for mishandling of classified document. a poll finds 86% of americans believe biden is too old to serve another term as president, including 60% who say they think both he and former president trump are too old. both republicans and democrats say the report could damage biden's 2024 re-election bid. former first lady hillary clinton is weighing in, saying that age is a legitimate issue for both biden and trump. former bill clinton advisor joking about the special counsel's findings as well. .liz peek, your r reaction. >> maria, this story is now national. i think that's what happened courtesy of the special counsel report, what was a store hely only amongst republicans who watch fox news and saw the terrible stumbles and miscues from president biden over and over again now the entire country is looking at the same information. everyone is aware that this is a

serious, serious problem. and i think the reaction of democrats over the weekend was extremely interesting. number one, new york times, two op-ed writers in the new york times calling basically for biden to get out. and this is going to be a drum beat that i think we're going to hear over and over. we're going to talk about the convention and how biden should get you out at the convention. this is really something that is new on the political horizon. no one has faced a contentious convention in a long time. i think we could see that and more democrats are actually now hoping for that. maria: the democrats now have to make a decision. kamala harris is there but, you know, the democrats did not use the criteria to put in a vp candidate that most would use and that is make sure that person is ready to become president. they were using a different cry criteria, liz. >> look, president biden

promised he would select a woman of color. that's what he said going into that whole nomination conversation. it was a huge miss take. cam -- mistake. kamala harris has been a disaster from day one and he is stuck with her, as are the democrats. maria: every decision this administration or this president makes is more underlining of the fact that in fact the questions about his age keep coming up, cheryl. the president is now facing backlash for choosing to skip out on the traditional super bowl interview for a second year in a row as his staff is being accused of hiding him in the basement. they're hiding him from the press. they're using first lady jill biden to ward off unwanted questions. jets' owner woody johnson joined me yesterday on sunday morning futures. here was his reaction. watch. how big do you think the audience is and why is president biden blowing off the traditional interview that the president always does on super bowl sunday?

>> the first question, everybody in america is going to be watching tonight so it's going to be well over 100 million, probably 120 million people watching. why president biden is blowing off this interview he blows my mind. i can't believe a politician would bypass an opportunity to do this, have the eye balls on him and listen to what he wants to do with the driven. maria: your reaction. >> we talked about this, the fact that you ignored a soft ball, what would have been a soft ball interview from likely nora o'donnell who was on the ground for cbs news in las vegas is a shock and in particular the bigger problem here is that this -- to woody johnson's point about why would you blow-off millions of eye balls like this, this super bowl is going to go down as a record breaker, ratings and you had the taylor swift issue and you had a great game and the advertisements, there were so many factors her. it was a huge missed

maria: welcome back. house oversight committee chairman james comer is demanding unfettered acassess to the classified documents that president biden was holding onto determine if the documents were used to help the biden family's influence peddling scheme. robert herr's report shows he held the documents willingly. hunhunter biden had a joint business venture with cefc. here's chairman comer with me yesterday on sunday morning futures.

watch. your reaction to the special counsel's report? >> what i'm concerned about is the fact that hidden within that document is evidence that some of the classified documents he mishandled were from ukraine and china. we've been leading a major influence peddling investigation of the president where we've proven that at the very least his son and brother had been influence peddling with those two countries. we want to know exactly what those documents were and we want to know if herr actually interviewed jim biden and hunter biden because, look, this family as you know very wells has been involved in influence peddling for decades. this is shady. this is counter to everything we stand for in america and it's a threat to our national security. maria: joining me right now is missouri congressman and house armed services committee member, mark alford. congressman, thank you very much for being here this morning. has your committee heard back from the biden family on whether

or not james comer and company will get their hands on those documents? >> no, but i certainly hope they do, it would go a long way to bring more evidence of the biden crime family and their take from foreign adversarial nations. i think this is the most compromised president. i have thought that for some time, since last year when the evidence started coming out and now more evidence of this feeble mindness, for getfulness, my mom turned 85 years old yesterday. we're dealing with the same issues. but she doesn't have her finger on the nuclear codes. this is a scary situation for america to be in. maria: so what should be done? what do you think? right now we've got the special counsel saying that he willfully held onto these documents but because he is too feeble and an elderly man with memory issues they're not going to press charges on any of this because he's too feeble to prosecute. now we've got 86% of americans

saying he's too old to run for a second term. what do you think should be done? >> well, i don't know if congress short of impeachment for other reasons can really get him out of office and then what happens, you get rid of tweedledee, you get tweedledum m in kamala harris. it's not good politically. it's not a good thing for the nation. the decline is getting more rapid. if you look at the videotape from six months ago, the evidence is there of this man's mental decline and i think it's a shame that his wife, dr. jill biden, can continues and his staff to push him out in front and basically show the cards of his hand of what they're dealing with in that family. maria: let's talk about the business at hand, the senate has voted in a rare sunday session to push forward with the $95 billion foreign aid package,

18 republicans back this legislation which includes more than $60 billion to go to ukraine, 14 billion for israel and over $9 billion in humanitarian assistance for gaza. congressman, your thoughts on this bill and why it is so hard for this administration and the republican as well to just secure the border. >> maria, you're exactly right. that is the number one priority right now. secure the border. as you know, we sent -- maria: it's not the though, congressman. it's obviously not. it's obviously not the priority. it's obviously not the priority. you say it's the priority but it's not. they're pushing forward a bill to send money to ukraine. that's the pr priority. >> that's the house's priority. the senate has a different priority because they're led by chuck schumer. they want to get this ukraine package up because they're getting marching orders from biden. the only way they're going to get this ukraine funding package

together and done out of the senate and over to the house is if they package it with aid to israel and that's not going to happen. these need to be two separate things. we passed an aid bill to israel early on, about the -- $14.3 billion, we had the pay for there y attached, clang back some of the -- clawing a back sock of the money for the irs agents. they will send us a flawed package. i believe it will be a no go in the house. maria: it's incredible to me, liz peek. you've got illegal migrants shooting guns at people in times square. you've got illegal migrants trying to beat up the nypd officers. they're throwing kids, american students out of their schools so that they can have a place for them to stay. this migrant situation is causing havoc and chaos across america and this congress cannot for some reason secure this

border. >> yeah, maria. but more importantly, the president is not securing the border. maria: that's right. >> i think that is the argument that continues to be made is that he doesn't need congress. he doesn't need extra super powers to close this border. we know president trump was able to do it, to get the flow down to basically nothing. that has to happen again. and frankly, if he really wants this aid to go to ukraine and to israel, he's made a big noise about that, then do your job. close the border and i think republicans and democrat woulds be happy to see that and they would fall in line. i have to say on this issue of aid to these countries, the issue a little bit is oversight. i mean, again, we're placing our confidence in ukraine by giving them $60 billion when we know that billions have been diverted and gone missing in that country. we're going to give $9 billion to gaza, to hamas, effectively.

we know there won't be sufficient oversight of this, maria and it worries me that congress is maybe going to sign off on this without any restrictions. maria: well, that's why i say congress can't shut the border. i recognize it is joe biden who refuses to shut the border. look at the priority in the senate. the priority in the senate is all of this, this $95 billion package. they should have dug in and secured the border, knowing what is going on across the country and then congressman, there's this news overnight. defense secretary lloyd austin is undergoing treatment in the critical care unit at w walter read medical center. he was readmitted yesterday. powers have been temporarily transferred to deputy defense secretary kathleen hicks. this happened he spent weeks in the hospital last month. your reaction to the latest development. >> my heart goes out to secretary of defense austin. he is due before the house armed

services committee on february 29, two weeks from this thursday, to fully answer why he did not tell the president of the united states and formally cede over his power while undergoing prostate surgery. he did do it right this time. which is a great start and we wish him well. ma.maria: all right. we'll watch that. i don't know what happens now with a 170 attacks we're getting on our troops across the middle east and whether or not there is enough pushback there, congressman. that's for another day. we appreciate your time this morning. mark alford joining us right here and stay with us. we'll be right back.

maria: welcome back. take a look at futures this morning on a busy week of economic data and as well as earnings on deck. dow industrials right now negative, down about 30 points, the nasdaq continues this incredible momentum, up 14 and-a-half, s&p is up again after reaching an all time high on friday, the s&p sits at 5,045 with a fractional gain this morning. we're waiting on the january cpi index out tomorrow morning, the consumer price index could be a market mover. retail sales out on thursday, followed by the producer price inp decks and housing data on friday. joining me now is horizon investment chief investment officer, scott ladner. thank you for being here.

how important is the cpi and what are you expecting? >> hey, maria, thanks for having me again. cpi is going to be important, this is still a fed who thinks they're fighting inflation. even though the battle is mostly done, we all recognize it, they still think that they're not quite confident enough for them to begin their cutting cycle so the cpi this week and ppi later in the week will be important. but we think we know what the story is going to say, the book's been written, we're reading i'd right now. disinflation is firmly in the pipeline. maria: how are you allocating capital right now? >> we still like equities, favor the u.s., u.s. large caps, especially the tech space, we are in the japan and international ebbing which you equity space,shunning especialla

really tough place to invest in. japan has attractive characteristics with the ebbing which i at this market and the -- equity market and the u.s. with the global easing cycle is the place to be for the rest of the quarter. maria: it's really interesting to see what's gone on with rates. look at the 10 year this morning, it is staying at 4.1%. remember before jay powell was on that 60 minutes program basically suggesting a rate cut is not happening any time soon, yields were about 4% or below, we were at 3.8% before 60 minutes. luke lloyd, jump in here with the 10 year at 4.158% this morning. >> it's absolutely taken a bit of a beating, going down as we saw rates go from 5% down to 4% in really just a couple months. it tells you a lot about not just the economy but tells you a lot about what the markets think the federal reserve is actually going to do. we saw that the markets were pricing in three rate cuts above the three the federal reserve

wants to do for a total of six. that's coming down to five or four poeen tp sly because they were -- potentially because they were more hawkish than a lot of people were expecting. the markets have gotten nothing right the past year with regards to interest rates. are we going to see the four or five rate cuts go back to two or three as the federal reserve stays hawkish. >> i think you identified the dynamic exactly right. this was a market that was pretty sure what we would get six or seven cuts this year and powell definitely threw a bucket of cold water on that. we're in the camp that we're going to get four to five and possibly six if we get going but frankly right now if the we get six cuts, it's probably not a good thing. if we get six cuts this year, that's the economic weakness the fed is responding. we think three, four, possibly five cuts is the right number right now and the yields around 4% is probably the right level

for yields for right now especially with how strong nominal gdp growth is in the country, with inflation coming down. so we think overall the market is coming more towards the fed. we think the fed is going to inch towards the market, probably four or five cuts will be the right number. at thend of the day it probably doesn't matter, as long as the fed doesn't have to cut because we have a growth slo slowdown wh we don't see in the cards. maria: what about big tech? some analysts are saying the new group of a.i. stocks to watch include microsoft, nvidia and meta, calling them m & m stocks, driving the force that are driving the stock market can gains and 401-k gains for the past decade. what's your take? >> we do like catchy acronyms in the stock market, don't we, maria? the big tech names are still ones we have to se own. this is the top of the market, not like the top of the nasdaq market in the late '90s, early

2000s. the top markets are positioned the best for a.i. revolution, they make the best revenue growth, the best earnings growth and they can essentially name their number in terms of profits. these are companies that you have to own. i'm not saying you have to be overweight. they have run a really long way pretty quickly. but being underweight or being short them is not the way to be. these are the most important companies in the world today. maria: i guess the question is, do you want to buy now after the huge outsized moves or wait and see a better entry point? >> you know, i don't think it's probably wise to get really cute about entry points and exit points. if you're smart enough get ott and back in, better for you. there will be places to get broader exposure. maria: then have you to trade in and out. i don't believe you want to be a trader here. we have a pretty good week of

fourth quarter earnings on deck, we'll hear from coca-cola lyft tomorrow, kraft heinz on wednesday, deere on friday. what will you be watching this week in terms of earnings? >> we'll be watching some of the ssame things we've been watchin. we think we'll have continued strong numbers because we have a strong tail wind of nominal gdp growth in the country. we're looking for the outlooks, we want to see how do companies characterize how the consumer is continuing to behave. this is a consumer that has for a long time had a wide disconnect between how they are financially from an objective standpoint which is strong and how they feel about the economy which is weak. people do not have the animal spirits. if people start to feel better and continue to act in terms of their consumer behavior and spending patterns, that's the thing we'll continue to watch. we think this will continue because this is a really strong

nationals coming across the bore doctor and into america for a while. when we look at the pictures it looks like it's largely military aged men. what can you tell us about this? >> that's the most scary aspect about this. if these were family units it would be one thing. if it were children it would be nor thing. because the vast majority are military aged men, you have to wonder what is their purpose, are they coming here to spy? are they coming here to set up criminal organizations that are going harm to american citizens? there's a lot of what's going on right now that we don't know but it's very, very scary every time that we see it and to t understd that we don't have the resources to vet every person that crosses the border illegally because our he detention space isn't what it needs to be and we can't get them through the sis s testimonk enough. we want to find out who they are, where they're coming from, what they're coming here for and

with guns, they're shooting at police, they're shooting at tourists, they're beating up the nypd, they're pushing american students out of their schools so that they can have places to stay. no strings attached, secure the border. but unfortunately the congress can't even impeach homeland security secretary alejandro mayorkas. you know, he's dodging responsibility on the border crisis, saying that the biden administration does not bear responsibility for a broken system. and that congress is the only one who can fix this. mayorkas will face a second impeachment vote tomorrow when steve scalise comes back. we don't k know if they'll have the votes to impeach him but we know it will die in the senate as well. >> had that's so frustrating. when you see secretary mayorkas who refuses to use the tools he has and blames it on congress -- if he was using all of the tools, such as repatriating people to other countries that would accept them that we have agreements with, the if he would
