even terrorists among them. i'm harris faulkner and you are in "the faulkner focus." those are the stakes. in 12 hours and 58 minutes from now, it will be the end of the trump-era measure that allowed the immediate expulsion of border crossers and it was working. some 3 million have been sent back under title 42. on biden's watch, we are watching it expire and people are desperate to cross over the border and they are now waiting en masse for midnight to come. the situation is this. >> the lifting of the title 42 public health order does not mean our border is open. >> it is going ton an invasion like we've never seen in the history of this country. >> i won't turn myself in.

previous to you i was telling the audience statistically we can expect hardened criminals and terrorists among these groups because we've been seeing it for more than two years under biden's watch. do you anticipate that we have enough resources right now to catch the bad guys? >> not at all. even if literally every person who turned themselves in was an angel, those aren't the ones are the real concern. everybody else that's getting away we have no idea who at the are and we know the ones turning themselves in aren't angels let me be clear. all the gotaways that are getting away we have no idea who they are. the ones we've been able to arrest plenty of people with criminal history in the united states. murder, rape, all sorts of different charges. not most of them but still plenty of them for it to be a concern for us. >> harris: we're looking live now in brownsville, texas. you and i met along the rio grande in the rio sector and there were children and people

drowning. your men and women were jumping in to save people. is that still happening? >> absolutely. the rio grande river is different depending what sector you are in. some areas you can walk across it and no deeper than your knees and other times it's over your head. groups if they don't know mow to swim or aren't expecting the current to be as strong as it is. we have more people drowning and in distress, the app isn't working. they can't go to the bridges. they'll do what they do and that's swim across the river. >> harris: heartbreaking to watch that. the biden administration this week put into action a 2022 memo that calls for allowing the mass release of non-citizens just onto our streets. go wherever they can get to. if illegal immigrant shelters reach capacity operators can release those deemed safe

directly from border patrol custody to avoid overcrowding. those safe illegal immigrants can be dropped off at bus stops, gas stations, supermarkets, border patrol council president brandon judd in "focus" yesterday says this is simply dangerous. >> when title 42 goes away that will surge to even more. that's what is going to require the street releases. when you release them into the street, that's what makes the american public less safe. then the burden falls on yuma, sierra vista and mcallen and all the cities. we can't do that. >> harris: you can't vet all these people and we can't house them all. what is life in america going to be like particularly in large cities? >> well look, we've been releasing people to the streets for a while and they were promising us there would be this

interview at the border where you would evaluate a claim and hold them in custody and see a judge. they were talking about this new process. title 42 hasn't gone away and it is already broken. as you said we're releasing them to the streets. we're paroleing people now. these people won't hang at the border for too long. they go to wherever they want to live in the country. it's hard to keep track as the numbers continue to skyrocket. it is not possible to track everyone. >> harris: i want everybody to pay attention to the right top box just above john and myself. that's yuma, arizona. biden let them build a little structure there because people were flowing over right before a visit from his administration. can't make that up. there you have it. did it help? apparently not. they are loading them onto buses now and taking them -- who knows

today before midnight. the president has already vowed he would veto it without even knowing what's in it, he will veto it, whatever and whenever it reaches his desk. we'll stay on it. fox news alert now. the nation is so captivated by one american teenager, natalee holloway from alabama on a high school graduation trip to aruba when she vanished this month 18 years ago. now breaking developments, the prime suspect van der sloot, will be extradited to the united states. one of the last people to see her alive. one of the last people to be seen with her. van der sloot facing a federal indictment stemming from an accusation he tried to extort money from natalee's family. a heartbreaking story and one very meaningful for me. as a correspondent i arrived

within 24 hours of natalee's disappearance on aruba and stayed on that island looking for answers for the next 29 days. >> 21 days and still no natalee. the cops say from here the three islanders said they took natalee back to her hotel. the connection between the first three men interrogated and the two security guards in custody is the subject of discussion. police and military searched this area intensely. the investigation here is now operating almost around the clock. the mystery of natalee holloway is as murky as ever. jonathan serrie live with more. >> well the peruvian government issued an executive order allowing for the temporary extradition of van der sloot to the u.s. he is the prime suspect in the 2005 disappearance of natalee holloway, the 18-year-old woman who disappeared in a trip to

aruba. she was seen socializing van der sloot the night she disappeared. it would allow him, the son of a now deceased judge in aruba, to face prosecution of u.s. for offer in 2010 to tell natalee's mother where her daughter was buried in exchan for $25,000. no body was ever found and although a judge later declared the young woman dead, van der sloot was never charged with connection with the presumed homicide. he is currently serving a 28 year prison sentence in peru for the murder of another woman, a 21-year-old he met at a casino in lima and pleaded guilty in that case in 2012. natalee holloway's mother issued this statement on his pending extradition. it has been a very long and painful journey. the persistence of many will pay

off. together we're finally getting justice for natalee. governor kay ivey of alabama treated the extradition to birmingham, alabama for her 18 years is significant. criminals like him are deceptive and vicious. alabama moms like beth hollway are stronger. her commendable persistence to obtain justice for natalee is finally paying off. >> harris: i was one of the first to sit down with both her parents, the one who made the most impression actually out of all the people i interviewed, including a very conflicted police chief on that island, was definitely beth holloway. i pray for her every day she gets the answers and they see justice. >> she was determined to find answers from the get go and just admirable about how she came down to the island seeking answers. >> harris: and she stayed. >> she stayed on top of the van der sloot family and parents demanding answers.

unfortunately they never gave them to her. perhaps she will get them now. >> harris: jonathan, thank you. democrats, their anxiety is growing by the hour. the president's re-election campaign is moving at the speed of a tired tortoise. top democrats telling the hill some in the party are simply panicking at this point. they say the biden camp is wildly underestimating former president trump as a potential rival despite all his scandals. one of those democrats putting it bluntly. team biden should be very fing worried. those are his words, cleaned it up for you for tv. conservatives also hitting biden's slow start. >> joe biden is abdicating for his campaign to people that are more energetic. >> it is surprising and the president of the united states is so underwater. it's a president who is failing.

>> the single least popular president in american history except for jimmy carter in the history of polling going all the way back to harry truman. that won't improve. >> harris: charlie hurt, washington times opinion editor and fox news contributor, and mark penn, former clinton advisor and pollster. mark, i will start with you. when you have a candidate that is moving so far behind in every category, staff, you name it, leading up to what could be the nominee and could be a second term, what do you make of it? >> well, it's certainly a tough road for president biden. in a situation like that -- i worked with president clinton when he was pretty low and wanted to run for re-election -- you would really have to do a reset on your administration. go for the center. try to get the moderate voters, completely change what you are doing, which is what president clinton really did. i don't see any of that here.

they are doubling down on a strategy that at best splits the country 50/50, is highly risky, and i would -- with a job rating now in the "washington post"/abc that's 36% is certainly problematic. >> harris: look, you have all that to work with in terms of transparency. they need you on their team. the big question to me, charlie, is how do you get this far and not realize what mark just said? you have to reset at this point. where do you begin? >> yeah, it's interesting, joe biden likes to talk about how this republican party is not your grandfather's or dad's republican party. this democrat party is not your father's democrat party. it's a completely different party. when mark penn was advising bill clinton, bill clinton was trying to get a majority of the country and was trying to push an agenda that was popular. conservatives might have disagreed and did disagree and

republicans disagreed with his ideas for the country, but he was trying to do something that would garner popular support in the country. what the biden administration is doing, they are ideologues hell bent on this crazy agenda that a majority of -- i would say even regular democrat voters don't support. i don't think they really care about the polls. and i don't believe anything the "washington post" writes anymore especially about politics but when they allowed that poll to go out they conducted that poll that showed trump beating biden by seven points, i think that is a real reflection of the sort of nuclear bomb that's going off in the democrat party. they are really worried and they should be really worried. >> harris: mark penn, most normal people when they are really worried come up with a contingency plan. is kamala harris is contingency plan?

signed down playing the hunter biden laptop story calling it russian disinformation. that man in the hot seat right now. house republican report says the c.i.a. pushed other former intelligence community members to sign on to that letter and then fast tracked it to give then-candidate joe biden political cover. democrats clapped back on those claims calling them unexamined allegations on an incomplete record. and another attempt to mislead the american people. congressman jim jordan does not agree. >> it sure looks like you have someone from the c.i.a. actively recruiting people to sign the letter. he wanted joe biden to have something to use in the final debate with president trump. he new president trump would bring up the laptop story. that's not fair to we the people, the voters of this country. that letter was used to suppress the story that the country didn't get to fully appreciate.

>> harris: just yesterday the house oversight committee laid out its newest findings and said when biden was vice president under obama, at least nine of his family members got millions of dollars from foreign nationals and that there were -- appeared to be an effort to cover it all up. the "new york post" with a scathing cover, it pays to be a biden. and the "wall street journal" editorial board writing the report shows the biden family profiting from joe biden's political power. there may not be a smoking gun but there is plenty of suspicious smoke worth investigating. james comer, the chairman of the house oversight committee, great to have you if "focus." first of all, the big question today is when will we see evidence that links joe biden to all of what you found? >> well, i think what we laid out yesterday was a complex web of shell companies that the biden family used to disguise

payments from foreign nationals, from adversarial countries all over the world that would eventually end up in the biden back pockets. the reason they did this is to protect people in the biden family, obviously. the payments shouldn't have been received. probably weren't paying any taxes on it, and they knew that joe biden would get in a lot of trouble. what these companies also served was to pay for basic living expenses for biden family members. now, we have gotten the -- we haven't gotten the credit card statements yet. the inform ant tell us the llcs were paying for things for joe biden for basic living expenses. we want to look at that. one reason we wanted to have the press conference is show that joe biden did lie about his family receiving money from china. nine family members received

got his back and dispelled the laptop, which by the way, harris, we wouldn't know about any of this were it not for the information contained in the laptop. the laptop showed that there was influence peddling taking place. that is how we began our investigation. we met with the people that were named in the laptop. we got the names of the banks. i subpoenaed them and we have bank reports and we presented those to the american people. it is evidence. none of this would have happened if we took joe biden and the mainstream media at their word. we are doing things that the media used to do. watergate wasn't uncovered by a congressional committee, it was the "washington post." it was investigative journalism. i am getting attacked by the "washington post" by having the audacity to have a press

were about some conservative president they might have jumped on it already? >> i think the american people know that some wrongdoing is occurring in the white house. i think that's one reason joe biden's poll numbers are so low. i think cnn got a lesson last night when they had a crowd of regular people. they realized that what they think and how they view the world and the issues they think are important isn't what the working class tax paying americans think. i will tell you what the working class tax paying americans think about this influence peddling. they think why does the biden family get to get away with committing crimes and you are talking about money laundering and potential racketeering, you are talking about bribery, and they do that and it's okay and their grandkids can get wires from foreign national but they have to work and pay their taxes. i think the american people want us to do our job. they are watching what we're
