able to travel elsewhere in the country and so what cdp and dhs were handing out a few days ago were notices to appear, allows to travel throughout the united states and eventually get work permits which is what they want. that's why you see fewer and fewer folks here in el paso over the last couple days. again, as title 42 expires at the end at mid night tonight i think you are going to see again another rush of individuals toward that border, you will see the streets of el paso and other cities along the border crowded until they are able to process them out. this administration wants to process, they don't want to solve the crisis. they want to try to manage and process their way out of it. >> there is no doubt about it. i saw you say that biden has inherent powers. could you list out just some of those inherent powers he has to stop what we're seeing? >> well, stephen mentioned a few of it. there is a number of policy that reside not only with

troops at the border, they are bringing back the rule that a lot of progressives hate, the transit rule, you have to apply before you get to the border. this is a terrible situation. it is heartbreaking. it is dangerous. but i think when you stand at that podium, they are outlining the goals, outlining the policy that they are working towards and we will see how that plays out over the coming days. >> the word orderly is aspirational, the images seem to be anything but that. what i don't understand is this consistent talking point we hear of congress has had 20 years to act. look, could the system be better? sure. it always could be better. but the surge we have seen has happened exclusively to record highs levels under joe biden's administration, i will give you 2020 because the pandemic shut down, not a good representation of numbers. 169,000 encounters at the border, 2.2 million now. why the explosion if not for change in

>> kayleigh: we've an update in the case involving former marine daniel penny. >> 24-year-old marine veteran daniel penny will turn himself in tomorrow morning at 8:00 a.m., expected to be arraigned tomorrow and charged with second degree manslaughter. alvin bragg chose not to go to a grand jury, described as the reckless cause of death of another person, penny could receive 3.5 to 15 years in prison. the charges come ten days after penny put you jordan neely in a chokehold for 15 minutes on the f subway train. neely's death was ruled a
