through that friction the mayor seems confident what he is doing in athens to protect the residents is good. he mentioned that police officers are getting a raise, they are adding multiple cameras for surveillance and even saying murders are down every year since 1992 staying firm on the fact this is not a sanctuary city, bill. >> bill: he had quite a bit to say and be debated. we'll have more on the community's anger over the mayor's lenient policies and migrant and talk to a life long resident of athens, georgia and get thoughts from her coming up. >> gillian: an illinois judge removing donald trump from appearing on the state's primary ballot citing his role in the january 6th riot at the capitol. he is putting the ruling on hold

pending an appeal from trump's team. jonathan turley, law professor at george washington university is joining us now. illinois joins maine and colorado trying to strip the president off the ballot. what if anything distinguishes the legal case here from the two other states? >> for one thing it doesn't matter. it's superfluous. most judges are waiting for the supreme court. there was forreason for this court to issue this opinion. it is a cut and paste from colorado. she accepted everything colorado said and put her own name on it and it has that feeling of sort of well me, too. i want to be included. she will not be included. this won't be in front of the supreme court. we expect a decision any day now and the oral argument did not go well. it was not the conservatives that asked the most difficult questions. it was justices from the left of

the court who raised a number of the problems, including justice jackson who said look, this is ambiguous. why should i adopt the least democratic interpretation of this constitutional amendment? it doesn't bode well. most people are expecting the court will roundly reject this theory and this disqualification effort. >> gillian: the three are far from alone, as you know. 35, 36 states have filed some kind of legal challenge to the former president's candidacy. we checked with the brain room at fox news. of the 36 challenges biden carried 22 in 2020 and trump carried 14. does it give us a clue what's happening in the legal system? >> there are academics who have good-faith reasons why they think insurrection means something much broader under this amendment. i strongly disagree with that. i think they are wrong on the

history and definitely wrong on the text of the constitution. but this is being pushed by a number of democratic secretaries of state like the ones in colorado and in maine. in maine you had a secretary of state that had been saying since the inauguration that this was an insurrection brought about by trump. so these advocates knew where to go and there was hardly any surprise. they had her at hello when they asked for disqualification. >> gillian: in the wake of the supreme court gangbusters decision yesterday to take up trump's immunity claims a lot of analysts and journalist folks are questioning the legitimacy of the supreme court now. listen to rachel maddow. >> this is b.s. you are doing this as a tactic to help your political friend, your partisan patron, and for you to say that this is something that the court needs to decide because it is

something that's unclear in the law is just flagrant, flagrant and they know it and they don't care that we know it and it's disturbing about the future legitimacy of the court. >> gillian: what do you make of that? >> i wrote about this on my blog this morning. this is why you have such anger. this is why people go to the homes of justices. this is what they hear in this echo chamber that the court is a bunch of robotic partisan hacks. you've had law school deans refer to them as hacks. and what people hear about that but don't hear the truth, the supreme court has ruled against donald trump, against conservative causes regularly, including the conservatives on the court. you had one person yesterday say that well, the this just shows the court is part of the insurrection. the insurrection is ongoing. that type of rhetoric is what is fueling rage in the country. the court anticipated this for review.

president biden passing his annual physical with the doctor identifying no new concerns. the lack of any cognitive exam raising some questions. fox news contributor dr. marc siegel is here with us. hello to you. two things to share with you. sheer what the physician said in part. president feels well and no new concerns this year. he continues to be fit for duty and fully executes all his responsibilities without any exceptions or accommodations. the question from quinnipiac. do you think president biden is too old to effectively serve? different from mentally acuity. 2/three say yes. you thought this report was sneaky and left out a lot. what do you mean? >> the poll you talked about also asked fitness to serve versus age. this is important. i'm not concerned about age. i don't think we should focus on age. we should focus on fitness. the american public is questioning fitness. 2/three ask if he is mentally

fit. that question was not addressed by the physical this year. this physical looked almost identical to last year's. one line that he doesn't have parkinson's or stroke or multiple sclerosis was lifted wording from the year before. the gait, his problem with walking, again saying it is due to arthritis in the spine and some orthopedic problems. some neurologists have told me the gait where your feet are glued to the floor is more consistent with fluid on the brain or possibly not enough blood flow to areas of the brain. i'm not saying he has that. i haven't examined him. we didn't see any imaging of the brain and no cognitive testing. the american public is questioning his cognitive ability because of the frequent lapses he has had in memory. neurologist eaves have been quoted saying well, when people get older they have memory lapses. i personally in my practice have not seen this kind of memory lapse. if i did i would refer the patient to a neurologist to get

testing for it. they are avoiding the elephant in the room in my opinion. >> gillian: he is also taking criticism or the white house is for not having the cognitive test embedded in the physical. if you were going to design something like that for presidents or candidates seeking office can you break down for us what you would like to see in there? what are we looking for? what kind of questions are we trying to answer in a cognitive test? >> really important question, very well phrased. it is over time is the answer. a words called cognitive reserve. remember, if it's a grandfather maybe you don't care about that. the president of the united states you want to know how their memory affects their ability to make decisions. their flexibility of decision making. their creativity. thinking outside the box with new things coming at them all the time. how do they look compared to other foreign leaders? you can't tell that with one cognitive test. it would be an assessment over time. >> bill: nice to have a doctor
