animation. >> steve: fox news alert. our big story, two major stories this morning, president biden and former president trump are both making trips to the southern border today to discuss the border. >> ainsley: dualing visit as judge orders donald trump name removed from the illinois primary ballot. >> brian: lawrence is live on the ground in brownsville, we begin with shannon bream in washington on the former president's legal battle. shannon, what is the point of illinois doing this? i mean, come on, it is in the supreme court's hands. >> shannon: and they have said that any votes that come in for him cannot be counted because they have started early voting. they are waiting on the supreme court. the judge said if there is a decision in conflict with my decision, obviously mine gets stayed. you feel like these people won

to make a statement. taking step of saying i find he has engaged in insurrection, which he has not been charged with or convicted of, didn't matter for this judge. >> steve: is it a political hit job. ultimately joe biden will win illinois in the general. to your point, they started early voting, the primary is march 19th. a lot of delegates donald trump could use to win the nomination on the republican side. is it a political hit job from a democratic judge? shannon bream that has been the argument in colorado and maine. judges hate to look political, they don't want that perception out there. when these people come forward and say all this about insurrection and not fit to be president, it does feel like a political decision.

what this judge did overturned bipartisan election commission who said you can't mount this challenge and kick him off the ballot with the 14th amendment. they are overturning what was done in a bipartisan manner that doesn't work. the court will give a decision on colorado and that will make the case for what the rest of the states can do. >> ainsley: what about the supreme court agreeing to look at the immunity deal? >> shannon: it almost doesn't matter whether he wins or loses -- it does matter, as far as timeline, huge benefit to the trump team. supreme court saying we will expedite and hear arguments in late problem, pushes decision into june. that trial jack smith wanted to start march 4 is not happening. once you get the decision, late june, if the former president

loses on immunity issue, he'll be able to go back to the trial court and say, you pick up where we left off and paused months ago, now we need discovery and pretrial motion, pushing this to september or october and then a question about whether a special counsel wants to be seen prosecuting the nominee leading up to an election. >> brian: that is key, what is the date where it looks like election interference? republicans and democrats have their opinion. legally what is the date? can you start something october 1? can jack smith go and say mr. former president, you are off the campaign trail, come sit in court? >> shannon: there has been an unwritten policy that is an understanding you don't have legal action involving a candidate within 60 days. a lot of folks argue special counsel is not bound by those things and they could possibly

be well within jack smith's rights or his authority to go ahead and have a trial that close to the election. i think if they do and if president trump is the nominee and fighting for his political and legal life at that point, it will embolden his case that his rival's doj is after him while trying to become president. that will be the argument. >> steve: imagine it comes within the 60-day doj statute of limitation thing. they say, can't do it now, wait until after the election. say donald trump is elected president again, could they start the trial afterward, have it before he's inaugurated and then the thinking is if he's elected he will figure way to pull strings and throw it all away. >> shannon: tough calculation at that point if that is the 16arrio, if president trump is

apprehensions in the same time frame. >> steve: white house and republicans trading jabs, each saying it is a political stunt heading into an election year. it's a big day and we have dispatched lawrence jones down in brownsville, where joe biden is going to go. and lawrence, you arrived early on the scene, talking what do people make of him showing up so late in the game? >> lawrence: steve, the pundits can go back and forth whether it is a political stunt, but people remember. same people i spoke to today, i spoke to a year ago when the surge was happening and they wonder why the president of the united states has come johnny be lately, why coming to visit a place where the crossings are only 15 to 17 people per day and not going to the epicenter of the crisis?

why not go to eagle pass or arizona? only visitor he will get is talk with a stage, border patrol, leadership, he's going to talk with community members, he will not get a feel of what it is like to have a crisis at the border. you will hear back and forth and hear the president talk about donald trump and the border bill that was the bipartisan bill in the senate, that bill is dead on arrival and the question is what are they going to do right now? he broke it, what is he going to do to fix the border with executive action. if they are waiting on a bill in the senate during an election year where the president can have some sort of victory or feel like he did something symbolic, that will not happen. >> steve: john cohen essentially is going to embrace the

problem, given our politics, they have become politically unobtainable. we need more border patrol, more judges, emergency authority like a title 42, when numbers get high. we need to fix how one qualifies for asylum in this country. >> brian: very interesting to hear him bring up title 42, the president couldn't wait to get rid of it. we were down to just a couple thousand crossing. what is interesting about where president trump is going is shelby park. state authority kicked out border patrol and said, stay on the outside, we will make our own fence. guess what, it stopped. i know it pushed it like a funnel further down, squeezed it down, it stopped all illegal immigrants coming in and the park returns to the people and it is now safe to go have a

picnic. that is what trump will see today. >> lawrence: so true and you got to go back to the statement of, it is nationwide now. why is it nationwide? remember greg abbott was told bussing the migrants to sanctuary cities was a political stunt. what it did, made everyone feel in the country that we're supposed to be sanctuary cities, what texas has been experiencing all along. listen to democrats carefully, there is an attempt getting closer to election to spin the issue and make it a unified front and say it is just republicans and democrats going at it with one another. we had a secure border. cartel was on the run under the last administration. something changed. day one, remain in mexico was done, they stopped building the wall, it is rusting on the
