the drapes at 1600 pennsylvania avenue, the white house, waiting in the wings as biden circles the drain. nobody is more obvious about his presidential ambitions than the one and only california governor gavin newsome. for years, newsome has been auditioning to be president. he took out ads you might recall in florida touting his great leadership. what he laughably called the true freedom state of california. all right, the reality is very different. california is by far the least free state in the entire country. without a doubt, it's one of the most expensive and difficult places to start a business, build a house, mow your lawn, power your home, feed your family and protect yourself. it's the only state in america that bans the future sale of gas powered cars. the only state to ban gas powered lawn equipment. the only state to ban plastic

packaging. they have mask mandates, vaccine mandates, school closures, the toughest gun control regulations and i can keep going. newsome called the second amendment a suicide pact while surrounded by armed guards. naturally california is also the highest tax state in the country. yet this year newsome somehow faces a $25 billion budget def deficit. this is after a blue state bailout governmented california with a budget surplus. newsome spent it all and then some. in less than a year, by the way. now he's looking for cash. in fact, if passed, a proposed wealth tax will fine californians more moving out of the state. he wants them to pay a state income tax when they don't live in the state. under newsome, california is hemorrhaging people. for the first time in its

history, the state's population is shrinking. in fact california has the highest demand for outband u-haul trucks to texas, florida, carolinas, tennessee. they're seeing an explosion in growth. california is unlistable for millions of americans but not because of its climate or geography. they're fleeing because of the high cost of living, homelessness and drug addiction, draconian covid policies. all of these problems, all of them, caused and perpetuated by democrats that have ruled the state now for decades. now gavin newsome thinks that he deserve as promotion. he wants to bring all of those special california freedoms to the rest of the country. now gavin newsome is a con man, he's a liar. he doesn't know how to management a budget, he doesn't know how to fix the housing crisis or lure business and development in to the state.

obviously he has no idea what the word freedom means. here with much more, fox business host, charles payne is with us. so in california, they have a $13.5% state income tax on top of the federal tax of 40%. 53: 5% out of every dollars for taxes. so now if you manage to save money and by definition become wealthy, now they want another bite at the apple? when you die, they get another bite at the apple? how many times are they going to take a bite of the apple? >> well, they're working on one more really feverishly. you mentioned the massive exodus of people. the exit tax. this came up a couple years ago. they're trying to work it in the you leave the state they can still tax you. it's like the song, "hotel

california." you can check out new time you like but your wallet can never leave. it's nuts. what they did a couple years ago, a few proposals. they started low, right? 30 million and down to single digit millions, this one is an extra wealth tax. they start with the billionaires first and take a big chunk out of their assets and add them up and in a couple years, it goes down to $50 million. you and i have seen this before. at some point it goes from 50 million to 20 million to 10 million to 1 million to $400,000. you cannot leave the state. you can't afford your electric vehicle, you can't afford a mortgage, you can't afford the taxes you laid out. too bad. you shouldn't have been here. here's the rub. what do they say justifies this? california wants to recoup the money that its invested in businesses and individuals. you know, that old canard that we hear from president obama, if

you live on the sidewalk, the state is responsible for your success. forget about the taxes and the blood, sweat and tears and savings and sacrifice. the fact that you live in california means that you owe california and how dare you attempt to leave. >> sean: in the early years of my adult life, a lot of them where i was living paycheck to paycheck, i never looked at anybody else and thought that they should be paying for anything that i own or have in life and anyway. have we grown a portion of this society that feels that entitled that they want to empower and embolden their government to take from this group of people and redistribute it to that group of people? in other words, have enough americans now bought in to this redistribution capitalism, socialism model? is that now a prevalent point of view? have i missed the boat on this? >> i don't think we're there yet. but i got to tell you, president biden gave it his best shot last

year. earned income tax credits for couples making $300,000, they took the ground swell and they took it up a few notches. government handing you money, paying you more money not to work than you would have made working. society with kids in school, they're trying to drive home this message. there's something about the ethos of this nation. they haven't been able to unwind it. they've done a good job. they chipped away at it, this entitledment notion and fairness notion. it goes hand and hand. somehow, someone has a lot more money than you do, something nefarious is afoot and the government will make it right. they take a big chunk from them, keep most for themselves and give you a few crumbs. like you, when i was growing up, if i saw someone -- i remember the first time i saw someone with initials on the sleeves of their shirt. i said i can't wait to make money. i'll do that. all my shirts have that, right? it's something i wanted to do. one of these drivers.

when my daughter was born, my first child, don't you know how hard i worked? that's the motivation i wanted. the clock is ticking. if you live in california, you need to do these things right now. get out of the state, turn over your drivers license, register your cars in a different state. terminate all your club memberships, relocate your family to a new state, get your air looms, everything, photographs, take them out of the state right now. notify your friends that you're moving, holiday, birthday cards, send them from your new address outside california. change your professional affiliations and limit any physical contact in california. if you're making money, you think you're going to make more money. if you're bursting your butt to make american dream, move now if you can. >> sean: a couple things. in the years when i needed jobs and i never got hired by a poor person in my life. i got hired by people that could afford to pay me. every wealthy person, they have two qualities that are

consistent. one is they're smart and two they're hard working. i would imagine the smart part will start exiting california if they implement this. agree or disagree? >> i agree. real quick, they're very frugal. right now this country, the most frugal are the wealthiest. they're trading down when they go shopping. they're smart. they save. they believe in the long-term. >> sean: charms payne, thank you. appreciate you being with us. time now we call the hannity hot seat. tonight's topic, california and the second amendment. beware of the old saying, as goes california, so goes the rest of the country. now, if that happens to this country, we become california, the rest of america, that fly-over country, the red state america, you can say bye-bye american pie. it's over, it's done. as you all know, the state is home to some of the most aggressive gun control laws in the country and yet according to gavin newsome, the second

amendment is a suicide pact. americans just can't be trusted with that kind of freedom. of course, newsome said this. take a look while surrounded by armed guards who protect him 24/7. take a look. >> it's a disgrace. >> we found the governor here in monterey park not far from the dance studio where 11 were killed. >> nothing about this is surprising. everything about this is infuriating. >> california has the strictest gun laws in the u.s. >> i mean, the second amendment is becoming a suicide pact. >> there's many people in this country that support the second amendment. >> i have great respect. i have no idealogical opposition for someone to reasonably and responsibly owning firearms. >> sean: isn't that this thing about strict gun control laws, they reduce gun ownership for those that abide the laws. those that want to protect ebb themselves and their families

but don't have the means to hire arm guards like the hollywood start and elite or have taxpayers pay for armed protection just like gavin newsome has. meanwhile, violent criminals, they don't by the very definition follow the law at all. they don't care what gun laws that california is passing. in fact, more people are murdered in california with guns than any other state in america. california is per capita murder rate is 5.6 per 100,000. similar to other states. newsome's state had a higher homicide rate than states like idaho, iowa, kansas, montana, nebraska, wyoming, the dakotas, utah. a handful of other states. many of those states have virtually in gun control laws at all whatsoever. they believe in freedom. on the local level, it's worse. san bernardino, they have a murder rate of 21 per 100,000. it's not just california. major cities across the country with strict gun control laws,

>> sean: four men have been arrested and accused of raping an lsu students that was hit by a car and killed by a car an hour later. here with more, jeff paul is with us. jeff, what a tragedy. >> yeah, sean. investigators say 19-year-old madison brooks had been drinking at a local bar in baton rouge when she asked one of the four suspects for a ride home. and 3:00 a.m., police believe the group dropped brooks off where she later wandered in the street and hit by the driver of a different vehicle. she was eventually taken to the hospital where she later died. an autopsy showed a blood alcohol level nearly four times the legal limit and they also found injuries consistent with sexual assault. police say that she was in a

drunken state and unable to consent. however, the lawyer for the two of the four men charged, one is a minor session brooks death was a tragedy but not a crime adding he has video proof that shows his clients are innocent. >> can you tell that she was intoxicated? >> yes. >> to the point under the law that you're in a drunken stooper? that you cannot lawfully give consent or answer questions? absolutely that was not the case. >> lsu's president says brooks should not have been taken from them this way and that what happened to her was evil and our legal system will partial out justice. sean? >> sean: thanks for that report. prayers for the family. big breaking news out of washington. matt gaetz and jim jordan are demanding answers for the former

fbi official with his ties to the russian oligarch. while the media and the top brass inside the fbi were accusing donald trump of being a russian agent, it appears that it was one of the fbi's own who had shady business ties to the kremlin. like i have been saying the time for real accountability is long past due. it's why jim jordan is chairing the judiciary committee, which is so important and why subpoena power is that important. also tonight, speaker mccarthy is officially rejected the appointments of russian hoax administers adam schiff and eric swalwell saying their efforts to politicize committee work and efforts to undermine u.s. national security. meanwhile, more classified document drama that is unfolding tonight. mike pence says that he discovered classified documents in his indiana home promptly informed the national archives. barack obama's office, they declined to answer questions about whether there is a search

for classified records at any of his homes or offices. here with more on all of this, the chairman of the house judiciary committee, jim jordan. a member of that committee, matt gaetz is with us. chairman, in the middle of this russian hoax -- remember, give a timeline here. we have -- we know for a fact that the fbi was warned in august by bruce orr, don't trust the dirty dossier. in early october, 2016, the fbi sends agents over to meet with the author, christopher steele. he couldn't get the $1 million bounty. the end of october, mccabe said the bulk of information without the dirty dossier, no fisa applications and yet this guy working on this case was the one involved in colluding with the russians? >> right, sean. the same fbi that spied on

president trump's campaign that altered evidence in front of the fisa court, lied to the fisa court has an agent that helped launch the trump investigation is now under indictment from taking money from russia. this is the special agent in charge of counter intelligence in the new york division. it's not just any russian. it's the man that christopher steele was working for. that is the lay of the land here. that is why matt and i have sent this letter to get more answers on what was this. this guy worked 20 years at the fbi. this mcgonical. this pattern that we've seen and the political nature that exists based on what whistle-blowers have told us and what we have seen has to end. >> sean: what are the whistle-blowers saying matt gaetz and what will the american people likely learn in these hearings? >> there's two critical vectors

that we're investigating. first how we're corrupted by politics at home. that's where the whistle-blowers have talked about really degrading evidence that would otherwise imply case the biden family. this story that is breaking now that is huge shows us that there's also a real coercion with foreign cash that comes in and has an impact on our fbi. what we know is the head ohio counter intelligence at the new york field office was turned by the russians and this is the very person that helped due the intake on the initial russia hoax. so now we have to determine when that person was turned. i'm very concerned that it may have been while he was at the fbi, even in this indictment, sean, details show he was setting up business organizations in new jersey that later accepted corrupt cash from russians while he was leading counter intelligence efforts at the new york field office. there could be real dangers to national security.

that's why mr. jordan and i want to know if there's oversight endeavors that we have to engage in to figure out how deep this rot goes. >> sean: jim jordan, you and matt gaetz will be asking the questions, has the fbi be politicized and the department of justice been weaponized. in tandem, you have the oversight committee investigating the biden family syndicate and whether or not joe biden lied if he had a discussion about foreign business dealings. we know the answer to that question. it was a big lie. the question is where will the money take us. what do the american people need to know about what's coming? who are the whistle-blowers? what will we learn from them? what are we finding out about the biden family and how they have been protected and the double standards that exists in our system of justice? >> first after all, i don't think there's a question of whether the highest levels of the fbi are functioning in a political fashion. that is obvious. we know that from the

whistle-blowers. we want to get the whistle-blowers public as they're willing to do it. i think many of them are. as i said the other day, sean, so many have been retaliated against. several of them have been suspended after they have can come and talked to our committee staff. we expect to hear from them an sit for depositions. i met one, talked with one who has went public haas week in florida. so we expect that to happen. that's where we're going to start this investigation and we'll hear from people that have been targeted like the parents who were targeted via the apparatus that merrick garland put in place with his memo. we'll talk to those people as well. >> sean: i have my sources. they informed me what i suspected what i said on the radio today. i think mike pence was watching everything with biden top secret documents and et cetera. he initiated his own investigation to just check. he called the fbi when they found a couple of documents, matt gaetz and handed them over

and worked with the officials. that's not the issue to me. the issue is how was hillary clinton treated? she had all of those servers. then she had 33,000 deleted e-mails with bleach bit. she had blackberries and iphones destroyed with hammers. she had sim cards removed. now we have the double stan dashed. why was the mar-a-largo raid and why wasn't any of joe biden's residences raided? why the double standard? is that a double standard? >> it's clear that hillary clinton got off because jeff sessions was a terrible attorney general. i'm not here for the document drama. it's far more significant that eric swalwell said that donald trump was a russian agent. and now there's people in the fbi that are russian agents. it's crazy that that would occur in our country as for the documents. hey, by the end of this thing, the only person that might run for president is larry hogan or something.

down playing concerns about the strategic petroleum sales to china and the white house calling it a nonissue. even as the reserves are now at the lowest level since 1984? oil prices now on the rise yet again. here with reaction, former white house chief of stance, reince priebus and joe concha. reince, i start with you. lowest level since the 80s when the price was cheaper. that was supposed to be for emergencies. democrats potentially losing an election because of high gas prices, that doesn't qualify as an emergency, does it? >> no. so what -- so everyone understands this, what happened was, the biden administration used so much of the oil out of the strategic supply that they actually took too much. it was sitting around and then they put the oil on the open market and china bought the oil.

this is the same group of people that buttigieg is talking about all of these transportation decisions. the decisions started on day one. when they ended the keystone pipeline, they increased taxes on oil companies. they ended oil leases. to put in perspective, if you -- even if you combine what obama did and what donald trump did, they together approved ten times the oil leases that president biden did. so, you know, republicans have a message on this. it's a commitment to america, an all of the above approach. it's an approach that is technology agnostic. you take small steps towards the environment and let smart people in the open market come up with ideas to help the environment. lastly the difference between the two parties is clear. ronald reagan said that preserving the environment is not a republican or liberal idea.

it's common sense. the democratic policy is to keep all energy the ground. that's their adopted policy and it's failing and hurting the american people. >> sean: you know, i look at this and i'm stunned by everything that i see on all sides of this. you know, i'm watching joe concha, here we're talking about we're at 50% in terms of our petroleum reserves. why would the issue of thinking about selling those reserves to china even come up and the democrats are like it's a nonissue. we have no problem at all selling this to our number 1 geo political foe when it's needle for our own national security. >> can you imagine the reaction in the media if donald trump decided to sell our strategic reserves to china or at least part of it? it should only be used to reince's point in emergency situations, period. not to try to reduce prices

ahead of elections. like pete buttigieg is runsing the transportation department, jennifer granholm has no business being the energy secretary. but hey, she said nice things about joe biden and governor of michigan before that. so she should be the energy secretary in this administration and running the energy department when she has no actual experience in energy. she's like the hunter biden of this administration. so overalthough, pete buttigieg, it's abundantly clear this former mayor of a college town that couldn't handle a pothole problem that was not only appointed to address the commercial airline industry, seeing endless delays for travelers, he's here for two reasons. identity politics and to pad his resume as a presidential candidate. like so many on the blue team, he doesn't care to lead by example. because he has what?

check. you can be fully vaccinated, fully boosted and have all of the booster 1, 2, 3, 4 and 5, you can have natural immunity but you can still catch covid. you can still get it and get sick. you can still transmit the virus to others. that's what the science tells us. look at the findings that show that whether you're vaccinated or not, you can still get the covid variants that are out there today. they're both omicron variants, new ones, even if yes, you're vaccinated and boosted and have natural immunity. despite all of this, the fda is proposing covid shots annually despite more and more evidence that vaccines and boosters don't work. here with reaction, dr. nicole saphier with joey jones. dr. saphier, if i'm wrong, correct me. my understanding is if you have been fully vaccinated, got all the boosters, even got covid,

you can still get it again and transmit it to others. am i wrong or right on the science? >> you're absolutely right, sean. listening to governor hochul what she said earlier today, she doesn't wants unvaccinated workers in because she has to protect new yorkers from essentially these healthcare workers coming in and transmitting the virus to the patients, this is political regurgitating of talking points that don't hold weight in this time of the pandemic anymore. i can tell you, sean, no infections or hospital acquired infections, those are a huge problem in our healthcare system. about 100,000 people die from them every year. the cdc said in 2021, with the mask requirements, with the visitor limitations, they still were on the rise. they're not talking about covid. thankfully covid acquired infections in the hospital have been less than 2% before the vaccines and they have remained low even after the vaccines.

when you're talking ant what governor hochul is talking about, the mandate for the vaccines and healthcare workers, that's the original vaccine. the original vaccine in preventing transmission against the now circulating omicron variant is null and void. not offering protection for decreasing transmission. everybody that has been infected with omicron that is providing more protection. you can still transmit the virus. bottom line, you can't have this talking point about being vaccinated will decrease the transmission because it is less than the flu shot these days of preventing symptomatic illness. >> joey, what a horrible way to treat our military. what a horrible way. >> sean, we're going to spend 2.5 billion this year in the ndaa just for the inflation and fuel costs that doesn't mean we're spending $2.5 on fuel. that means we're spending $2.5 billion to account for inflation

just in fuel in the military. the entire ndaa is up $75 billion from more where it should be because of the inflation, all the things we're having to pay for. that's before we get to the weapons we have to replenish that we're sending to ukraine. you take that into account and you tell me our military needs to recoup if all 8,400 service members had a bonus, which they didn't at $7,000, that would be $60 million in bonuses. s that as much as they could recoup. you're telling our military spending billions on inflation needs 64 million from 8,400 service members that were forced to leave? it's insane. >> sean: they can serve six years of the seven and they want the full $7,000 back. it's madness. thank you both. joey, thank you. dr. nicole, always good to see you. when we come back, last call straight ahead.
