maria: good friday morning everyone thank you so much for joining us. i am maria bartiromo. friday april 26, your top stories, 6:00 a.m. on the east coast. sticker shock persist as the inflation story unfolds. features are indicating a big rally at the start of trade ahead of the federal reserve preferred reading on inflation. the dow industrial of 58, the nasdaq up 163 extended yesterday's big moves, the march pc index could be a market mover out to a half hours time, 8:30 a.m. eastern join us as were counting down to the numbers, the dow and nasdaq selling off yesterday as persistent inflation keeps investors on the edge when and if the fed will cut interest rates. the dow industrial plummeting, the s&p lower by 73 in the nasdaq lower by 100 points. growth is slowing as earnings on top this morning.

would be a ceremonial president, that's not what the founders had in mind in the justices were on the game. presidential immunity is imperative or you practically want of a country anymore. maria: about came out of the hearing, the scotus also warning the supreme court is seen a dangerous president and president can prosecute their political rivals. watch this. >> the president may be criminally prosecuted by a bitter political opponent, will that not lead us into a cycle that destabilizes the functioning of our country. we can look around the world and find countries where we have seen this process and the loser gets thrown in jail. >> i'm trying to understand the disincentive from turning the oval office into the seat of criminal activity in this

country. once we say no criminal liability mr. president you can do whatever you want. >> i am concerned about future uses of the criminal law to target political opponents based on accusations about their motives. maria: fascinating to hear the arguments of yesterday and this will continue. the your reaction. >> ethic it's refreshing to see the highest court in the land having a deliberate conversation on the issues that many people in this country have forced to decide. many people have said for a very long time these issues are much longer than president trump. they have large ranging impact on the veracity of our republic. in some ways it is always appeared that people are willing to damage the institutions that have allowed america to become the envy of the world by actually trying to go after president trump in a way that is beyond the pale.

hopefully we will see them strike the balance between accountability for anyone who holds the office but also hamstring in a way that the business of the people and stability of the world is in many ways compromised. maria: i think you're spot on. the two systems of justice has been the story for donald trump since he walked out the other bitter and announced, excavator and announced who's running for president. dave used things against him, the other side, political enemies in many cases were not even true. that's really what the justices are talking about right here, being used against drop. >> again there are people who hated president trump, members of congress talking about impeaching him before he even had taken the oath of office. from that point forward it seemed quite clear to many people no matter what he did or didn't do their going to try to find some way to penn a crime on the elephant. now we have the issue with the

president, at least outside of the courthouse talking about what many of us have said the supreme court is the last bastion to ensure the brinksmanship of her politics doesn't overrun the purpose of the country. maria: i was happy to hear that the supreme court justices are talking this out. hash judiciary republican state manhattan da alvin bragg in the das office of political motivation and animus to infected prosecutorial discretion in the trump so-called hush money case, jim jordan said x prosecutor mark pomerantz put public pressure on bragg to actually charge trump. we know this was overlooked many times and yet alvin bragg went forward with it. >> this is pretty sad, it's a sad commentary in the current state of justice in the united states. there's no way in the world that this case would now be occurring

on the push for artificial intelligence business, that stock better than 4%, chevron earnings out in just a moment you will have those momentarily. getting ahead laffer tengler investment cio nancy tengler is with me as chevron chairs are about half 8%. thank you so much for being here. i love the fact that you look at fundamentals. i want to get your take on it, how are earnings from your standpoint in terms of fundamental growth. >> i pinned the piece on monday that suggested we would see a slowing economy. last week's earnings were disappointing from the industrials. we saw guidance lowered in some cases and other cases we solid reaffirmed but very few instances of earnings being guided up but this week takes the cake in the same piece we reaffirmed our commitment to technology and a lot of people have been saying it's over and a.i. is not real and you saw

yesterday microsoft earnings contributed materially to earnings and the google news was fantastic, we on both microsoft the 12 best ideas portfolio. we're very pleased with what they deliver, we think were just getting started early innings in the a.i. race. maria: yesterday we saw the obvious slowdown that you're referring to, we had gdp at 1.6%, compare that to the quarter before at two plus% in the quarter before the at 4.9% you talking about gdp going from 4.1% from or .6% in a couple of quarters. even though the macro story is slowing you will see outsize growth from big tech. >> infected a slowing economic environment you want to own companies that have reliable earnings growth. if you take a company like service now that reported this week up over 24% that's what i

want to own in a slowing environment but what was more troubling some of the gdp slowdown was inventory subtracting and trade about 1.3%, we are slowing and what was more troubling the quarter pce of 3.7%. that should be what we will see today with the pce numbers. nobody wants to see slowing economic growth and rising inflation. maria: inflation has been persistent, sticker shock is in food, fuel, rent. will today be a market mover and you think it's going to stay appear for a little bit? >> i think those of us that live in the real world know prices are 20% higher so only on wall street do we look at the rate of change and say good prices are only going up 0.3%. americans are hurting, i think that is very clear. we continue to draw our analogy

to the 1990s were you had stronger economic growth and strong productivity and they were able to coexist with strong stock prices. maria: jamie dimon collated the 1970s. able to get to the earnings breaking, chevron right now earnings beating expectation there actually beating on earnings-per-share and revenue. earnings $2.93 a share. revenue of 48.7 billion. expectations were for 287 a share on revenue of 56.6 billion. 293 on revenue of 48.7 billion it could be a mess on revenue even though it's beating on earnings. stock is up flat a quarter of 8%, what is your take on the oil sector. >> we own chevron it is a disappointment that they missed on revenues and that really tells you what they see from the demand standpoint. i think a tell this company settles the hess arbitration

with exxon it does not go anywhere for quite some time and has performed about half of what exxon has performed year-to-date. it's being held back. maria: would you buy oil companies knowing the oil may stay up in the 80s for some time. >> we are overweight but that's not saying much because industry weighting is pretty low in the s&p but we own fang, chevron, eog, we like those names you're getting paid to wait for things to get better via the dividend. we are pretty happy that were not adding to the group and were happy with our position the way it is. maria: then there's the fed, let me bring john dansk en. the federal reserve alpha-1 c meeting next week. obviously we won't see them move in rates next week but we could get more commentary on whether or not a cut soon or sooner than later. >> that is true, the market does

not see the first rate cut occurring if it doesn't have a september 18 meeting of the fomc. the reality is we have to see a material slowdown if we have a just entered this inflationary economy. we don't have that yet. you're talking about the court pce price index that was a surprise on the high side. if i worked this number out it's telling me for the month of march the court pce index was up by five tenths of 8%. earlier the gain was expected to be only three tens of 8%. finally on the gdp report all of the growth came from consumer services for consumer spending. spending on durables was down, spending on non- durables was down and moreover one of the reasons though of reading was so

low because government spending grew by over 1% as opposed to faster than 4% growth in the final quarter of last year. if you take out government, this is a lackluster economy. maria: that's a great point and i'm glad you raised it. i want to get your take on that. i spoke with stephanie palm boy after the number was out and she said of the 1.6% growth, yesterday that we saw in the g gdp, consumer spending on housing, healthcare and insurance was up one point to percent. out of 1.6% yet one point to percent spent on housing, healthcare and insurance, that is all inflation. >> i think you want to pay attention to what john said about government growth that showed up in the non- foreign payroll numbers last week or month, whatever it was it was largely government and non- growth areas of the economy. i would say look to the '90s for the fed's playbook you can

the communist party of china a high did as well but this story is talking about the sjp parent organization funded by a network of on profits funded by among others george soros the billionaire left-wing investor. >> we've seen this in the past they use the dark money cut out and it's funded through subsidiaries so it's difficult to follow, that's why last monday you saw when this kicked off the protest occurred simultaneously in cities across the country this is before they occupy columbia but we had all these protest i was out there so i was up close on them the protester very, very much like occupy. is not to students i've seen the ages of some of the arrestees there in their mid-20s well past college age. you can see there going out at the same time all over the country and they have the same tests and obviously this

coordination and somebody is pulling the strings. maria: unbelievable what about the story of the day house judiciary republicans say alvin bragg and the das office allow political motivation and animus to infect the prosecutorial discretion in the so-called hush money case. the judiciary chairman jim jordan says that x new york prosecutor mark pomerantz put pressure on alvin bragg to charge trump and people are looking at the trial saying we still don't understand what the crime is in the threatening years and years in prison for donald trump, what is the crime. >> we talked about this when the indictment came down. it's got no clear, 34 counts but all goes to a felony to get under the statute of limitations. based on the second crime the alvin bragg has still not hallucinated. that's a real problem. in the sense donald trump still doesn't know specifically what is charged with. the reason for that, the secondary charge is the one that is really problematic. it's a federal election charge. alvin bragg has no jurisdiction. the case law in new york says

you cannot use a federal statute to bump the state charge that's the way the state law goes. real estate you have to rely on a tax charge or something but the problem with that why didn't he charge it he has jurisdiction over that, the examination of this and why it was brought forward really has merit because the case is almost certainly not going to hold up on appeal and then you have to say after everybody else passed on it including alvin bragg's office originally, why did he go forward. maria: the legal situation is going to feature prominently in new york the verdict possibly in may or early june. i want to know what this means for the election. really interesting hearing, president trump speaking out about the first day of supreme court hearings on presidential immunity where some of the justices seem to be open to granting some level of protection of immunity for president trump, watch this.

they will have to use the test to ascertain what happened here in as justice gorsuch said what that's going to involve is looking into the mind of the president and trying to ascertain motive why was he doing what he was doing and the outer limits of both sides, one side best articulated by justice jackson and the other by corsets, comes down to the two extremes because as neil gorsuch said you speaking to the ages this will be with us for the rest of our lives, remember whether it evolves to the credit of the sitting president or not during an election we should remember that it is part of the president's official duties to ensure that the integrity of our election system is sound whether it cuts against him or not and it's an argument that donald trump's actions if he believed that the election had really been undermined are within his official duties if he felt like it had been impugned. maria: were to be watching that. by the way it's good to see you.

i wanted to ask you about harvey weinstein and the rape charge overturned in new york. real quick. >> i think that's very significantly for the donald trump case because the donald trump involves prior bad acts and that's what got the weinstein case thrown out. it's sandoval all the two cases that are implemented. that is likely going to matter if the case appeals for donald trump. let me just say for this reason and others i can tell you and go to the top question. as a cop and not as a lawyer. if i had brought this into the manhattan district attorney's and asked them to go forward they would've laughed me out of the room rate is only because his name is trump. count on that. maria: taken to the bank, i'm sure you're right, paul mauro joining us. i want to tell you exxon mobil is out and the numbers are below the revenue. it looks like a beat at 83.0 wait billion. that's better than expected but the earnings are amiss the earnings copy to dollars and 6
