spoke to the son or brother or family about a shady foreign business deal. that's a complete lie. we have proven that over and over. biden was pictured with numerous hunter business partners including a fellow board member and now thanks to the house oversight committee investigation, we know that they trusted fbi source accusing joe biden of taking form bribes in exchange for policy decisions, we know more about this individual. we know that biden as vice president was tasked with leading america's policy in ukraine during the obama administration we know that hunter was raking in 50 grand a month from a ukrainian oil giant and gas giant at the very same time will we know that hunter accepted lavish gifts from the founder, we know he was paid a fortune but he admitted on good morning america that he had no experience. did he ever file taxes on those gifts or register as required by the fair act and were there any policy changes and what did he do in exchange for this

money? we know that joe come as vice president he leveraged 1 billion us taxpayer dollars. you get a ukrainian prosecutor fired. that prosecutor investigating hunter's employer and hunter himself for corruption and he withheld that billion and in six hours they fired the guy. now the fbi's confidential human source who has now been out there, this is the james comer and charles grassley 1023 form they have been looking for but that person apparently detconversations with the marie summa executive who refer to hunter as dumb but said had to pay the biden's because ukrainian prosecutor the one that was fired by joe or because of joe was investigating them and it would be difficult to enter the us market in the midst of that investigation thus the same ukrainian prosecutor that biden forced out six hours another $5

his income to pops are paying for pop's home repairs. so after pushing the russia hoax committing abuse falsifying documents. squeezing witnesses overprocessed crimes and using heavy-handed raids to intimidate witnesses and leaking it to the press and also pushing big tech to censor the hunter biden laptop story that we know was real and seemingly ignoring a bribery allegation against a biden i think it is pretty fair for americans to conclude how insulting it is for a doj special counsel to lecture all of us that we have equal treatment under the law because i'm not buying this in this america. joe biden's america. the sheer lack of self-awareness is beyond stunning but in reality biden's far left doj probably doesn't care. they just want to get trump at any cost rate here with more, the author of trial of the century.

greg jarrett and the author of the book get trump alan dershowitz and former acting attorney general matthew whitaker is with us. it to see you. greg, let me start with you very one thing you keep referring to as the presidential records act conspicuously in my view absent any reference to there, why would this be relative in a case like this? >> is the main defense and it's the prevailing controlling law that presidential records act a civil statute gave trump the right under the law to maintain custody and control if they are classified or not, sean, it's a civil not criminal statute because it's a specific statute. it takes precedence over general and for a decade the department of justice agreed with that. it became their own established standard they argued in federal court in a bill clinton case stating emphatically that

clinton was entitled to keep whatever he wanted after leaving office if it was classified or not so that's trump's main defense and the judge in the case endorsed it. the judge ruled the national archives doesn't have authority to decide presidential records and seizing them from a former president is unfounded and contrary to the law so trump relied on that standard. that should be his defense. >> let me go to the statement. we have one set of laws in this country and they apply to everybody and that we can go to what i just played in this particular case it was james comey admitting hillary had top-secret classified materials all over her servers. i would argue that deleting 33,000 emails and destroying devices that may have that information, to me, and maybe

i'm old-fashioned, that would fit the classic definition of obstruction but i am not a prosecutor. do we have the same standards being applied to hillary clinton, joe biden and donald trump in these cases? >> i don't think we do and jack smith try to persuade us that we do. he is probably listen to your show so he deliberately did not indict trump under the provision of the statute >> because of my show? >> the provision. >> what he learned. >> well. listen. he didn't indict him under the provision talks about negligence he indicted him on the higher standard of willfulness will make it harder to prove but will allow him to say see this is distinguishable from hillary clinton not arguing negligence arguing willfulness. there are 2 paragraphs out of almost 100 in the indictment that donald trump, paragraphs

34 and 35, that disclose the consensually recorded tape that trump allowed to tape when he spoke to a writer about a book concerning meadows in which he admitted that the document that he showed him may be flashed in front of him. we don't know. could have been declassified but was not declassified. those are the only paragraphs, 34 and 35 that are on eviscerated and he doesn't have anything to worry about. the rest of them are covered by the record tag or lack of intent it's very hard to prove the crime with level of intent but the paragraphs that are troubling, and i think the defense will probably be look. i was just showing off. i did really show him these materials. i just let him see that we had them. he didn't read them and of

course the government doesn't have the materials themselves so will be hard to prove what's in them but if i were trump's lawyers, those of the paragraphs i would be focusing on. i think the rest is duplicitous and typical and predictable and probably not criminal. >> somatic whitaker, let me go to what james comey said in the three days in 2016 he talked about top-secret classified information being faxed to hillary insisting that the heading be moved, the classification but it didn't declassify the document. people didn't have clearance including lawyers and others also looking at those documents at least 10 people at the time foreign governments likely having hacked into that system and then comey's statement that 30,000 emails forgetting the 33,000 she deleted 110 of them

and 52 email chains determined by the only agency to have classified information at the time eight of those chains had top-secret 36 had secret. tell me how this, in any way comports with the statement that was made by jack smith today that we have one set of the laws in the country that apply to everyone. where the laws applied in that case? >> in the hillary clinton case under the jack smith standard and hillary clinton should have been charged on many counts of violating the statute and this is the problem is the equal justice under the law. that concept is out the window because that was a fleeting moment where the fbi director can stand up and give someone a pass that now we have the biden administration, through their

had information in his possession but there has been no leaks. there has been no talk to grand juries. no reading his home no reading his office no reading any of the locations. what does the average american think watching the same these two did it and they got away with it. why are you going after this guy? >> all the intensity going after president trump. just this past wednesday we interviewed, we had a deposition of the former head of the washington field office for the fbi. mr. san antonio he san antonio told us from the start where is the us attorney assigned to this grade this going to happen in this case with the classified documents. they said there is no us attorney we are running this out of headquarters. and he said why are we doing that now and then he said if we are going to do this why don't we just call president trump's lawyers.

>> former president trump is shaking up his legal team in the wake of his federal classified document indictment. he removed two of his top attorneys from the case. a reason was not given but both attorneys met with special counsel jack smith about the documents this week. trump is facing nearly 40 counts on seven charges including making false statements and conspiracy to obstruct the charges come almost a year after the fbi allegedly found classified documents at his florida home. people across the eastern half of the us are finally getting much needed fresh air a new weather pattern is pushing the hazardous canadian wildfire smoke over the atlantic ocean earlier this week people in new york city and philadelphia experience the most polluted air ever recorded. now back to hannity.
