advisory serial regulators, i don't mean kellogg's. they are stopping power, electricity, they are stopping national security, economic growth. it is here insanity. anyway. i need to be seen again by watching liz mcdonald. >> thank you, larry he's never been in the private sector,
5:01 pm
supporting taxpayers all his life so that is the back story. larry, good to see you again, a great show. this story, it looks like more and more like cases against trump could be falling apart. joining us now, former federal prosecutor, from a congressional investigator tim dewey, it's good to have you both on. the u.s. supreme court today majority sounded like they may limit special counsel jack smith's 2020 case against former president trump. presidential immunity. what does it mean now? >> it's interesting because it didn't seemed like a large majority of the core certainly got there has to be some residential immunity for official acts. i think before this case was brought, these cases were brought against president trump most people assumed presidents had immunity for official acts like others like the speech and debate class but these cases are
5:02 pm
extraordinary brought against the president and the arguments today suggested the president trump will give a strong ruling for majority of the supreme court that at least his official act are immune from criminal prosecution. the question becomes which official act -- >> let's show the new york times headline because even the new york times is saying it so what do you think about where you come down on this? >> i think that's right, a court majority probably have a five -- four, extension three official acts police have immunity and they're going to send it back down to the lower court to make factual findings that say under this task what was an official act. bottom line, it would push the case beyond the election so that's where i think it's going to go. i think the argument was extraordinary that we have reached where we have that given
5:03 pm
in that setting and having to discuss liability for court presidential acts. >> let's listen to president, former president trump. he spoke today about how the supreme court hearing was a game changer. watch this. >> the u.s. supreme court had a monumental hearing on immunity, presidential immunity and i hope it was clear that a president, most of you could say a ceremonial dozen of the south the founders had in mind. >> what is your reaction to that? former president trump got an outpouring of support from new york city construction workers. what you think of what he just said? >> in my opinion, i think the most extraordinary thing today was some of the justices seemed to take it as a given that the
5:04 pm
department of justice prosecutors and grand juries could be trusted to be politically neutral when it comes to prosecuting someone like a former president of the united states. i think she just look around the country here in atlanta, flo florida, new york and d.c., i don't see why any of the justices of the supreme court should be comfortable that you got neutral prosecutors. certainly the new york case shows certainly not even a crime there and the justices and supreme court should cut down should not be taken as given these entities are not poli political. >> the supreme court did appear open to middle ground on residential immunity. that's what we heard, what does that mean, middle ground? >> i think it's to say that a court official acts are immune and to send it back on what is an official act, reference to glazing kate and opinion by
5:05 pm
judge task at hand that me the rubric they used. i want to tell on what they said, the nature of this case isn't just alliance on the jury, is the department of justice position. mike is a great lawyer but was pressed and he said obviously there's immunity for court act like appointments and was asked wait a second, that was charged. he said to say this case is different. this is the one case that is different. i think that gave away the game, the department of justice is attempting regime to one man, president trump. >> the way it seems to break that, the liberal justices skeptical of immunity, conservative justice moving the other way. we are talking justices neil gorsuch, samuel alito clarence thomas, chief justice john roberts, he appeared to be looking for an offramp to send
5:06 pm
the case back down to the trial court. that will delay election, let's listen to what the justices s said. >> if an incumbent who loses close hotly contested election knows a real possibility after leaving office is not that the president is going to be able to go off into a peaceful retirement but the president may be criminally prosecuted by a bitter political opponent, but not lead us into a cycle that destabilizes the functioning of our country is a democracy? should what about president franklin d roosevelt's decision to return japanese-americans during world war ii? couldn't that have been charged under 18 usc 1421 against civil rights? >> it seems there's some area you conceived when it official
5:07 pm
acts that congress cannot criminalize and now we are talking about the scope. >> take on what you just heard. >> i agree with the justices and that is what happened during the argument. i think it was extraordinary have michael had to concede that there are some cases where the president has immunity. i think in this case going to happen is get sent back down to the judge, the judge will have to have fact findings. that means witnesses and hearings, make a decision and rent back to the supreme court again where there will be disputes and oral argument. this isn't going to trial anytime soon. >> wrap it up for us. >> i think that's exactly right, this is an going to trial anytime soon and étude, one final confession of the argument is important. he conceded the solicitor general was consulted in the pint in the position. that means highest levels of biden's justice department, not
5:08 pm
special counsel should wait and to go after president trump. >> what does that mean? beckett means jack smith is not, he is special counsel but the notion the white house isn't involved, the president's political appointees are involved, that's not correct. >> so is not independent. thank you so much, good to see you. to this case, the only other case it looks like against former president trump, it might possibly reach a decision before the 2024 election it's the new york hush money trial fox news nate fully lived from new york state supreme court in new york city with the latest. good to see you. >> what is you. cross-examination of former american media ceo and president david becker underway and will continue tomorrow at the end of court, there is a dispute over the jury left about the way phrase the question. the judge agreed and needs to be addressed with the jury first
5:09 pm
thing in the morning but the cross-examination began with hecker explaining publishing stories about trump was good for his business and he let chuck know about negative stories as early as 1998. long before he got involved in politics. becker explained summer stories for arnold schwarzenegger story about tiger woods during his direct examination today. pecker says he hasn't spoke to thompson's 2019 but when asked if he had negative feelings, he said was the opposite, trump acted as a mentor for him and even though they haven't spoken, he is still considering him a good friend. he did talk about a nonprosecution agreement which american media entered with southern district of new york or campaign finance violations, that agreement detailed the trump tower meeting at 2015 when
5:10 pm
pecker made an agreement to benefit the trump campaign by suppressing negative stories about the former president and publishing negative stories about his political opponents including bill and hillary clinton as well as the republican candidates the primary shift at that time. he finally, just to wrap this up will testify 2017 meeting with trump at the white house after he won the white house should trump asked how karen is doing, karen mcdougall, purchased lifetime rights to the story alleging an affair with the former president and he said all of his dealings with michael cohen about the president's former lawyer for in that capacity is trump attorney, been part of trump's campaign so a busy day and will get back to it 9:30 a.m. tomorrow. >> thank you, it's good to see you. let's bring in former deputy assistant attorney general john yoo. great to see you again.
5:11 pm
your reaction to the report? it sounds like a lot of atmospherics and not a lot about the nuts and bolts and facts about the case. reasonable doubt problems. >> this is a good day for trump as you heard supreme court on media also in the courtroom today in new york city the reason is because book crime was actually committed by donald trump? the das trying to pretend donald trump violated federal election law. he corrected election 2016 using these campaign tactics but what you are hearing the witness today is supposed to be the strongest witness for the prosecution is that this is something celebrities do and pecker was doing a disservice for celebrities. it has nothing to do with the campaign. there's no law broken and da rags case lapses.
5:12 pm
>> one juror has reasonable doubt trump winds, the case is over, there's a lot reasonable doubt. prosecution is putting up witnesses should who basically admitted made things up like michael cohen david pecker, publisher of the national enquirer, da rags witness, he testified made up a negative story in 2016 about the father of senator ted cruz and oswald. rags team cites a felony using new york state law. the underlying crime is a conspiracy to affect election. that's a state law musto a misdemeanor. state law only covers new york state elections, not lateral collections. this is a frankenstein case that the da is not allowed to touch federal election, that's the u.s. justice department federal elections commission.
5:13 pm
they looked all of this and decided not to go with it because the same problems you're talking about. they don't want to rely on michael cohen is a star witness for the government, they don't want to put david to chris witness because you got cloud witnesses in the case of covid are people testifying favorably to trump. that's why the case -- is left out here. one juror thinks this is not worthy and hangs the case, it's a mistrial and will finish before. >> the southern district of new york, the d.o.j. doctor. manhattan da bragg sets it back into life when trump decided to run again. that's where that basically she tried to claim federal felony nor charged federal election crime violation built on new york state misdemeanors. books and records cases, the violations. take it away in very similar to the case got to think about the

on, from where you sit, it looks to us more and more like the cases against president trump are hit with setbacks, could they be falling apart? they may take a middle ground on presidential immunity. >> i think they should. i think they ought to give broad discretion to president of united states to protect america and american citizens, taking actions he will need immunity from. then, they could do us a favor, here are the things that president does not have immunity for, it may be personal in nature, embezzlement that kind of stuff, hopefully that will happen, and pull a lot of teeth out of mr. smith 's prosecution, i believe that splitically motivated.
5:57 pm
elizabeth: -- is politically motivated. elizabeth: we heard that solicit or general for biden white house was in touch with jack smith's team, means that basically biden white house saying they have nothing to do with it, it is independent, this does not sound want. independent. >> can can't be independent, attorney general works for the president of the united states, that is part of the problem, any climb of independence rings hollow because the man works for you, how independent could that individual be, his actions have spoken, he is not very independent, he does everything to favor president biden and everything in his power to prejudice former president trump, who happens to be the main rival of his boss, biden administration trying to say they are independent
5:58 pm
is foolish. elizabeth: what have you heard from your democrat colleagues about these cases, what to they think? >> they will -- toe the party line, look president trump is guilty of this and that and on other side, saying now, this assault political witch-hunt. by the way it is really dangerous. this is the kind of stuff you see in nicaragua and third world, in nicaragua then ortega had a novel way of winning reelection, anyone who announced they would run against him, they were thrown in jail. this is pretty close to that you are trying to put your main rival in jail. you are trying to embarrass him before the election. and using the doj as a weapon to carry out your plans. that is flat out wrong, american people should reject it. elizabeth: your reaction of former president trump watch this. >> today was a breath taking
5:59 pm
this room you saw what went oit was breath taking. amazing testimony. this is a trial that should have never happened, this is a case that never should have been filed. elizabeth: that was former president trump on hush money trial here in new york. if just one jurors had reasonable doubt trump wins, the case is over, there is a lot of reasonable doubt, they put up witnesses who admitted they have made things up like michael cohen. and it covers local state races not federal. your word. >> my word, you got a local prosecutor using federal law which even biden's doj decided not to prosecute. and so, this is a long stretch by any means. and it should be rejected unfortunately, it will go
6:00 pm
down to the jurors and what the jurors feel, unfortunately for president trump, he is in a place where like 85% of the people voted for president biden, not for him. can he actually get a fair trial, no matter the evidence says. can he get a fair trial. we'll see, hopefully there is one, two, or three in there that will back at facts as they are, no matter how they feel about the president vote the right way. elizabeth: thank you congressman carlos gimenez. >> be sure to tune in tomorrow, we have from "wall street journal" editorial board kimberly strassel. and victoria coats that does it for us, thank you for watching "the evening edit" on fox business, now time to send it to dagen and brian. dagen: thank youi. elizabeth: sur
