maria: good thursday morning, everybody. thanks very much for joining us this morning. i'm maria bartiromo. is thursday, march 14, top stories right now, 6:00 a.m. on the east coast. today, tiktok on the chopping block after the house overwhelminglies passes a bill forcing tiktok to divest from chinese parent company bytedance or face a ban in the united states. american companies are now vying for the app as the bill bill mos onto the senate. markets are trading this way, all to the plus side, just a few days ahead of fed meeting. this morning we look ahead to the february producer price index and retail sales out this morning, the fed meeting coming up this week on theth and 20 20th. more earnings out before the bell, dick's sporting goods and dollar general reporting. bitcoin above $73,000 but it is below all-time highs this morning, the euphoria around bitcoin continues. we're talking about it.

of the hour. the house passed the bill yesterday that could pave the way for tiktok to be banned in the united states and on the app stores. the bill now headed to the senate. fox business' kelly o'grady now with more. kelly, good morning. >> good morning, maria. congress is inching closer to a ban or a forced self tiktok. the house passed the vote with bipartisan support. next up, the bell be is going to head to the senate. it could face a rocky future. senators on both sides of the aisle have shown support. there are central tensions including the legislation's impact on free speech as well as this could affect americans and businesses on the app. a video posted yesterday, the ceo warned of the bill's implications. >> the legislation if signed into a law will lead to a ban of tiktok in the united states. the bill sponsors admit that's the goal.

it gives more 0:power to a handful of other social media companies. >> this is echoed by critics of the bill and former president trump that the ban would filter issues to other social media platforms. they are looking at you how it impacts the flow of illegal drugs into the u.s. and how it impacts mental health. >> they'll watch certain videos and certain things and it will turn dark. they can't get out of it. the app keeps showing them things that may pertain to self-harm or to you suicide. >> tiktok isn't alone. instagram, facebook and snap facing lawsuits regarding harm to young users. that was a point underscored during the debate yesterday, that the safety is not just a concern with tiktok. it ties into a larger question, should the bill pass the senate, tiktok needs to find a buyer.

who is equipped to buy it from a financial and strategic perspective and do we want that company gaining more of tiktok's might in the u.s. maria: mark, your reaction? >> look, this bill obviously there's overwhelming support in the house. seems like the senate's on board. but there's certainly some pushback. there are broader implications with this bill than just banning tiktok. and i think that's something that some of the first amendment advocates raised the issue, whether it's congressman massey, elon musk, they've pushed back saying look, this specific bill would actually give the president of the united states the ability to ban websites, not just apps. so look, i mean, there's obviously a national security risk with tiktok. i just don't know that this bill is going -- it may give the government more power than we probably should. maria: during the trump administration there were efforts to get an american company to a to acquire i i thot

they were very close in terms of oracle. oracle wanted the company. it fell flat. something stopped there. joe, your reaction. >> this is par for the course in america. where you find bipartisan support for the actual substance of the idea and then the lawmakers get involved and what they produce doesn't actually comport with what the american people want or need. you look at something like tiktok, it is agreed that china has basically declared war on the u.s. homeland, on multiple fronts. they have a pharmaceutical warfare on main street with the fentanyl that is coming across our border. there's no fentanyl made in mexico. it's all made in china. but then you're looking at the fact that now they have actual psychological warfare on our children. whether will we do to prevent them from wreaking havoc on society and our children? a ban on tiktok is required.

if they can't make sure we don't undermine the essence of america, the chinese communist party wins once again. maria: this is another instance where national security issues are running right into some of our values in ems terms of frem of speech. >> i think we keep forgetting, joeys right, that the chinese if you recall correctly when they sent us those cranes, they had spy equipment in them. the enemy is at the gate. it's about freedom, it's about the president getting too much power but at thend of the day these guys have been very clear about having fentanyl destroy our children and it's problematic. maria: it's problematic. you say at the gate. the p enemy is inside the gate. >> that's right. maria: talk to mike pompeo, former secretary of state, he will say they're inside the gate. they've been able to infiltrate every area of our economy and communities across the country. it's quite alarming. so we'll see how this goes in the t senate but p i think the

data on the way. the ppi out at 8:30 a.m. eastern, economists are expecting month over month prices to be up three tenths of a percent. retail sales also out this morning. in two hours. economists expecting a gain of eight tenths of a percent month to month and five tenth hads of a percent when you strip out autos for the period. p joining us now head of investments, jeff clinglehoffer. would you buy stocks here after this huge runup? >> it depends on what kind of stocks. i would talk about caution. a lot of the data we see on the headline numbers suggests the consumer's hanging in there. when you peel back the onion, there's a lot of signs that give us concern, a pause. different numbers on the number of jobs created versus overall unemployment but if you strip it back to the average american, what they continue to feel and what we continue to observe is despite a strong employment

market, they're struggling to keep up with their consumption. so we're seeing the dip into savings, we're seeing them take on additional debt to try and stay in the game and we're seeing default on that debt and so all of this to us the is the early indicators, a pause, a reason to pull become and play for safety. maria: what does that mean for the fed. when you look at yields this morning, you get a sense that the federal reserve is perhaps thinking about lowering interest rates but do you do that in an economy that's actually as questionable as you just laid out. the yield on the 10 year at 4.19%, the fed is going to kick off that two day policy meeting next week. treasury secretary janet yellen talked to fox business yesterday, she says it's unlikely that rates will return to pre-covid pandemic levels but says most forecasters do expect inflation to cool down. watch this. >> i don't think we're going to see stagflation. most forecaster believe we're on a path where inflation will come down over time.

the single biggest contributor to inflation is housing costs, rental prices for new apartments have actually declined overall, flat to slightly down. it takes a while for that to filter into the cpi. >> you did say that inflation was tran transitory, do you regt saying that now. >> i regret saying it was transitory. it has come down. transitory means a few weeks or months to most people. maria: so jeff, i've been reporting that steve schwarzman, the chairman of blackstone group, who is the largest owner of commercial real estate in the world told me rent is down, it just hasn't filtered in there. yesterday we got the cpi, rent looked like it was up but it looks like that part of the cpi has come down and will filter through so inflation will get better. but what is your take on what the fed does next week given the inflation levels today? >> i think at the high level the

fed isn't likely to raise rates. they're not likely to cut rates. what we'll be watching closely is what do they signal to the market via their dot plot. what the fed has been signaling to the market is their expectation that they're going to cut three times this year. i think given the inflation data we've continued to see, i push back on that. i think the fed is on hold for much longer than even they anticipate. the reality is, it's not just what the headline inflation number does. it goes back to the average consumer. the average person used go in and spend $100 at the grocery store, now they spend 150 or 175. they're struggling to not allocate that additional 50 or $75 to something else. they're taking on debt. i think really if i'm the fed, trying to land the plane is going to be very, very difficult and they've told us they're going to err on the side of caution to get inflation back under control but the data take coming in now suggests if anything it's actually looking up and the job is much harder. maria: mark. >> not only are consumers starting to dip into credit cards and savings and stuff like

that but they're also working multiple jobs, multiple job holders are at an all time high. the stock market, in an election year there's typically a drawdown of around 16%. right? they tend to be more volatile than nonelection years. we haven't seen that. i read a statistic that we have not seen a 2% dra drawdown or a period with not more hand 2% drawdown as long as since 2018. the market's been very complacent. are you exacting a pullback at some point this year. >> i think we have to strip out some of the magnificent seven. nvidia goes up and down by 5% a day. it's a very different structure. getting to your point, market complacency does run high. overall, earnings on the s&p 493, ex those magnificent seven, are coming down. what we're really going to watch is profit margins. because thus far, the strength in 2023, the strength in 2024 has been the ability of

companies to pass through higher prices and consumers actually continue to pay. struggling to pay but continue to pay. so as we look forward, as that consumer really does reen trench and the reality of challenges, i think profit margins will compress and, yes, i think markets will have to adjust to that future reality. maria: you agree with that? >> i do. the consumer is spending. the capacity to borrow is over. what happens, we don't see the fed rate cut we thick is coming. they said three are coming. they also said six are coming. what happens here? they are tapped out. they can't spend anymore. what do we do? >> i think that consumer is the alchemy of low interest rates is over. that's what i'm saying. it's difficult for them to continue to take on the debt and they'll have to actually pull back spending and that's what the fed is waiting for. >> what does our market do? how does our market respond? is that a huge downward pressure? what happens then? >> i think when we see that, sentiment is running high. markets don't trade on data.

they trade on how we feel, trade on sentiment. sentiment running high when we see the consumer reen trench, i would be worried especially about certain segments of the market. fixed income continues to look interesting today. maria: you've got options. great to talk with you. thank you. we appreciate it. quick break and then president biden is touting his economic choices in wisconsin yesterday as his budget asks for more than 5 and-a-half trillion dollars in new and higher taxes. i'll speak to wisconsin congressman scott fitzgerald on what the president said to his consistent sit wents in the -- constituents in the badger state. stay with us. ♪

wisconsin yesterday. joining us now is wisconsin congressman scott fitzgerald. congressman, your reaction to the president on this economy. >> yeah, i think, maria, the problem with the administration has right now is every time they march president biden out to the podium and i listen to the entire speech that he delivered in milwaukee yesterday, it doesn't match up with what people are seeing on the street. right? premium is about 4 bucks a gallon right now in wisconsin. if you go to the local grocery store, everything is doubled or tripled in some instances around some of the -- certainly produce, dairy, eggs, everything is not what the president is saying, just doesn't line up with what the reality is in wisconsin right now. maria: yeah. a lot of people are questioning what this means for these tax increases that the president is planning. i mean, if you're going to insert 5 and-a-half trillion

dollars in new taxes on an economy that is already questionable, what does that do to the macro story? and obviously he's not going to be able to raise taxes this year. you and your colleagues will stop it. he's giving us an indication of the next four years, right, should he win re-election. >> if you looked at the budget that he just rolled out, you would add in excess of $50 trillion for a total that we're all very concerned about right now and he just continues to spend which is going to add to the inflationary issues. maria: white house press secretary karine jean-pierre shutting down reporters from former special counsel robert had hur's testimony, the whole conversation she wants shut down on biden's handling of classified documents yesterday. watch this. >> it's a case closed. you heard from my colleague yesterday. ian sames. sam s, the spokespersonfor th. i don't have anything else to add.

the case is closed. maria: you questioned robert hur on the president's memory. watch this. >> do you find that the president was senile? >> i did not. that conclusion does not appear in my report, congressman. you. >> you felt that the president's memory or lack therthereof was a critical reaso decline prosecution. >> my report to the extent it addresses the president's memory gaps that we identified and the evidence we obtained during our investigation, they're addressed in the contexts of determining how the jury would perceive, receive and consider evidence relating to whether or not the president had willful intent when it came to retaining or disclosing national defense information. maria: i didn't understand that answer, congressman. tell us more about what you got from this testimony because we're talking about the president's mental capacity when he doing the documents, right? and that was when he was sense senator. if a jury today says this is a guy with a bad memory, an

elderly man with a bad memory, so what? he didn't have a bad memory and wasn't elderly when he took the documents, right, out of the secret room. >> yeah. i mean, one of the things that judiciary committee was trying to do was establish what was the president's mental state, which is why i asked that question and other members asked similar questions to that. maria, if it was me or anybody else that works in government and we had classified documents in six different locations in multiple states, okay, and it was discovered or disclosed, we would be in deep, deep trouble right now. and what that testimony certainly i think with the special counsel, what he relayed to the committee was that his mental state was so fragile that if they had put him or asked him to appear in front of a jury,

that there is no way that he would have been able to recall what he needed to. >, to somehowdismiss that. from a legal perspective, it just doesn't make any sense. and then on top of that, the second thing i thought that chairman jordan did a really good job of kind of underscoring, is the idea that there was a motive. we all know what it was. it was book. so he kept referring to his memoirs or his notes when he talked to the ghost writer. again, another thing that would have absolutely put anyone else that works in government in hot water. maria: where does your impeachment inquiry stand at this point against president biden. look, hunter biden has declined the invitation to testify at the house oversight committee next week regarding the biden family influence peddling that the house oversight and judiciary committees have been telling us. chairman james comer said the exit at this has called hunter

biden's bluff and hunter biden for months was stating he wanted a public hearing but now he's refusing to come. john sullivan is reporting that hunter biden and his partners aided the chinese to bid, to corner nuclear energy in the united states according to memos. john solomon is reporting this this morning which seems like a big story, that his father was still vice president and hunter biden and his partners tried unsuccessfully to help a chinese energy company acquire one of the u.s.'s premier nuclear technology companies. in a see con secret attempt to l the global market. are you looking at this? and where does the impeachment stand now given that hunter biden said he's not coming next week. >> let me tell you why he's not coming, my take as least, because the closed door deposition of hunter biden answering questions, it didn't go well. it didn't go well as all. maria: for who? >> a lot of the things that he

told the attorneys in the room that day are completely conflicting with evidence that oversight and judiciary already has in their hands. so i'm sure that they went back after that deposition and said we don't know if we want to do this public testimony, much different type of environment. members of congress can be a little more animated and kind of go right for the jugular in that environment and based on the lies that were told under that deposition with him being sworn in the way he was, i think they have great concern about putting him out there right. maria: i see. real quick, joe pinion. >> congressman, you look at a state like your home state, wisconsin, we had about 70,000 votes was the margin of victory for president trump in 2016, pennsylvania, wisconsin and michigan. as you look at these issues, the issues affecting main street

america, people concerned about hunter biden and joe biden's complicity but also people looking at the average economy not yorking for everyday americans, how do you feel that plays out in your home state as we start turning our eyes towards the general election? >> well, we just y saw senator n johnson get reelected in a statewide election. there is a path, absolutely. it was less than 78,000. it was mere 24,000 votes and what i would say to that is things changed during covid. there were absolute accommodations that were made in some of the counties by specific clerks when it came to absentee ballots. that seems to be -- it's going to be a little bit tighter this time but i do believe there absolutely is a path for president trump to win re-election in wisconsin. maria: we'll leave it there. congressman, it's good to see you this morning. thanks very much. >> thanks, maria. maria: scott fitzgerald joining

maria: welcome back. president trump expected in a florida courtroom today where he will attempt to have the classified documents case thrown out. cheryl casone with details now. >> that's right, maria. trump's attorneys say he was entitled to the documents under the presidential records act but prosecutors disagree, they argue his claims rest on three fundamental a errors, all of which reflect his view you that as a former president the nation's laws and principles of accountability that govern citizens don't afl apply to him. ju?georgia, a judge quashed some evidence. they said it's a correct application of the law as the

incident for united airlines after a san francisco bound boeing suffered a mid-air fuel leak and had to return to sydney's airport. there was an emergency landing last night at la x after reporting a possible mechanical issue. there is reports it was a blown tire. american is not confirming that. the boeing max 9 that blew out an a air plug last january was scheduled for a safety check right after that flight. okay. there's this. elon musk is defending his decision to cut don lemon's x show from the platform, ending his deal with the former cnn anchor. in a post, musk writes this. his a approach was basically just cnn, but on social media which doesn't work as evidenced by the fact that cnn is dying and instead of it being the real don lemon it was really just jeff zucker talking through don. cheryl, thank you. the chinese communist party attacking the bill that forces bytedance to sell its share of tiktok or face a ban in the u.s. they say the ban will become fire in the u.s., out with a statement this morning, how the u.s. handles the tiktok incident enables the world to see clearly whether u.s.'s so called rules based order serves the world or serves itself, according to the ccp spokesperson. joining us now, the author of the decisive decade, jonathan dt ward with us. what do you make of china's response to this tiktok ban bill? >> they're rolling out all their sort of biggest spokespeople, that sort of thing and this comes directly from the foreign medicine city. they say this kind of bullying behavior cannot win in fair competition which is completely absurd. i you mean, you're talking about a country that has denied real access to any of our technology companies, any of our social media companies and all of that is widely non but this is not

about winning an intellectual argument with the communist party, this is about stopping an adversary operation in the united states and i think we need to go back to what tiktok actually did last week and remind ourselves of what happened. they basically turned the app that's been used by 170 million americans into a tool of direct political action. what users found when they had logged in was something that said speak up now before your government strips 170 million americans of their constitutional right to free expression and then had a call button where people could call their senator. so clearly, they think they're untouchable. this is bytedance which is basically deeply tied to the chinese surveillance state and they're acting i think with impunity here so it was a huge win for america yesterday to pass this bill if the house. i mean, finally, yay, we're winning a battle here in this obscene sort of situation we found ourselves in where china is i think gaining on every front and all we do is talk.

we're finally winning something. so pushing this forward, and then i think the other side of it is the communist party, and i don't think this is that well-known, one of their key bureau members who we should pay more attention to wrote a book early on in his life called america against america and he had traveled widely here, saw what he thought as the contradictionses, the potential for divisions. the russians think that way about us too. there's a an idea in communist party strategic thinking about using a country to fight a country. so this is what they want. they want us to be fighting each other and they're accomplishing that so i would also -- the people that executed this, lobbyists, marketing firms, advertising agencies, i give them 30 days to cease all activity on behalf of tiktok or regard them as part of bytedance. we have to clean this out. maria: this is all a strategy to undermine the united states. you know, pushing propaganda out there to create disruption and

fighting amongst ourselfs is happening and and has been hapg for some time with propaganda on tiktok and the ccp. there's a prediction that xi jinping will ultimately tell bytedance to divest from tiktok. he said xi is dealing with an economy that is failing. do you think ultimately a u.s. company buys it? >> we have to do something. the bill is very clear, it's the right thing to do. there are people earn their livelihoods on this. getgetting bytedance out of the equation is what we have to do immediately. there should be buyers here. the trump administration lined up something similar with oracle and one of the other big tech companies was considering it, i think it was microsoft. and keep in mind, this is all

coming as beijing is trying to excise our remaining tech companies from its own infrastructure, a big report in the journal about that on document 79 to get rid of dell and microsoft and a oracle and the rest of them. so we have to get this done. i do think there will be a buyer. kevin o'leary who you've had on your show has offered to buy this thing. i'm sure there will be plenty of creative ideas. getting bytedance out of the equation and hitting them with entities list, foreign direct product rule and everything you can and want to do -- maria: i'm so over these lists, jonathan. there's so many lists of chinese companies that have been sanctioned. they're still trading on u.s. exchanges, that means that u.s. investors are funding the expansion of their number one adversary, the chinese communist party. we need to see more than just slapping lists on these companies. congresswoman nancy mace voted no on the tiktok bill, she said the proposal is part of an alarming trend toward government

maria: welcome back. bitcoin has been be on fire, take a look at it this morning as it hit another all-time high this week. this morning bitcoin is pulling back but still sitting above $73,000. joining me is the co-founder of dna, brock pierce. brock, great to see you. thank you so much for being here. what's your take on the euphoria around bitcoin, do you think it keeps going? >> well, it's definitely that time. we go through cycles with bitcoin and we have gone through to bullish as we reach all-time highs and what's driving that is the bitcoin happening or halving is coming up april 19 which is when new bitcoin that are minted is reduced by 50%. usually as we approach this we find ourselves reaching all-time highs either before or after that. this one has been cat liesed and ac-- catalyzed and accelerated

by etfs. funds that weren't able to buy bitcoin now can. the fact that everyone with a typical retail account can easily go out and buy bitcoin without having to encounter these security concerns that everyone's hard of. it's a great time to be a bitcoin holder. even peter schiff who has been the most antagonistic towards bitcoin, said he wished he bought bitcoin. maria: analysts are predicting the spot bitcoin etfs could see $220 billion of inflows over the next three years. i guess people are look at the situation and saying have i missed it, i want to get in now. is that the right move, though, now? >> if you haven't bought any, just for your own education you should go out and make a very small purchase and spend time reading about i i only encourage people to invest in themselves so they can make informed

think we're looking at $150,000 bitcoin. i don't think we'll see prices beyond that. maria: it will go up and down but long-term you're bullish. chris, jump in here. >> i'm worried it's the wild west. i'm concerned a little bit. i understand after gold went on etfs, they went on a seven year run. nigeria is sending banned crypto for destroying their currency. there's concern that bitcoin will take the place of central currency. the bitcoin guys are okay with it. i'm really concerned about significant volatility. what do you think? >> well, so the wild west became california. so it's good to be paying attention to these things. you can't say that bitcoin caused the harm in knee year ni. the nigerian government caused the harm to nigeria. bitcoin was the escape route. donald trump weighed in as well, saying in his term as president

he was not sure about bitcoin, not a fan. he said if he were president of the united states, he wouldn't touch it. maria: wouldn't up the it. mark. >> i'm less worried about bitcoin. go ahead, brock. >> trump wouldn't take an action against bitcoin. he believes it is here to stay and it has a place. maria: thanks for the clarify case. >> i would be more concerned about a central bank digital currency than investing in bitcoin right now. with the central bank digital currency they could certainly if we don't do what the government wants us to do, they can shut off access to our capital so that's certainly a major benefit when it comes to crypto overall. look, i mean, at 73,000, it looks like there's just so many reasons that crypto can continue to go higher. supply and demand obviously, supply, new supply is going to be cut in half going forward, there's a lot of liquidity, seems to be front running the fed's rate cuts. there's so many things that can take crypto higher. what could we possibly be

missing that could actually cause a substantial pullback? >> well, like we've seen with sam bankman-fried and the debacle, usually there's a cass catalyst that sends things in a positive direction but usually there's something that slows bitcoin's roll. if there's something that spooks the markets, a u.s. government action but that's been derisked with the s.e.c. allowing the etfs. maria: this is the first time we're speaking with you and dna. what's dna? >> i started a lot of things. when we talk about central bank digital currency is was one of the co-founders of tether, doing $50,000 a year. we can go deep into that. dna is distributed networks advisors, it was a leading advisory firm in the bullish run and in this super cycle, dna is back. maria: all right, brock. great.
