martha: right now hillary clinton's resting at her west chester, new york home. her husband, the former president is stepping in for her right now on the campaign trail. hillary speaking out last evening on the phone with anderson cooper, talking to you about what she says happened. >> i just didn't think it was going to be that big a deal. i felt dizzy and i did lose my balance. but once i got in and could sit down and cool off. once i had some water, i immediately started feeling better. if we weren't fast enough. i talked to my staff. we take responsibility for that. bill: the cover of the new york post calling mrs. children toll illery.

saying she avoided the emergency room to conceal her health problems. >> there are a couple things going on with this illness issue. the first is they are making the most limited concession possible about not being forthcoming about her illness before her nearly collapsing on the 9/11 ceremony that brought the world's attention to it. they said we thought it wasn't a big deal. the second thing they are trying to do is change the subject to a larger issue of transparency. a lot of their surrogates have been talking about that saying hillary clinton is not the one with a transparency problem, it's donald trump. not sure if that will work out because hillary clinton, not trump, is the one who did nearly

collapse. bill: maureen dowd was on fox last night and said he kree i is the real issue. >> the health issue is a perfect microcosm of why she has problems. she has a wall up of defensiveness and secretiveness, pushing back, the press didn't know anything. each time it gets worse because that spirals into a snowball. bill: then she said it's not the health, it's the stealth. >> maureen dowd is someone who covered the clintons throughout the 1990s. we have seen a number of appointment who did cover -- a number of people who did cover the clintons in the 1990s, and they are saying they are doing what they always did. there was always a veil of secrecy and it always led to

speculation. you will probably so republicans adopting some of this. saying if you are dissatisfied with the secrecy with which hillary clinton handled this, just wait. bill: if there is another episode, that could be big trouble, byron. >> another episode would be huge. we know there has been a lot of theorizing on the basis of no real evidence of hillary clinton's health in the past. but this incident actually happened. people are putting it in an understandable frame. we have all been sick and tried to work through it and found out we couldn't and ended up in bed for a couple days. the bigger issue was perhaps the secrecy with which she treated it. and if it happened again, there would be a lot of questions.

voter. she was attacking millions of moms and dads who want their children and want a better future for all americans. reporter: but a lot of donald trump supporters are wearing that as a bang of honor, a lot of supporters are referring to themselves as the adorable deplorables. martha: also donald trump is going to unveil a childcare policy which has started to come out this morning. tell us about that. reporter: this is something his daughter ivanka trump made her signature issue. it would allow for tax deductible childcare expenses for up to four children for people who have no income tax liability.

earned income rebates up to $1,200 per child. and reduction for stay-at-home parents. and texas deductible contributions that could grow tax-free. they ask be use for childcare and after-school education and expanding school choice. he would pro -- this is one of the biggest items for people not covered untheir employer. he would give 6 weeks. paid maternity leave for mothers. one of the big issues is how to pay for all this. they say it would be tax neutral, but it would, particularly the last item on the maternity leave, and economic punishment for mothers

in the united states. martha: this is a subject ivanka trump has talked about with three young children of her own. she is sensitive to those issues for young moms. bill: republicans getting ready to grill clinton aides who set up that email server and destroyed remnants it. that's includes bryan pagliano, clinton's senior tech adviser who pled the fifth in previous congressional hearings. his lawyers calling the subpoena by committee chair jason chaffetz a partisan attack. cha fats last night defending his decision. >> we are trying to protect the classified information. i didn't create this mess, hillary clinton created this mess. there are years of federal records. some of it so classified none of

she is going to release or wants to release. but they weren't falling down in new york, either. i get it and it's unfortunate that we have to talk about these things because we don't want folks to be sick. but the fact is she has had these episodes for months. and people are asking questions. bill: what about her points on taxes? when will they be out? >> i just don't hear a lot of interest from people in this subject learning about the individual taxes or the thousands of llc corporate filings of donald trump. bill: it's possible he will goat next two months without releasing them? >> if these audits are done my sense is he will release the taxes. if you go to the f.e.c. website they can look up donald trump's filings with the federal elections commission. what you will see is not just

bill: the president expected to veto a bill that would allow the victims of the 9/11 attacks to sue saudi arabia. the bill passed the house you unanimously friday but has not been presented to the president yet. the white house suggesting the bill would be retold when it passed the senate in may. lawmakers expect to attempt to override that veto. martha: a provocation in a series of incidents between iran and the u.s. military. the iran military threatening to

shoot down two u.s. navy planes in the persian gulf as he flew reco -- asthey flew reconnaissa3 miles off iran's coast. what's going on here? >> i think this is yet another example of iran's effort to show it is the dominant power in the persian gulf, pushing us around for everybody to see, letting the arab states know they are not really in the kind of defensive position with us they want to be in. and i think we have passed the point where we really ought to be deciding on some kinds of strategic response. not responsing to this provocation or that provocation. but doing something about this to demonstrate to the leadership in tehran it's not acceptable.

i have zero faith the obama administration will do anything like that. there was one quote of the u.s. saying we wanted to test the iran what reaction. is that why? >> i think if they thought they had some leadership from the white house and would be backed up, that would be a different thing. i assume we have been flying reconnaissance missions close to the iran what waters for quite some time. as aggravating and potentially dangerous as the boats running against our destroyers and threats to shoot down our planes, as bad as that is. if you escalate you better be prepared to think what it means if the iranians escalate as well.

i think you could end up in a worse situation if we escalate and then back down at a higher level. my hope is everybody goes to sleep for the next four months and we have a new president prepared to deal with iran. the lesson being taught is the united states isn't pushing back. martha: you can get yourself in a red line situation if you are testing this and you are not prepared to take the next step and you don't know what that next step is. you would recommend that we not do any stronger show of force in that area with larger naval ships or aircraft carriers because we are not prepared to follow through? >> if we had a real president i would be prepared to do a lot of things. i think our objective should be to overthrow the regime in tehran. but that's not the policy we have now. we don't have a president who demonstrated competence in

difficult international confrontations like this. i understand why people are aggravated over this but we need to be prepared to do it right and i don't see that response in the white house. bill: republicans getting ready to dig deeper into hillary clinton's server. on the hot seat, several former members of clinton's tech team. >> benghazi, whether it's going back to through win skit or the rose law firm billing record or the health issue. the first reaction is to deny, then it's to demonize the questioner, the critic, then it's to deflect. martha: that's laura ingrahm with the classic pattern as she sees it. the trump campaign joins us next.

happened to her when she got severely dehydrated. she worked like a demon as secretary of state and senator and the year since. >> only twice that i can recall. it is something that has occurred a few times oath course of my life. i'm aware of it, and usually can avoid it. martha: joining us is david bossie the department trump campaign manager. what do you make of the response from the clinton camp last night? >> i think it just continues to add to the confusion. you have big clinton saying one thing and hillary clinton saying another. and you have their campaign after totally disorganized.

it continues to tell the american people they don't respect the process here. they have to be more forth coming. whether it's pneumonia or not, i don't know. and so it's a very interesting dynamic with her having this problem on sunday. then them trying to cover it up, the staff not being coming. some of the after not knowing. then we find out the staff even had pneumonia as well. we hope this gets all cleared up. but the truth is yet to be found. >> the clinton campaign said you are asking us to be more transparent. we would like the trump campaign to be more transparent and we would like him to release his tax returns. the irs says even when you are under audit you can release your tax returns. what do you think about that?

>> one issue that allows you to be commander-in-chief, and that's your health. there are plenty of lawyers with different opinions on releasing tax returns. mr. trump's lawyers have been saying for many years that he cannot. that issue has nothing to do with that. martha: why is that? >> because he's under audit. mr. trump has been on this show and many others talking about that audit and telling you he's not able to do it because his lawyers advise against it. martha: is that going to change before the election? i think a lot of people would say it's fine. if you don't want to disclose that to the american people. you run a private company, you are a private citizen, that's your prerogative. but many believe what you would

see is he pays a lower rate than a lot of people. >> you are trying to equate two different things. we are talking about the health and welfare of a candidate. and we are making a political argument over mr. trump's taxes. those are two different things. mrs. clinton had a health problem, a health scare in front of the american people live on television. and now the clinton campaign in order to push back from that want to equate it to mr. trump's taxes. they have nothing to do with each other and i disagree wholeheartedly in that. i'm not going to let them play that. martha: it will continue to be the transparency issue. each side has their issue people are pressing them on. >> let's talk about mr. trump's health.

martha: he's about to release those reports. he has great stamina, he's running around the country campaigning all the time. everybody who is with hip says he has the kind of energy. we'll see what comes out. he says he expects them to be absolutely fine. i want to ask you about this deplorable issue and what your thoughts are on that. there is a piece by dana mill milbanks, and he says hillary clinton was right. he says. talking of banning muslims from this country, hesitated to denounce the klu klux klan, saying well, you may be a racist.

>> "the washington post" and dana milbank. it's not surprising they would continue this line of falsity. hillary clinton made the comment that half of the american people are deplorable. or half of the half are deplorable. and they are in a basket of deplorables. this is a problem for her because it lifted the veil, and it shows what contempt she has for the american people. donald trump is saying i'm going to be president of all americans, even if you didn't vote for me. i'm still going to be president of all americans. that's a different tone than mrs. clinton. martha: do you feel this is a gift to your campaign? >> i don't know if it's a gift but we are going to be using it to tell the american people and educate the american people to her attitude toward the american

people, to whether she has the temperament to be president. we don't think she has the temperament, and i think this type of comment, which by the way is not the first time she said it. to say it's a mistake and a one-off comment, it's very children tonian. martha: he has been criticized for calling people names, now she is calling people names. the debates will be fascinating. bill: the u.s. air force responding to more aggressive behavior by northt korea. flying a pair of b-1 bombers over it neighbor to the south. how that went over. what will we learn today from the house oversight committee. when we come back we'll be talking to a member of the committee who will be asking those questions.

martha: a show of force over south korea. the u.s. flying two b-5- -- b-1 bombers it comes days after north koreas fifth nuclear weapons test. posing a threat towvment s. bases in south korea, japan and guam. bill: due to testify five people who set up the server, operated it or destroyed it.

that includes bryan pagliano. but his lawyers say he will not testify. jason chaffetz told us you cannot simply ignore the law. two years after hillary clinton leaves office, there is a preservation order, a subpoena, a statement by hillary clinton on march 10 saying she preserved everything, then you have this conference call between clinton attorneys and platte river networks and less than a week later this stuff is destroyed. bill: i spoke to jim jordan earlier. thank you for your time, good morning. what will you get out of today's hearing? >> well, hopefully we'll get some guys who will testify and answer questions. my concern is they will take the fifth. bryan pagliano did before.

the individuals who worked at platte river network handled the server. now it looks like they are the ones who took bleach bit to the server and destroyed the potential evidence. bill: there are five who have been called today and they all had a connection to the establishment or maintenance or ultimately the destruction of what was on that server. is that correct? >> pagliano is on the front end. on the back ends is mr. thornton and mr. combetto with platte river. they worked to destroy the evidence after there was a subpoena and preservation order in place. mr. cooper worked for the clintons for a long time. he will be at the hearing today. bill: who used the hammer?

martha: so we have a couple big events about to get underway on capitol hill. a hearing that could possibly shed some light what happened to hillary clinton's emails it is about to begin. got a couple of people on the hot seat who would know first-hand how the destruction took place. donald trump's running mate, mike pence, will hold a joint news conference with house republican leaders. we'll see if any news made. there is jason chaffetz the chairman of that committee as they get ready to get underway. hour two of "america's newsroom," i'm still martha maccallum. bill: and i'm bill hemmer. looking for answers from the tech staff that managed clinton's private server, destroyed her emails and her cell phones. bryan pagliano refused to 125

times previously to testify before congress. catherine herridge on the hill. what do we expect from the hearing, catherine, let's start with there? reporter: i spoke with source on the committee, their expectation that all four witnesses would appear this morning. i was inside of the hearing room behind me, one of the witnesses is already there, justin cooper. long-time aide to bill clinton. according to fbi file he is one that took the hammer to destroy two of hillary clinton's blackberries. our expectation this morning based on our conversation with the congressional aide, that i.t. manager bryan pagliano who originally set up hillary clinton's server will appear at hearing. he was granted what they call use immunity bit justice department during the criminal investigation into the mishandling of classified information. there are two employees from a colorado firm called platte river networks this is the firm that managed the email server and was responsible for the deletion of the clinton email

archive despite congressional order and to preserve the record. the two employees have been dodging appearance. >> we enlisted united states marshals to deliver three subpoenas. we expect them to show up tomorrow morning. evidently according to news reports two of them have been granted immunity by the fbi. so i would expect them to sing like songbirds. i don't know that they will but they should. reporter: we were told a short time ago is that all of the subpoenas were in fact served yesterday. the expectation as i mentioned that all four witnesses will appear but i would give you some context on that, entirely possible two will take the fifth amendment. that is the right against self-incrimination, bill. bill: catherine herridge on the hill. martha: jails son chaffetz is now speaking. let's listen in. >> -- had it installed in the

basement of her private residence in chappaqua be, new york, he registered the email domain, clintonemail.com in 2009, the same day secretary clinton's confirmation hearing began in the united states senate. mr. cooper has described his role in managing secretary clinton's private server as quote, customer service face, end quote. he explained to the fbi he helped secretary clinton set up her mobile devices and fished with them, he would break them in half or destroy them with a hammer. interesting, mr. cooper was never employed by the state department while he managed the server. she used to conduct the business of the government. mr. cooper needed upgrading to the server for better service he turned to mr. bryan pagliano. mr. pagliano had worked for secretary clinton's 2008 presidential campaign and was in the process of closing out the campaign's i.t. assets when mr. cooper called to discuss a

new server for the secretary. to put that new server together, mr. pagliano used one from her campaign. anything else he needed was evidently bought off the shelf. then in march of 2009 mr. pagliano and mr. cooper met in the clinton's home in chappaqua, new york, and installed the new server reportedly in the basement. unlike mr. cooper, mr. pagliano went on to become a state department employee. just a few months after installing the server, mr. pagliano was hired at the state department as fs-15, schedule c. public reports suggest mr. pagliano received a state department check and was paid by the clintons, none of which he reported on his public disclosure forms as required. a recent office of inspector general report, mr. pagliano's super survivors at the state department quote, questioned whether he could support a private client during work hours given his capacity as full-time government employee, end quote. mr. pagliano left the state

department in february of 2013, just as hillary clinton, secretary clinton left. in responsibility for the server is turned over, when left. when the responsibility for the servers is turned over to our next two witnesses things started to get a little more complicated. mr. bill authority of thornton and paul combatta worked for platte river networks. he was hired in early 2013 to host the email server after mr. pagliano had been working on it. prn, platte river networks, mike greated secretary clinton's emails to from the pagliano server to its own center in secaucus, new jersey. things get come many many complicated. in 2013 "new york times" revealed secretary clinton use a private email account while at

state department. benghazi committee sent a subpoena and following news. that request was forwarded to prn, platte river networks to cheryl mills, former secretary clinton chief of staff and current interview. in the first interview with the fbi evidently, mr. combatta had no memory of that q in subsequent interview he not only remembered the request but he understood it meant not to delete secretary clinton's emails. around end of march a number of things happen. there is a conference call between platte river networks, cheryl mills and david kendall, another one of secretary clinton's private attorneys. once again mr. combatta's story changes. in the first fbi interview he said he deleted no emails of secretary clinton around that time in. later on he not only deleted archive but also used a product called bleachbit to delete her pst files on the server. at the same time number of

manuel deletions were made on backups of that platte river network server. we appreciate the witnesses that are here today. we hope they can illuminate the situation. allow us to better understand it. because as i said before, this is one of the biggest breaches of security in the history of the state department. we have a duty and an obligation to investigate it. now i recognize the ranking member, mr. cummings for his he opening statement. >> thank you very much, mr. chairman. today is our third, third, emergency hearing about secretary clinton's emails in four business days. third. in four-days. emergency. i believe this committee is abusing taxpayer dollars and authority of congress in astonishing onslaught of

examined forensic evidence, and concluded that these accusations have no merit. fbi director comey stated, and i quote, we found no evidence that any of the additional work-related emails were intentionally deleted in an effort to conceal them. end of quote. he went on to say, and i quote, we did not find any evidence of evil intent, or intent to obstruct justice. now, that's the fbi director, the man who had been a lifelong republican, a man who was applauded by the republicans as one of the most honorable public servants that ever existed. so he went on and he emphasized

in a memo to staff just last week, and i quote, the case itself was not a cliffhanger, end of quote. of course the republicans did not like the answers that the fbi director gave. so they simply manufactured today's hearing out of thin air. this entire hearing is a contrived campaign photo-op. here is the playbook the republicans are using. step one. publicly accuse the witnesses of criminal activity, no matter how ludicrous and then refer them to the u.s. attorney's office for criminal investigation. that's step one. step two. the next day invite these same witnesses to an emergency hearing on those criminal

accusations, and then rush to issue a flury of unilateral subpoenas demanding that they testify. no dedate, no vote. step three, express false outrage when these witnesses, this is the playbook, express false outrage when these witnesses, who you just accused of criminal activity, take advice from their counsel to assert their fifth amendment right not to testify. there you have it. presto. instant photo-op. that is what happened to mr. combatta and there -- mr. thornton, despite the fact that a team of career law enforcement agents at fbi recommended unanimously against bringing any criminal charges in

this case. keep in mind that director comey said this was an all-star group of fbi agents, an all-star group of fbi agents said unanimously that these gentlemen should not be charged. then there's bryan pagliano. the i.t. specialist who worked on secretary clinton's email system. mr. pagliano has already been interviewed by the fbi and the fbi provided us with the results of his interview, but, the republicans disagree with the fbi's conclusions. so here we are. mr. pagliano has already asserted his fifth amendment rights before this congress. he did this when chairman gowdy issued his own unilateral

subpoena to force him to appear before the benghazi committee on the same issue. of course i sat as a ranking member on that select committee. obviously mr. pagliano was concerned about the criminal accusations that republicans are making, were making, so his attorney advised him to assert the fifth amendment. there is no legitimate reason for republicans to force mr. pagliano to appear yet again before congress just to assert his fifth amendment rights one more time. how many times will republicans do this? will they force him to take the fifth in front of the science committee next? how about the homeland security or intelligence committee? so we have then go to those committees too? this is absolute abuse of authority. now, chairman gowdy and i

disagree about many things but i give him full credit for one thing that he did. at least when he subpoenaed mr. pagliano he did it in a private session. he did not force mr. pagliano to assert the fifth in public just to humiliate him and i respect mr. gowdy for that. let me say this as explain as i can. if this committee's goal were just to get mr. pagliano, or other witnesses on the record asserting their fifth amendment rights, we could do that easily in a private session just like mr. gowdy did with mr. pagliano a year ago. there is no legitimate reason to force mr. pagliano or the other witnesses who were subpoenaed for this hearing to assert the fifth in an open session. there is only an illegitimate

reason, to get a photo-op that republicans think could harm secretary clinton's presidential campaign. finally, some may argue that mr. pagliano or mr. combatta should testify before us because they received limited use immunity for their statements to the fbi. but no lawyers worth their salt are going to let their clients testify before a congressional committee whose chairman just sent another referral for criminal prosecution. no matter how frivolous the accusations are. they are just not going to do it. pursuing these kinds of blatantly political attacks, undermines the integrity of our committee, the congressional process, and the constitutional rights that are supposed to

letter dated september 7th, 2016. mr. pagliano informed the committee through his attorneys that he might assert his fifth amendment privilege. i authorized a subpoena for mr. pagliano's testimony. on september 8, 2016 the committee transmit ad subpoena to mr. pagliano's attorney and the subpoena required his presence here today. mr. pagliano is uniquely qualified to provide testimony that will help the committee better understand secretary clinton's use of a private email server during her tenure as secretary, as, at the state department among other things. the committee invited him to appear the expectation that the testimony will advance the committees' investigation which seeks further information about the setup, management of secretary clinton's account and other technical aspects of the account. i take my responsibilities as committee chairman seriously, especially the decision to issue a subpoena. it is a serious matter. mr. pagliano has chosen to evade a subpoena duly issued by the committee of the united states

computers, one in chappaqua. why did you set up clintonemail.com? >> secretary clinton was transitioning from presidential campaign and her senate role and had been using primarily a blackberry for email correspondence. there were limitations to her ability to use that blackberry as well as desire to change her email address because a number of people had received her email address over the course of those activities. so we created, with a discussion of believe with huma abedin at the time what domains might be of interest. we obtain ad domain and we added it to the original server used by president clinton's office for her to use with her blackberry at the time, and we set that up in a way where the messages simply came into that server and bounced right to her blackberry and were not retained on that apple server. >> who paid for these computers? >> all of them were paid personally by the clintons. >> personally? >> personally.

decision made to switch to one server from the other. in my conversations with mr. pagliano i was aware the apple server we were using was not fully meeting our needs and was not expandable to meet potential future needs of other staff in president clinton's office joining the server. it also did not have a robust solution to support blackberry usage. very hard for me to even remember what the technology around blackberry was then and how they functioned. there were more progressive ways to use a blackberry. mr. pagliano had the expertise to set you up a server that had a proper blackberry interface with it, and that was something that was desired by president clinton's team. so over a period of time as bryan decommissioned those servers from the campaign, we were able to purchase them from the campaign. he then took time to set them up on his time either in the campaign offices or his home, i'm not sure the location. then delivered them them to
