president trump. plus, spying on ordinary citizens without a warrant with. utah senator mike lee on fisa. will the fbi abuse the ability to spy on americans once again with lawmakers passing the controversial fisa bill? it's all right here, right now on "sunday morning futures." ♪ ♪ maria: and we begin this sunday morning with the newly-passed foreign aid a bill headed to the senate this upcome coming week after the house passed a $95 billion package of bill which includes aid to ukraine, israel, taiwan and a fourth bill forcing the sale of chinese-owned tiktok. it was a victory forrous speaker mike johnson who -- house speaker mike johnson who receiveed support from democrats while facing a threat from georgia congresswoman marjorie taylor greene of filing a motion to vacate. the congresswoman did not file the motion yesterday despite the bill's passing, and she will

join us live coming up many just a few moments as the bill sends $60 billion to ukraine, $26 billion to israel, $8 billion the taiwan and the indo-pacific along with humanitarian aid for gaza all in the face of a $34.6 trillion national debt in america. it is headed to the senate floor for the vote on tuesday. of joining me now ahead of it in this "sunday morning futures" exclusive is texas senator ted cruz, a member of the senate foreign relations and judiciary committees. senator, thanks so much for joining us. >> good morning, maria. good to be with you. maria: what is your expectation for the foreign aid bill once it reaches the senate on tuesday? if. >> well, as you noted, we're going to take it up this week. i think there's a lot of support for the bill in the senate. i think think it is quite likely to pass when it comes over on tuesday. look, there are elements of this bill that are good, there are elements of the bill that are not so good. the most important elements of the bill, the best parts of the bill are, number one, much-needed military aid for israel. israel has been at war since

october 7th, israel has been depleting its ammunition and and has been depleting iron dome and david's sling and arrow 2 and 3, the missile defense systems that have saved countless lives. and so i think it is important that we provide that israel military aid. the democrats have delayed that seven months now. i think it's important that that be in there. there's also, very important in this bill, is the tiktok prohibition. that is major, major legislation. you and i have talked before about a tiktok. i have deep, deep concerns about tiktok controlled by the chinese communist government. i think the i chinese communist government is -- can, number one, use that for surveillance and espy manage of american citizens and, number two, hay use it aggressively to push propaganda, anti-america propaganda, to our young people. this bill's a major step forward in that it e forces china to divest of tiktok. both of those are good. i think the most disappointing part of this bill is that it

does not do anything meaningful to secure the border. this was an opportunity to take a serious step forward on the border and, unfortunately, the democrat party position is they support open borders. they're unwilling to do anything on border security. as for the ukraine funding, i think this got more focus than the democrat bill, the ukraine funding. of the $48 billion, roughly $35 billion of it is directed to the u.s. military. i think that's, that is a good thing -- maria: okay. yeah. >> and a portion of it is also structured as a loan. that is a good thing. i wish this were directed at only military aid and not economic aid. unfortunately, there's about $10 billion of economic aid as a forgivable loan. i'm not a fan of that, but i am a fan of, as i said, the israel and tiktok portions of the bill. maria: well, you're right, i mean, joe biden could just or forgive the loan. it's a loan, but it's a forgivable loan. even brandon judd, the head of the border patrol union, was so

disappointed in this because there was absolutely no if help for the border. i mean, couldn't the lawmakers have actually just forced a change, a new security at the border? not even any money? brandon judd says this, there's nothing more backwards, i wouldn't have even expected taxpayer dollars. they could have given us policy, and that would have been enough. no policy changes at the border. why are you having such a hard time the moving the needle on security at the border, senator? you, meaning republicans. >> well, listen, the democrat party has, embraces open border. they want this invasion. republicans, listen, i feel for speaker mike johnson. he has a virtually impossible job. he's down now to a 1-vote majority. that majority if goes all the over -- all over the place on everything x. so he's a good man who is trying mightily. but at least so far republicans have not been willing or able to use the leverage we have to force real border security.

i'll tell you, maria, this week was a bad week for the united states constitution. this week we had the alejandro mayorkas trial that was supposed to happen this week, and senate democrats, every democrat refused to hold a trial and essentially nuked the impeachment proviolations -- provisions of the constitution. and also this week we saw both the house and the senate refuse to enforce the fourth amendment's warrant requirement for searches of american citizens on fisa. and i think both of those the in the same week is really a bad week for the constitution. maria: well, and not to mention this two-tiered system of justice. you have got opening statements in the so-called hush money trial tomorrow for president trump. and i should point out we've got breaking news from tony bobulinski, he is actually filing suit against your colleague in the house, representative jamie raskin. tony bobulinski says jamie raskin as has repeatedly lied about the plaintiff, tony bobulinski, implying and directly stating that bobulinski

has lied to congress and is a trump campaign plant. so you've got all of this side show going on as president trump has to face down on all of these indictments. opening statements beginning tomorrow while i you got potential corruption in plain sight and no focus on u.s. citizens at a, you know, seeing what's happening to the country with the open border. >> well, and, maria there's a unified thread through all of this, and it is that democrats are willing to abuse power and defy the law in order to stay in power. their number one concern that trumps everything else is keeping democrats if control. people ask me all the time, why would they allow -- we're now up to 11 million illegal immigrants under joe biden. maria: wow. >> the worst in history. why would they allow this invasion? the answer is simple, they view those 11 million illegal immigrants as future democrat voters. they want to stay in power. on the impeachment trial, why would they utterly ignore the

text of the constitution and 200 years of precedent? because they desperately did not want the facts of this invasion at our southern border before the american people. they did not want the american people to see the people who are dying, the women who are being sexually assaulted, the children who are being abused and being murdered, the drug overdoses, the crimes, the risks of terror. they're terrify pd of those facts. and so they just defy their constitutional obligation to hold an impeachment trial. the same is true with the two-tiered system of justice. the democrats, the biden justice department and democrat prosecutors across the country are more than happy to abuse the justice system to try to destroy their opposition. maria: wow. >> and the thread behind all of that is for the democrats, staying in power is all that matters. the rule of law and the constitution for them, sadly, is no longer a concern. maria: well, that is incredibly disappointing. we should point out that the

census just counts people, it doesn't count citizens. so it does help the democrats to have a wide open border, doesn't it? because if you've got more people in sanctuary cities, you'll get more congressional seats. so that's what we're hearing -- >> well, and, maria, we teed up a vote on that, a vote directly that said the census should not count illegal aliens in the senate. the democrats voted party line against that vote. in the house my opponent in november is a very, very liberal congressman from dallas can. he voted 100% with nancy pelosi his first four years in office. and and he voted in favor of counting illegal aliens in the cent us. -- census. he also voted against deporting illegal alien who criminally assault police officers. that that's the position of democrats. and, by the way, as the senate we had that vote, every democrat said an illegal alien who physically assaults a police officer, do not deport 'em.

every democrat voted no. they're a radicalized. maria, i tell you, in every state in the union if you gather just ordinary people together and asked in new york, california, anywhere, and said, look, if an illegal alien assaults a cop should you deport if him, normal people are going to say, of course you should. maria: of course. >> but not elected democrats. they side with the criminals and the illegal aliens against american citizens. maria: senator, what can you do as an elected official to stop this anti-semitism raging throughout the country? i mean, look what happened this week. anti-israel campus protests intensifying at columbia university. 100 students detained, many arrested at columbia university last week as the protesters sprung up at universities across the country. why are we seeing this once again? >> well, look, we're seeing a vicious anti-semitism, a vicious hatred of israel in our universities and, sadly, among the democrat party. elle tell you, maria, one of the

most troubling things about the democratic party and these two are intertwined, it's not just the squad, it's not just the extremes of the rashida tlaibs and the omars and aocs, it's the so-called mainstream of the democrat party. it was chuck schumer who stood on the senate floor and demanded that the elected leader of israel be thrown out of office. that's never happened in the history of the senate before. it was joe biden who orchestrated a resolution at the u.n. effectively condemning israel for not having an immediate ceasefire. it was nancy pelosi who signed a letter saying cut off military funds to israel. now, biden and schumer and pelosi are not the fringe of the democrat party, they are the leadership. they are, are the so-called mainstream of this party. this party has turned hard anti-israel because they're terrified of their rabid core. and on campus you see really the id of the democrat party expressed. and you want to know why this is happening? this, tragically, is cultural

maria: welcome back. breaking news this morning after the house passed a $95 a billion foreign aid package yesterday which includes $60 billion in new aid to ukraine on top of the $10 billion that the u.s. has -- $100 already sent in the last two years. russia's brutal invasion of ukraine enters the 788th day. more than two years in, polish president andrzej duda is calling on nato allies to increase their defense spending to 3% of their gdp to stop that russian imperialism. i spoke with president duda on thursday in his only u.s. interview about russia's aggression in eastern europe and his meeting with former president trump at trump tower this week. >> translator: this is cruel russian imperialism which, unfortunately, we know from our history, we know it well even in central europe. first of all, you have to show that nato is a aa live -- alive and that nato approaches

security and defense in a serious way. and that means military strengthening, the necessary military strengthening of nato member states. it also means military purchases, this is necessary in nato member states. so there is no other way. military, defense spending has to be increased. right now nato has got a set level of 2%. that was agreed back in 2014. this is a minimum. in fact, i believe that the efforts should be made to increase that level to 3%. as it was, it will have bad reflections of that, bad memories. but today, unfortunately, we're seeing a return the that time in our history just as it was in the times of the cold war. this is the way to keep peace in the world to stop russian imperialism, and this is exactly what what we should do right now. maria: what do you think putin is thinking? if do you expect him to try to go into poland, into other nato countries?

>> translator: you cannot exclude that. if the world, if a free world -- i want to stress that -- nato member states, the united states, if they allow are putin to win in ukraine, if they allow russia to win this war in ukraine, then there is a very high probability that he will make another aggressive step because this is the insatiable russian imperialism. we know it is indispensable to make sure that ukrainians are defend themself, and this is my effort also to the u.s. politicians, make this decision. donate equipment. because this is enough for ukrainians to defend their homeland. maria: how does this new, direct attack from iran on israel change the backdrop for you? many analysts say that the aim is to divert attention from the war in ukraine. it should focus the attention of the world on this conflict flaring up in the middle east. i always stress one thing, israel was attacked. ordinary civilian citizens of israel were attacked, and israel has the right to defend itself. maria: this migration and asylum pact by the e.u. recently adopted, it is includeing of this idea that illegal migrants should stay in europe while their asylum cases take place. is this enforceable legally? how do you feel about the? first of all, today we are seeing illegal migration which is caused by -- [inaudible] attack which started back in 2021. we have been experiencing the third year of this hybrid attack. we can see the regime inviting

citizens from countries of the middle east, far east and africa, and they are literally, we've got evidence, video recordings, they are literally pushed to the border in order to cross that border illegally. and we are defending that border very decisively not only because it's our polish border, but also because this is the border of the european union. we treat our commitment in a serious way, but we are also a defending poland against an influx of illegal migration especially in a situation that is orchestrated. because without a doubt, it's orchestrated by the belarusian regime, and without a doubt it is inspired by moscow. maria: you also met with president trump while you were in new york this week. tell us what you discussed. you were with him for, what, more than two hours? [speaking in native tongue] >> translator: myself and president trump are friends for

four years when he served as president of the united states. we collaborated with one another with excellent results. for polish-american cooperation which during the tenure of donald trump, this cooperation was elevated at a much higher level. and back then we also entered into very important contracts, economic and military ones, important for poland and the u.s. thanks to that, to poland will soon get f-35s. today our pilots are being trained here in the united states, and those fighter e jets will be given, these will be the polish f-35s that that will be given to poland. we're really delighted with it because that -- [inaudible] secondly, we talked and we entered into contracts to construct the first nuclear power plant in poland based on westinghouse technology, it is the u.s. technology. more than 4 percent of gdp, we

spend more than 4% of our gdp on defense. huge part of that accounts for purchases in the united states the starting from missile defense system which right now is being delivered to poland from the united statesment -- united states. of next batteries for the delivery system are being delivered true the already mentioned f-35 five generation fighter yet es. maria: what is your reaction to something that president trump has been talking about in terms of aid to ukraine being a loan? well, of course, to a large extent -- >> translator: well, this is an issue of domestic policy being implemented by the united states. to me, what is most important is that that ukraine gets support. i believe that thanks to this support, also thanks to the support precisely of the united states as the most powerful power on the free world, ukraine will be able to defend if itself. if ukraine is able to defend itself and we participate

together in the reconstruction of yeah, ukraine has -- of ukraine, ukraine has got a lot of natural a resources. it has got a huge development potential, and i think that ukraine will have a lot to thank for any kind of help but also repay any kind of loan. this support is indispensable for ukraine. that is why i urge them to support as soon as possible, because russian aggression has to be stopped. thanks to support with equipment, thanks to support with guns, ukrainians, i firmly believe, are able to stop russia, russian aggression themselves with our support so that it does not spill out, spill over. maria: mr. president, it has been more than two years. do you think ukraine can win this? >> translator: that is not a question of ukraine winning this war, it is a question that russia does not win it. the point is that putin does not win this war.

ukraine will win the war, we can say it this way, although for majority it will not be a victory only if it is able to defend itself. then we will be able to say, yes, ukraine will be able to defend it. maria: it would be a major game-changer if the u.s. tapped into lng resources here, would it not? >> translator: in terms of gas, yes. indeed. since the presidency of president donald trump, we have been buying gas from the united states. back then we signed first contracts for lng gas deliveries. by the way, i visited saw bean pass to see the terminal, to see the places from where the gas is sent to poland, and right now we are receiving that gas, and this has been going on for a couple of years now. i'd like to say that the i am delighted that the recommendations between poland and the u.s. have been getting

democratic colleagues established, it's not a high crime or misdemeanor? is that what we did? >> that is precisely what the precedent established today. maria: and that was republican senators mike lee and john kennedy on the senate floor last week with as majority leader chuck schumer and the democrats refused to hold a trial for homeland security secretary alejandro mayorkas over his handling of the southern border with drug and human trafficking spiking in america as a result of that that open border. the dismissal of two impeachment articles against mayorkas comes as more than 10 million people have crossed illegally. ted cruz just told us it's actually 11 million people illegally in the united states under the biden administration. that does not include the roughly 2 million so-called gotaways that we know of, that that we've seen evading apprehension and disappearing into the country. joining me now with reaction to this "sunday morning futures" exclusive is senator mike lee temperature of senator, thanks very much for being here.

why can't you move the needle on securing the border and holding people accountable? >> look, we've had a seismic shift in terms of who's coming into in this country and the number of people coming in. the reason that we can't get ahad of it is we have -- ahold of it is we have the executive branch of government with sole responsibility to enforce the laws we pass as a congress refuses to enforce the law and, instead, this administration is doing exactly the opposite. they say, yes, they're supposed to say, to. where they're supposed to close the door, they open the door. they're doing the exact opposite of what's required every single time. look, alejandro mayorkas is not a restaurante rush -- restauranteur. his job is to serve as the gatekeeper. he's not keeping the gate. maria: so what happens now? will you not be able to secure board -- the border until we have a change in the white house? >> tragically, it appears that

we've lost the tools that we might if otherwise have had. and we've given them up more or less this week. first of all, when the nat democrats chose to nuke the senate's impeachment power for the first time in history where we've had jurisdiction over articles of impeachment, duly passed by the house of representatives, we didn't undertake a trial the. we didn't cull my fate in a a finding of guilty -- culminate in a finding of guilty or not guilty. first time in american history where that has happened where we had full jurisdiction as we did here. maria: right. >> and, by the way, in the process of doing that, they also she set a new precedent that,s apparently, lying to congress knowingly, intentionally, isn't impeachable. that's really odd. secondly, we relinquished what bargaining power we had left insofar as the senate passes on tuesday what the house passed last night. we will have relinquished what little bargaining power we had left. maria: yeah. >> we started saying months ago

ukraine doesn't get another dime especially until such time as the border's secure -- maria: right. >> until congress has a passed legislation to force joe biden's hand. and that didn't happen. and the republican-led house of representatives completely walked away from that yesterday. maria: so i guess you have to believe that if the democrats are running the senate, then it passes. how will you vote when this ukraine bill and the foreign aid bill, $95 billion, comes to the math this week? >> well, look, we -- comes to the senate this week? >> look, we expect to have a handful of votes perhaps on amendments that could make it better, but it's very difficult for me to imagine if any scenario in which any of those amendments will pass. and under no suckers could i -- circumstances would i vote for the bill as passed by the house of representatives yesterday. understand, they passed four different can bills yesterday, but they used this weird procedure whereby all four of those bills merge into one bill

as they reach the senate, and and they have to be processed as one bill in the senate. look, this is a really good deal for ukraine and zelenskyy. the it's a really good deal for hamas which stands to receive up to $9 billion of in this $95 billion aid package. it is not good for hard working americans who are finding more and more of their taxpayer dollars going to people other than americans. going to secure borders other than the u.s. border. mur more unbelievable. wow. i want to switch gears and ask you about fisa. 9 you've been talking about this a lot. i've seen your posts since -- and and your commentary on the floor. but the senate passed the fisa surveillance tool renewal. what, minutes after the midnight deadline are. so right there you got it in. you're very critical of this because there wasn't even an amendment for a warrant reared to -- required to spy on

ordinary citizens. what happens when you're sr. vailing foreign terrorists? how do ordinary americans get swept up in that and get surveilledsome. >> from time to time, american citizens, some of them perhaps more than others, but nobody really knows how often it might happen, if you're talking to someone who turns out to be an agent of a foreign power, somebody on foreign soil lo -- who's being surveilled under fisa's 702, your end of the conversation will also be scooped up. we call that incidental collection. it'll be then stored on an finishes sa database. -- nsa data base. and what i've been arguing for years is in order for them to do a query of your name knowing that you're a u.s. citizen before they type in maria bartiromo, show me everything that we've gotten on her on the data a base, that really ought to require a warrant. you see, because they've collected that without a warrant in order to access it knowing that you're a u.s. citizen. they should have to get a

warrant for that. it's not too much to ask. and yet the united states senate passed this just a couple days ago without any warrant requirement. that's are very unfortunate. maria: well, wait a minute. because critics of your upset on this say that there were 56 reforms and restrictions on the fbi to fisa warrants in the bill that would stop future crossfire hurricane and put criminal penalties in place. they say that this is critical to stopping terrorists that are likely in the country now, and they say almost 100% of what we knew if about the cartels, the drug cartels and fentanyl producers working with china is because of fisa's 702 and this program. >> yeah. look, these are fake leaves -- fig leaves as far as reforms go. they put some reforms in place. do you know who they put in charge of them? fbi leadership. so if you're comfortable with how fbi top brass will be policing themselves especially when it comes to fisa where
