less than 72 hours from the end of title 42. it's been used nearly 3 million times in the past three years. but that all comes to an end this thursday. >> bill: that's when the flood gates are expected to swing open. the number is expected to jump almost double to 11,000, which would completely overwhelm yet again anyone working on that border. >> dana: under title 42 they can process my grants in the span of 40 minutes. starting thursday it will take agents 30 minutes to an hour to process a single person. >> lawmakers suggesting the white house is wildly unprepared for what happens next. the man in charge, secretary mayokas, insists that is not the case. >> so we are prepared, number one. number two, we have a migration information center that is specifically set up to

communicate with state and local officials and we have been doing so. we are using our fema regional coordinators ascii points of contact. we need immigration reform. everything that the department of homeland security is doing, everything that our partners across the federal government are doing, is within a broken immigration system. >> dana: team fox coverage. marc thiessen on deck with analysis. let's get to bill melugin live in brownsville, texas. >> good morning. the numbers are already starting to explode. border patrol reported last week alone they made 55,000 migrant apprehensions, almost 8,000 every single day with a huge surge continuing here in brownsville. look at this stunning drone footage our team shot in brownsville late yesterday afternoon. one of the biggest single groups of migrants crossing illegally we have ever seen during our fox news coverage of the border.

a line almost as far as the eye can see predominantly single adults. mostly single adult men. very few women. almost 0 children as the rio grande valley sector is overwhelmed with thousands of illegal crossings every day. recent months 70% of what's coming across the border are single adults. also in brownsville yesterday take a look at this video that we want to warn our viewers is graphic. a horrible scene. eight migrants killed. ten injured after a driver in an s.u.v. plowed into them while speeding as they were gathered in front of a migrant shelter here in brownsville yesterday. the scene extremely graphic. bodies went flying all over the place. the f.b.i. on scene investigating. the driver was arrested with local police trying to figure out what the motive was here. was it a bad accident? intentional, a dui? here is what one migrant had to say who was there when it happened.

>> all of a sudden bodies start flying all over. there were dead, some were missing legs. it was horrible. >> we'll take you out to el paso. take a look at these images. this is part of the border wall where there is a gap in the wall. what you are going to see is a group of evaders crossing illegally into the united states. they don't wait to be apprehended. they start walking down a dirt path. they get close to interstate 10 and continue trying to evade not turning themselves in to border patrol. so many agents are pulled off the front lines because of the big groups they've been dealing with there aren't always agents on hand able to arrest these evaders. el paso is dealing with big groups going into neighborhoods, running off in different directions as they gotaway numbers continue to skyrocket. case in point, back out here live border patrol is reporting

that last week alone, they saw 18,600 known gotaways here at our southern border. almost 19,000 people who successfully snuck into the united states without capture in a single week. >> dana: a busy week and you will be there for us. thank you. >> bill: marc thiessen here. good morning. mike pence was with us on thursday and said if you don't believe this administration favors an open borders policy, you can believe it now with your own eyes, mark. it is happening. >> absolutely. the worst border crisis in american history is about to get worse. title 42, they expelled over the last three years 2.6 million migrants. that's going away. the crisis will get far worse than it was before. the problem, bill, title 42 is an emergency public health measure. we shouldn't be depending on an emergency public health measure to secure our border.

joe biden has the exact same legislative tools that donald trump and barack obama had before him. they secured the border. people forget he didn't just reverse donald trump's policies, he verse reversed barack obama. he deported 3 million migrants. biden stopped doing that. under obama, the prosecutions for illegal entry into the united states doubled to 100,000 a year. biden stopped doing it. obama detained migrants including families, biden stopped doing it. these are choices. joe biden has chosen not to enforce the law. it is a simple matter of choice. if he enforces the law and uses all the tools at his disposal he can secure the border because his two predecessors did. >> dana: it is unlikely to happen and what we found yesterday from the abc poll

which at the white house must have come like a slap in the face. biden job approval 36% in the new poll from "washington post", abc. all-time low for him. call for number three, biden's fitness for office, 63% say does not have mental sharpness. and i don't know how they improve upon those numbers, do you? >> he is not improving, he is getting worse every day. you see it. compare him to bernie sanders who is 81. biden is an old 80 years old. all the polls show this. if you look at the day 838 of his presidency the single least popular president in american history except for jimmy carter in the history of polling going back to harry truman. that won't improve. so -- if you think about this. if you look at the social security administration statistics, the average american male has about a 42% chance of

making it to age 85. so biden will be 86 at the end of his second term. kamala harris has a 58% chance of becoming president if he wins re-election and she is less popular than he is. he is old but he is an old 80. and so i think americans are starting to come to the conclusion he is not up for this job. it is there in the results and there for everybody to see every time he goes on camera. >> bill: here is what would concern me if i was the white house. this is not your base entirely, but a lot. young people, right? approval among americans under the age of 30 is 26%, all right? i see that and i figure those folks have checked out on this administration. >> very true. you just see it in the fact that robert f. kennedy, a famous name but basically a nobody, never held elected office, is at 20%.

20% is more than every other republican presidential candidate except for trump and desantis. and 20% of the vote. most republican presidential candidates would like to be at 20%. a sign that democrats are very uncomfortable with biden at the helm of the ticket. >> bill: they push to attract younger people to their cause. student loan forgiveness a great example. you're at 26? no good. >> dana: i think that because the economy does not feel good for those younger people and dealing with inflation and higher rates to get a home. last point, marc. >> not all those people have college loans or went to college. a lot didn't. they are being asked to pay for the college loans of their fellow students who took out loans they couldn't afford. it is not a pure everybody under 30 loves college loan forgiveness.

disturbing video is ahead. some eyewitnesses report hearing more than 50 gunshots that sent panic. a property so big with 120 stores. people on the other side did not hear or see what was going on. it just so happens there was a police officer already at the outlets on an unrelated call. heard the shots. located and neutralized the suspect. 33-year-old mauricio garcia. authorities searching for a motives as those who live to tell their story process what happened. >> when we were running the shots got closer to us. really close. i thought they were running towards us and we were all running around and there were

[shouting] >> dana: protestor jumped onto the subway tracks in new york city over the weekend blocking a train to demand justice in the choke hold death of jordan neely last week. the marine veteran who put him in the choke hold could end up fa facing charges. >> the nypd confirms with fox a total of 13 people were taken into custody this weekend over the protests that spilled onto the subway tracks, disrupting

trains and creating chaos over the continued controversy. po police were seen moving the protestors off the tracks sat after denouncing the choke hold death of jordan neely and yelling and threatening passengers when placed in a choke hold by a marine veteran identified as 24-year-old daniel penny riding in the same subway car as neely last monday. a week ago today. neely's death was ruled a homicide by the city's medical examiner. as we wait to see if any charges will be filed there is a war of words between the lawyers and family of both men. on friday the law firm representing penny expressed condolences to the neely family while also stating that neely had a documented history of violent and erratic behavior and penny never intended to harm neely and could not have foreseen his untimely death. local media reporting this

morning that neely's family issued a statement saying penny's press release is not an apology nor expression of regret. it is a character assassination and a clear example of why he believed he was entitled to take jordan's life. neely was known for his michael jackson impersonations but his mental health had declined in recent years. his family attorney told nbc news neely had demons in the after math of his mother's murder. a source tells us this case could be headed to a grand jury this week to decide what, if any, criminal charges were filed. we continue to watch this closely. >> dana: thank you so much. you can be upset about the jordan neely passing and for the life that led up to it. interesting these protestors as far as i know haven't protested at all about all the crime on the subway. >> look how many photographers are there. every time i see this the flash bulbs are going like it's a

>> bill: she is part right but part wrong. what house republicans have said is we'll pay our bills for the next year. you just have to cut spending in return. now you have 43 republican senators in the house side who are joining that chorus. >> some of the house republican ideas are fantastic. putting up a half trillion dollars, the administration is, toward student loan issues. there are programs if you can't pay back your student loan you can have them forgiven or put in abeyance. the white house policy is hading $5 billion a month to our indebtedness by the student loan pause. they will cost a half trillion dollars. house republicans are saying don't do that. that would save half a trillion dollars. pretty reasonable. the white house doesn't want to do it. they want everything exactly as they want it. the president needs to engage. >> dana: the abc poll showed this, asking who would people

blame if default does happen? 39% say they blame republicans. biden 36%. that's evenly split. you have this meeting with biden tomorrow. do you think something comes out of that. >> i sure hope so. it is a negotiation between biden and kevin mccarthy with house republicans. the president has known that for weeks. only now is he meeting. he is meeting also with schumer and mcdonnell. it is between he and mccarthy. he has to engage and show leadership. >> bill: do you think the white house was surprised that republicans were able to pass what they actually did? >> i don't know if they were surprised but it points to a dynamic. he has got to get something with mccarthy that can pass the house republicans. if they were surprised, it shows you that my gosh, they had house republicans voting for a debt ceiling increase who had never before done so. mccarthy did his job and scalise did his job. >> dana: this poll in gallup

asks about americans being worried about the security of their money because this is the first week so far, only monday morning, we haven't had a big major bank crisis. this is people who are worried about the safety of their money in banks, 19% of americans very worried. moderately worried 29%. does that worry -- is it warranted or do you think everything is okay in the banking sector? >> i spoke to michael barr, the federal reserving point person on bank regulation and assures me it is only a handful of banks in trouble. if the american people are more broadly concerned about our nation's fiscal house, they should be. one thing i've been speaking of, social security is going insolvent 8 or 9 years. when it does, everybody -- everybody on social gets a 24% cut. neither biden or trump are talking about it seriously. they both say there is not a problem and we don't need to do anything. we need leaders who are honest.

announced plans to send my grants to the community 20 miles north of new york city. he said serious penalties could be issued if migrants arrive at local hotels. we have and will continue to take a strong stance on the mats of new york city trying to engage in human trafficking by busing in 300 plus adult male migrants from their sanctuary city to a hotel in orange town. that line in the sand has effect. it appears this hotel sold out as recently as yesterday morning now is reported to be wide open for vacancies. town officials say their small communities aren't equipped to handle the sudden increase and need for services. another quote, i agree this calls for a federal, not a local solution. to send these people to a location that is not equipped to meet their needs is a betrayal of the often-expressed desire by new york city to be a sanctuary for them. mayor eric adams says nearly

60,000 migrants have arrived in the city from texas since last fall and the cost of caring for them could climb to $4 billion. new york city will foot the bill for four months, sheltering, feeding and providing services for the migrants. his move comes after he accused the federal government of failing to support the city with the migrant crisis. >> that is putting an incredible strain on all of our infrastructure. we've run out of our traditional shelter space. we have had to lease and turn over 120 hotels into emergency shelters. so again, the federal government cannot wait any longer. >> a press conference is set to get underway in less than an hour as local politicians discuss next steps in this plan to bus migrants up north. >> bill: thank you. something to watch again. c.b. cotton in new york. >> dana: dramatic helmet cam video capturing the intensity of the war in ukraine. the latest there and news of a

where ukrainians are still holding out. it is something else, general. to think that this is your last hope to keep the russians from taking that city shows how desperate this measure has become. >> no doubt about that, bill. this is bakhmut. the russians are trying to take it for over nine months. it doesn't have much military value but it has a lot of symbolic value for them because think about what they have done and what they have failed at. they tried to take the capital, failed. they tried to take the donbas region after readjusting last year during the summer. they failed to do that. and then they conducted another offensive when the ground froze in the wintertime this year to take the donbas region again. that's failing. this is part of that failure bakhmut itself. here are the russians in a desperate situation having conducted three major

offensives, failed at all of them. they've conducted an air campaign to destroy ukrainian's energy infrastructure. that has failed. it is not 100% but it is working. they tried to destroy the morale and resolve of the ukrainian people with an air campaign by killing them. and that has failed also. now we're on the cusp of a momentum shift. ukrainians are about to go on the offensive and hopefully take significant amount of territory but more importantly liberate their people from the control of the russians. >> bill: remarkable stuff. just continue to watch it here. one thought here, general. a lot of people are suggesting by the end of the year if the ukrainians are successful that you could drive each side to the negotiating table. the thought is first of all, i don't know if putin would go for that. but the second thought is whether or not beijing would be the mediator. do you think china is capable of

doing that? would they be capable of doing that? under any scenario right now? would you want that? >> well, if they could convince the russians to lay down their arms certainly and depart the country, which i don't think is going to happen. that would be welcome. but they are certainly not neutral in this by any means. they are supporting the russian invasion here and supporting the genocide that's taking place here. they are not going to be able to have what is expected to be some kind of a neutral position to bring both parties together. it's unfortunate right now here we are on the cusp of a major offensive conducted by the ukrainians and we have certain european countries talking about negotiating with the russians. that plays right into putin's hands, bill. that's what he wants. he wants to see some weakness out of the west which gives him encouragement to stick with it, not to go to negotiations, to dig his heels in. and there is no basis for it.

the europeans, bill, so everybody understands they have trained more ukrainians for this offensive than the united states has and provided 1550 armored vehicles and 250 tanks. considerably more than what the united states has. eastern europey answer as rah percentage of gdp are providing more support financially than the united states does based on the wealth of the countries that they have. and that's not well-known out there. and now we have the western europey answer raising this sort of white flag. let's negotiate on the cusp of a major invasion. it doesn't make any sense strategically in terms of having that discussion now and giving putin a hand here to play. >> bill: thank you for your time. may 9th a big day in russian history and see how it goes in moscow and other cities near the front lines. thank you for coming on today. >> thank you, bill.

history of mental illness. andy mccarthy. this is the headline. race shouldn't stop us from tackling repeating and mental illness. jordan neely, but the issue is a broader one. he had 42 prior arrests between 2013 and 2021, including four for assault and others for transit fraud and criminal trespass. he is one of many. the recidivism problem is what we need to 0 in on it. >> there is too much race talk, i think, about crime, dana. when we really know what the issue is. it is people who, as you say, are repeat offenders. most people who come out of state custody have a record of at least ten prior arrests and five prior convictions. to just think about that for a moment, the majority of crime is

not solved. we know that it happens but it doesn't result in a conviction of anyone. so the people who are sociopath i can and habitual offenders, when they're in custody many fewer crimes get committed and they are responsible for most of the crime. probably 80% of the crime, the serious crime that we deal with, is recidivism crime. >> dana: it is new york state. it says the three-year recidivism rate for new york in 40%. what does that mean? >> what it means is when somebody comes out of custody, those people reoffend within the next three years. if you expanded the timeline, the number would probably go higher. >> dana: and so do you think that new york city and recidivism rate is replicated across the country in some of these bigger cities? >> i don't think there is any doubt about it, dana.

i think heather mcdonald has said that custody, being in prison, is actually a lifetime achievement award for crime. almost everybody who is in prison has been arrested multiple times and most of the crime that they would like you to believe that most of the people in prison are non-violent drug offenders. most people in prison are in prison for serious, violent felonies and they have been in prison before and they're responsible for many more crimes than their records reflect. >> dana: you are a former prosecutor. when you think of somebody like alvin bragg in new york and the prosecution of this possible charging of the former marine who in his mind he was protecting people on the subway. he and others were protecting others on the subway. does that enter into alvin bragg's mind? does recidivism also play a role here? >> i think the biggest thing for bragg, dana, is that if you are going to charge this person, you
