breaking news from the pentagon as the biden administration makes big moves ahead of the potential border disaster. it could come in days if it's not already happening, title 42 will be lifted and the surge is expected to grow. welcome back as "america reports" heads into another hour. >> bill: no dramatics today. i'm in for john roberts, i'm bill hemmer. we are told pat ryder makes remarks off the top and new information about the plan to send 1500 troops to the southern border within the next week to nine days, sandra. >> sandra: it's a big deal. the decision is coming nine days before title 42 expires. fox news teams have been reporting for weeks now, this has been anticipated. overburdened border towns are in panic mode over what could happen when that ends. we talked about el paso.

>> bill: seeing migrants massing by the tens of thousands, believing the end of title 42 will be the perfect time to make their move and make the crisis at the border a bigger catastrophe. >> sandra: as we await the pentagon briefing to begin, morgan ortagus, welcome to you. thanks for joining us. what are your thoughts as we are expecting this formal announcement from the pentagon a short time from now? >> important to level set expectations what the u.s. military can and cannot do at the border. u.s. military, sandra, cannot enforce immigration policy. they can't -- they can do things like build a border wall, build infrastructure. we saw the army corps of engineers were going to do that in the trump administration, that was one of the proposals. they can also do admin functions, right. because we did have 1100, if not more border agents that left the job in 2022 because a myriad of

reasons but a lot citing being very frustrated with the policies of the biden administration, so the military could come in and do admin functions, for example. but what can they not do? can't get into shooting wars with the cartels, they can't arrest immigrants who are illegally crossing, they can free up border agents by doing some admin -- infrastructure work. i also think it's important to remember why do we have to make this announcement today, why do we have to do this, not blind, they see and they know what's going to happen, they see the images you are showing throughout the day, sandra, of the border towns and what will happen a few weeks and days, a matter of days whenever title 42 will end, and that's one of the reasons why the administration was forced to make this announcement today. >> sandra: getting a little more information from the pentagon ahead of hearing from brigadier general pat ryder in just a

moment. at the request at the department of homeland security, secretary austin has approved a temporary department of defense increase of additional 1500 military personnel to supplement u.s. customs and border protection efforts on the u.s. southwest border. furthermore, reads for 90 days they will fill critical capability gaps such as ground base detection and monitoring. these are the details that emerged earlier. data entry and warehouse support until cbp can address the needs through the contracted support. military personnel will not participate in the law enforcement activities. this deployment to the border is consistent with other forms of military support to dhs over many years. could that point, can you look back at when we saw similar measures taken under the trump administration? >> yeah, this did happen in the trump administration, i think the obama administration, the

bush administration, so it's not new. it's important to know it should be temporary, right. i think around 2018, 19, whenever you saw temporary surge is he border, the trump administration moved to quickly get it under control. it has been used by other administration's, this should not be the solution that biden administration has not properly funded dhs, not properly funded border patrol and their agents and they need to be fully funded. they need support. they need support not only financially to be able to get more agents in and to be able to retain qualified and experienced agents but need political support as well. these officers that are on the front lines of our border do not feel the biden administration has their back, it's not reflected in the budget. so, temporary measures and utilizing the u.s. military are fine but this should be a solve, it should not be a solution for

underfunding the u.s. border patrol. >> bill: morgan, good afternoon, bill hemmer here. revert back to a poll about two weeks ago, a little less than that. of the seven major issues we polled, the disapproval in the administration, 61%. people are paying attention when numbers are that high. >> absolutely. and it's because of the images, it's because people in border towns are being affected. and it's not just affecting republicans, right. it's affecting democrats and independents and people who are not voters. the american people are not blind. they know when there has not been a real solution offered, i looked at the state department release on title 42 and will enforce title 8. why haven't you been enforcing title 8 the past two years. i'm not against temporary measures to stem the flow, the flow of illegal immigrants, but

what are we actually doing -- what are the long-term policies we are putting in place? the vice president is supposed to be in charge of the border. i have not seen her there, she's supposed to be in charge of root causes of illegal immigration and she is going to potentially, if president biden is re-elected, she would assume more responsibility as you would have the oldest president ever and going into a second term. >> sandra: her strategy is to blame republicans. she and the white house have made the case the republicans are in the way of immigration reform. there is a back and forth with the chicago mayor and greg abbott of texas. abbott blamed the immigration crisis on biden's open border policies, and chicago is saying hey, stop sending busses of migrants to our city, we don't have the resources. k.j.p., and abbott told chicago to take their complaints to the white house.

k.j.p. was asked about that a moment and responded with this, morgan, listen. >> it's unfortunate that governor abbott continues to play politics with migrants and with the american people. what he's doing, that's what it looks like, like a political stunt instead of trying to address the situation or maybe get the congressional members and senators in his state to actually ask them to work with us on truly dealing with the problem, with trying to figure out how do we deal with immigration reform instead of doing that he plays politics. >> sandra: she says abbott is playing politics. you know what, morgan, the reality for the cities of the influx of migrants, economic perilous situation and chicago has been very specific, you can find out the ways they have not dealt with this, and they are led by a democrat in that city and state, but dealing with the reality on the grounds. they do not have the resources

to accommodate the continued flow into their state and into the city of chicago. so they are speaking up, saying something about it, and that's real, morgan. >> listen, this administration has no solutions for governor abbott. if they did, then governor abbott wouldn't have an unprecedented number of illegal immigrants in his state. so what would they actually like governor abbott and these mayors, by the way, many democrats in the border towns, democrat officials, it's not just republicans. important to note that, that democrats have been very critical of the biden administration as well. and the lack of a plan. so, comprehensive immigration reform that is bipartisan, would that be a great thing, the american people like to see that, sure. is that going to solve the problem of thousands of migrants coming over the border and the deluge we will likely see in the coming days and weeks when title 42 expires, it's not going to solve the immediate problem. so governor abbott is doing

everything he can do to protect his people and sending them to cities often claimed to cities that claim to be a refuge for illegal immigrants. and fox actually interviewed me from the border august of last year. it went down there and spoke and heard countless stories of women and teenage girls that are raped and trafficked. we have a human rights catastrophe for latina, for teenage hispanic women this administration is basically completely ignoring. and by having basically no policy, and by having no plan to protect and secure your border, you are encouraging these cartels who are now making billions of dollars off of human trafficking to continue this behavior that is directly harming and sexually abusing teenage girls and young women and someone has to put a stop to it. >> sandra: morgan, we are going to get to the pentagon.

southwest border for 18 of the last 22 years and every year since 2006. shifting gears, the department of defense remains committed to supporting the department of state's efforts in sudan. organizing and synchronizing transportation from khartoum to port sudan and on to saudi arabia for others who wished to depart saudi arabia. ships remain in the vicinity of port sudan and are able to provide support to the evacuation mission as needed. additionally, isr assets continue 24/7 overwatch overland evacuation routes. and distribute relevant information to the department of state, allies and partners and international ngos for decision-making. secretary austin looks very

there. quick response morgan and what we think we might be able to expect when you get 1500 troops down there. >> yeah, just as we said earlier, no law enforcement capabilities, but they will be for 90 days as the spokesperson just pointed out assisting dhs and cpb. again as i have noted, this should be temporary and it should be a sign for the administration to actually increase their support in funding of dhs so that these border agents are able to properly handle the flow. ultimately the pictures you are showing will only get worse in the coming weeks and months. the administration is not going to be able to avoid this problem and just pray the nightly news does not show it anymore. too many reporters and americans speaking out. >> bill: we have had a reporter on the border two and a half years, and as far as we can tell, no other networks even come close to that.

>> sandra: i think you almost have to just keep reiterating, why this matters, when title 42 is lifted, what that will look like. cbp statistics right now, morgan -- i shouldn't say only -- 46% of migrant encounters at the border have resulted in a title 42 expulsion. what this goes away, you are looking at a massive surge at the border. when that goes away, all those people, that is a situation that will only get worse. and this is an administration who is not saying they are doing anything to address that right now. in fact, there is a blame game, morgan. >> and don't forget this is billions and billions of dollars enterprise for the cartels, this human smuggling operation. so the cartels with also lead the news and understand title 42 is ending and they know what they can take advantage of, they know how to get people across. so, we are essentially enabling

billions of dollars of illicit money, fentanyl number one killer of young people in the country, so you are going to see drugs over the border increase, illegal immigration, and as i said earlier, unfortunately you are going to see the harassment of women increase because of these policies. and just calling on the congress for immigration reform is fine. congress should absolutely act. that is an attempt by the press secretary to deflect from the images you are showing today. >> bill: nikki haley said here is an idea, reimpose title 42, close the border, as opposed to sending troops. >> sandra: a different issue on the state department spokesperson responding to fox on this pakistan program on

transgender issues. listen, this is a full screen. up on the screen. in this specific grant the department provides funding for english language learning and integral skill that helps unlock educational, transgender youth. what is the discussion that is happening around this, morgan? >> the whole grant that the state department put out, they put out an rpf, to get people to bid on this. for me and my former colleagues at the state department, we were perplexed by this and first of all, we do teach english language around the world and we should, trying to specifically focus them on transgender community in a country like pakistan doesn't make a lot of sense to me. if you think about this from a security perspective, who is making the list of who the transgendered people are, how do you have accountability of that. outing such people actually harm them in a country like pakistan where it's illegal to be a

person in the lgbtq community? what i would say, when you peel this back and look at the bigger picture, every time we do public diplomacy programs around the world, every officer, every foreign service officer, every person evaluating the person should ask themselves does this advance the american interest, is this worth spending taxpayers money over. and pakistan, subservient to t chinese communist party, we should focus on india, the largest democracy in the world and critical to have as a friend and ally against the chinese communist party. >> bill: thank you, morgan. thank you for your time today. pentagon briefing continues. fox news alert, secretary of state antony blinken has until thursday to come up with all

documents referring to the infamous hunter biden laptop letter. house republicans requesting any communication after testimony from a former cia official claimed blinken was the driving force from the statement from 2020. fox news exclusive, he's denying he had any role. >> i don't do politics, and don't engage in it. but with regard to that letter, i didn't -- wasn't my idea, didn't ask for it, didn't solicit it. >> bill: the interview conducted by benjamin hall. >> good to see you, this was the first time secretary blinken has said specifically he had nothing to do with that letter and again he went back and again and again to saying he did not do politics, he stayed out of it. this letter was written at a time when he was doing politics, he was part of the presidential campaign to help president biden

be elected. and he said the transcript doesn't lie. blinken's call help set it in motion, and mike's testimony said blinken's call did trigger it. a lot of questions moving forward and talked about china as well and i want today speak to secretary blinken how the u.s. is countering the threat, talked about the spy balloons, the hacking, the military build-up. his response to the u.s. response. >> i think what we have seen over the last couple of years is the united states putting itself in a much stronger position to deal with the x he tigs that we have with china and that we fully acknowledge. first, made historic investments in ourselves to compete effectively, investments in infrastructure to semiconductors to climate technology. >> it's not holding china back. it's not stopping china. >> the issue is i think less holding china back and making sure we are able to run faster.

public's help identifying two of those six people we know have lost their lives because of this. they are looking to identify them based on the cars they were driving. one of them in a blue chrysler 300, the other in a hundai which was so destroyed police can't figure out the color of it or its model. this is the scene where a lot of those cars and trucks have been toad, since then many of them burnt, crushed, twisted into pieces, we met survivors with their hands bandaged, at least 37 were hurt, some have life-threatening injuries and hearing the stories from drivers what they have described, they saw nothing but dust, strong winds combined with loose dirt made for blinding conditions for so many of them the national weather service says winds were gusting up to 43 miles per hour at peak. a silver lining as we were reporting, we heard some

underway in congress to set ethical standards, supporters say it's overdue, and others say it's an overreach. and nice to see you in the afternoon, douglas. how do you think this is going to go? >> well, as badly as i think anyone can predict. the supreme court is meant to sit above politics, people are meant to respect it and we are seeing once again the democrats showing a desire to disrespect the supreme court judges, ignore as was just mentioned, for instance, there is such animosity these days against certain of the supreme court justices. since the leak last year, we still haven't got to the root of, since the leak last year, clarence thomas in particular has been undergoing an unbelievable demonization in the public sphere. we have an actual assassination attempt on justice kavanaugh, and you would have thought the democrats might step back and

think is this a good idea at this time to poor kerosene on such a fire and they have decided the answer is yes, it is. so we see as i say, the recent accusations, wall street journal has completely debunked against clarence thomas, seems the democrats want to push it, a problem with ethics in the supreme court. what more could you do to that, when the country needs institutions -- and accusations against clarence thomas, such a ridiculous pitch, all been debunked, the left wing media in america is going off an associate and friend of clarence thomases who happens to collect memorabilia from 20th century dictators as a sort of memory of

massively changed by the leak that happened last year. whatever people's interpretation of the results of the midterm, i don't think anyone can deny that leak had more of an effect on politics in this country than almost anything else that happened in the last year. 0 interest getting to the unprecedented historic leak, instead, dems are going after the supreme court justices themselves and it cannot end in a good way. as i say, one of the things that holds the nation together is its institutions and respect for institutions. one institution with respect is the supreme court and seems at the moment the dems want to blow that up. >> sandra: to that point, some of, if we have not played them out yet, highlights from today's hearings. take a listen here. >> supreme court should step up and fix this themselves. for years they have refused. and because the court will not act congress must.

>> separation of powers is not some sort of academic concept that was invented by law professors. this is a concept that is structurally baked in. >> my bill would fix that. >> this is not about making the court better, this is about destroying a conservative court. >> sandra: some of what we heard, douglas. >> i think that's pretty much what we just heard there, pretty much right, this is just a drive by shooting on a conservative court as perceived by the left in this country. they would not be having these hearings if they thought this was a court that was issuing judgments that favored their political side. nobody thinks it could be. and as for the sort of attempt to claim the financial corruption or anything like this, you know, i always say just look at the shoe on the other foot problem. the boot on the other foot

issue. imagine if this was done the other way around. if the republicans were going after the democrats, or left wing court, left wing justices on this issue, the democrats would say the republicans were blowing up the constitution. they would be talking about the separation of powers. they would be talking about the founding of this country. as it is, they don't seem to mind those issues when it a campaign that favors them. there should be some things we agree on in this country. and one of them would be the supreme court does not become, you know, the supreme court justices do not all get picked off in the press, in the media, and actually literally with attempts to assassinate supreme court justices. we do not have that in this country. the supreme court is -- it's a lamentable term in this country's history so many don't

report finds the airlines themselves are to plame for the majority of post-pandemic surge in flight cancellations. jeff flock is at philly international airport. jeff, you spend a lot of time in airports. what is the reaction there? >> sadly, fortunately i'm not going anywhere, i like it when that happens. we talked to some folks about that thing, the reaction is summed up in the words of no duh, but yeah, here what happened, the house transportation committee said let's get to the bottom of this. asked the general accounting office to check out cancellations. are they the weather like the airlines often say or something else, like maintenance problems, or staffing problems. the answer is in, and yeah, it's the airlines' fault. take a look at the numbers, sandra. this is -- the people that did worse were the budget carriers like spirit, jetblue, frontier,

the numbers from the gao, 82% of the flights at spirit were the result of problems at the airlines, not the weather. the carriers that did best would be the legacy carriers, delta, united, less than 50% of the flights there were something other than weather. yeah, as i said, pretty much a no duh response from the flying public, take a listen. >> often times they just use the excuse of the weather and it's just -- they are understaffed and it's pretty obvious it's more than the weather. the weather has been here forever. why are there so many cancellations now. >> it happens, but i would not put it past them to blame it on the weather if it was mechanical. >> pretty much all of them. the money. >> crazy the airline could be taken out due to infrastructure they should have taken care of a while ago. >> reference, sandra, to the issues at southwest. you remember back last

the banks. yes, there could be a sense where it's passed on. the average american are getting hurt is the regional banks have not been paying them sufficient fees on their deposits. they should be making 4%, not a half a percent. so, they are going to lose deposits but will have issues with commercial real estate, where most of the loans are. >> bill: in my history where a bank goes out of business or bought out of dire straits, it's not good. you don't know what's underneath it. the president said the banking system is safe and sound. grady talked with elizabeth on the hill and asked this question. >> do you think the banking crisis is over? >> i don't know how anyone can say that. the fed report on friday criticized the fed for regulatory and supervisory failures. >> bill: she's right, the president is wrong. >> the fed, supervisory in san

francisco was subpar with silicon valley bank but we should understand they changed regulations under trump, changed from 100 billion in assets to 250 billion in assets on capital adequacy, so the banks were getting less regulation, had less capital and stretched assets to make more money. first republic a year ago was trading at 150. today all the investors got wiped out as did the management. that's bad management, that's risk, greed, and i think they deserve to go out of business. all supportive of jamie getting another amazing deal. i'm glad it's not hurting the depositors. >> sandra: what about tighter lending as a result of this. great concern that could be the case. >> i think that will be the case. i think a lot of loans on small banks are office lending and commercial lending and they are going to get hit by that.
