chris bedford, mark simone, good to see you. that will do it for us. thanks for joining us. steve forbes and ed rollins are passed by their colleagues in the house. lou dobbs is going to take you through it next. good evening. i'm in for lou dobbs. the trump justice department taking new aim at clinton corruption. new reports tonight that attorney general jeff sessions has ordered justice department prosecutors to investigate how the clintons managed to rake in millions from the controversial sale of uranium one. we'll take it up with chris feral congress will avoid a government shutdown. a house has approved a temporary measure to keep the government running and the u.s. sphwhait right now still voting on the bill. they're one vote short. we'll have a full report on that and the trump administration

tonight threatening to cut off funds to the united nations after the international body voted to reject president trump's recognition of jerusalem as israel's capitol. john bolton is here with more on that tonight our top story and major development in the uranium one scandal, jeff sessions reportedly ordering the department of justice to look closely into alleged clinton collusion, determine whether a special counsel should be appointed to investigation, how the clintons raked in millions of dollars. fox news chief national correspondent ed henry has our report. >> not looking good. not looking good. >> a year dominated in part by president trump being in the cross hairs of a special counsel

investigation is ending with attorney general jeff sessions ordering the justice department prosecutors press fbi agents about why did did not seek charges in the uranium one deal. >> the end game would be if they found something they certainly would be potentially capable of reopening the investigation and handling as if it were an active ongoing criminal matter. >> that could mean a second special counsel to probe the way investigations of clinton's e-mail server, as well as the uranium deal, handled by james comey, deputy andrew mccabe, and peter struck who sent the text messages supporting hillary clinton. >> i would say it's the same ba lo an any they've been peddlingr years. >> bruce orr recently demoted at the justice department.

>> he has a meeting during the election with christopher steele, the same guy that the democrats from fusion paid to do the discredited trump dossier and bruce orr's wife works for gps. and orr meets with fusion after the election. how do you explain that conduct. >> mccabe was pressed on the dossier today in a long session. after facing seven hours of questioning by the house intelligence committee on tuesday where he could not recall when he learned that the clinton campaign and the dnc paid for the dossier leading senator rand paul to tweet today, time to investigate high-ranking obama officials. this could be worse than watergate. democrats insisted this is a diversion from the real issue. >> which was the russian attempt to subvert the last election, the possible collusion -- well

the certain collusion by many members of the trump campaign. >> other democrats claim this is an attempt to fire mueller over the holidays. a charge the president and the legal team consistently denied. >> ed, thanks. congress tonight averting just moments ago a government shutdown. the house before that passed a stopgap sending bill to fund the government threub january 19th. the senate moments ago followed suit and it looks like the tally right now the 62-32. all they needed were 60. our fox news correspondent is on capitol hill. >> the american people are counting on congress. reporter: if the senate okays the short term budget just approved by the house by 11:59 tomorrow night, almost every federal program stays funded until january 19th with the exception of a handful of pentagon programs. that's even though some republicans wish the military got an easier boost.

>> anytime you're talking about deficits and extending, doing a continuing resolution, it's hard. it hurts the defense. i think the area that's bothering u us the most is the military is going to get their 33rd cr in a decade. and the military's readiness is hurting. reporter: it also puts automatic medicare cuts on the shelf until 2019 and funds the children's health program through march. both of those provisions enjoy broad bipartisan support but democrats insist they didn't have much of a say in the debate. forcing the republican to go at it alone. >> if you've got the votes, you don't have to talk to us. but if you don't have the votes, we really need to come together in a bipartisan way to be the responsible stewards of this government. reporter: a sore spot for one senator in the budget, the reauthorization of an ns actioner spying tool, section 702. >> the short term extension is okay. i will filibuster any long time

suggestion. they try to do it for a year were four years or forever, there needs to be more overnight. reporter: not in the short term budget, a daca fix. so despite the demands of democrat lawmakers, there's no new resolution for people brought to this country illegally as children. >> i don't think in his heart that the president intended to hurt these people in the very cruel way that they have being hurt by the actions that have being taken. reporter: uncharacteristically quiet today, senator chuck schumer seems content using daca as leverage on republicans next time there's a shutdown fight in january days before the state of the june on. >> we're not talking about until we see what the house does. >> congressman charlie dent says he's seen thing in his 7 terms that give him confidence that a shutdown can be avoided. >> there will be drama and

chaos, yelling and screaming and then we'll avert a shutdown. reporter: there may be trouble brewing in the senate tonight for 8 $81 billion for victims of the wildfires and hurricanes. they needed a lot of democrat support to pass in the house and conservatives are weary of the package because tu new spending is not offset by cuts elsewhere. >> thanks. the u.s. senate just approved the continuing resolution. it will keep the government open until january 19th. it now goes to the president. the vote so far is 62-32 with an historic win on tax cuts under his belt, president trump took time to celebrate the holidays with some of america's finest today. they're still on a victory lap. a signing ceremony could come tomorrow. chief white house correspondent john roberts has our report.

reporter: greg, good evening. there is every indication that this is shapings up to be a very merry christmas for president trump with the expected signing tomorrow of the biggest achievement of his presidency. the lift from a huge legislative victory under his wings, president trump left the white house today to wish merry christmas to some of the heros that keep this country safe. >> i'm heading over right now to walter reid military medical center to say hello to some of the bravest people anywhere in the world. reporter: it's a tradition for u.s. president to visit walter reid and thank the men and women for their service. president trump enjoys wide support from the military pledging to rebuild u.s. forces. but the president's promises ride on republicans and democrats in congress reaching a long term spending agreement next year. today the white house was urging congress to ge keep the governmt running for the next four weeks with a continuing resolution. >> we want a clean bill and that's what we hope happens and

we hope it happens soon. because we know everybody is ready to make sheush that the government is fully funded and functional and go home and celebrate christmas. reporter: the president is anxious to get a continuing resolution on his desk because he wants to sign tax reform tomorrow before he leaves for christmas vacation in mar-a-lago. but in order to sign the bill tomorrow he needed waivers contained in the cr to prevent cuts from entitlement programs. >> it's a lot of fun when you win. >> there's plenty for the president to celebrate. boeing, at&t, wells forego, comcast all announcing bonuses for employees or wage increases, even more charitable giving. president trump believes this is just the beginning. >> we're bringing the entrepreneur back into this country. we're getting rid of all of the knots and the ties and we're going -- you're going to see what happens. and ultimately what does it mean? it means jobs.

jobs jobs jobs jobs. reporter: and it was good news for the president on the economic front. the bureau of economic analysis revised thirds quarter gdp down a fifth of a point. but com combined with second qur groit, the u.s. economy had its best back-to-back performances in three years. but the president may face new obsession in his quest to replace obamacare. enrollment in obamacare surpassed expectations. 8.8 million people signed up for health insurance during open enrollment. that's 400,000 fewer than last year those surprisingly strong. >> they tried for month to repeal the affordable care act which would have sent the costs soaring, they failed in that effort. but they have consistently undermined aca in every way they

trump may fire robert mueller over the break. charles schumer today voicing his concerns over a constitutional crisis. the white house once again attempting to allay those fears. >> for the one thousand time, we have no intentions of firing bob mueller. we're continuing to work closely and coo cooperating with him. we think that it is just further evidence that the democrats have no plan, they have no agenda, they have nothing to talk to about other than attacking this president. while they've been focused on russia, this president has been focused on america. gregg: joining me now, christophechrisferrell. >> i was looking at the latest polling data. amajority of americans think the mueller investigation is tainted tainted. he himself has disqualifying

conflicts of interest. does fueler have himself to blame in the lack of faith and confidence that americans have in the investigation because he selected an entire panel of part partisans? >> you are exactly correct. and he also is completely unable to articulate the predicate. no one can tell you what crime has been committed. and instead they're investigating people looking for a crime. that's not the way we operate in this country. gregg: show me the man i'll find you the crime. is it increase egli clear to you that there may have been those within the fbi and the department of justice who, for political reasons, decided they were going to go about clearing hillary clinton and simultaneously as a backup plan, let's frame donald trump with a meritless investigation in order

to bring him down. >> it's not an open question anymore. we have a variety of characters either under oath or in the form of various electronic communications saying exactly that. so we have these draft documents where they try to water down the claim out, mishanding information which i'm familiar with prosecuting from the standpoint of being a special agent. and then you've got these guys talking about insurance policies, meaning they're going to leverage the phonied up dossier from fusion gps christopher steele and turn that into a fisa warrant. gregg: that's a crime, isn't it? >> it certainly is a crime. gregg: if you use a dubious phony document in an affidavit in support of a warrant, a wiretap, that's a fraud on the court, isn't it? >> it is. it's also misconduct on the part of the agents. it's prosecutorial abuse on the

matter of the attorneys involved. it's a train train wreck of misconduct. this is hanging around mueller's neck. they can't get away from it. when it comes to bringing charges against people, the very thin thin of the one thousand claim falls statements on general flynn, conspicuously absent is the charge of conspiracy. you know why? there were no conspirators because there was no crime. and every other case, when you see a 1001 charge for false official statements, you always have the guy roll in who else he was in conspiracy with. it's not there. gregg: but mueller arguably illegally obtaining documents from the transition team to use to implicate michael flynn. flynn's lawyers ought to go to court, shouldn't they, and withdraw the plea and challenge the evidence under the

exclusionary rule. you can't use evidence that was illegally obtained. >> it is. it's all fruit of the poisonous tree kind of stuff. this is investigation 101 and law school 101. both sides of the equation, the investigators, the special agents involved from the various agencies and the attorneys involved, they all know better. and this is a very dishonest game they're playing because they've got to come back with a scalp. gregg: it looks like jeff sessions is ordering the doj to start investigate whether hillary clinton engaged in pay to play. simultaneously should they reopen the e-mail case because there appears to be an abundance of evidence, and the statute of limitations hasn't run -- that she mishandled documents, 110 classified documents on her

unauthorized, unsecured private e-mail server. >> the answer is yes, of course they have to investigate both issues. thankfully the american public knows about the e-mail server because of the work of judicial watch. gregg: right. >> what i want to know is -- i would love to see the interview of mueller, comey, wiseman, rosenstein, how are they going to address that with respect to both uranium one and the e-mail investigation. gregg: do you suspect that comey, mccabe, peter struck, involved, as well as james baker, all of these guys together within the fbi, that they deliberately changed the wording of the exoon ration statement that was initially drafted by james comey to absolve hillary clinton to pave the way for her to become president. >> from the 2nd of july, stween, that saturday, my first

question was hey, that interview of hillary clinton, was it a right's warning event? that's all you have to know. and the answer back was no, it was not. an then you knew for a fact that it was a coffee and donut session arrangedded b by david kindle. >> they didn't read her rights. mirandize her. she said i don't recall 39 times during that coffee and donut session. she remembered her name and date and birth and that was about it. >> in any legitimate information, you pause, pull out a nondisclosure agreement, you ask her to refresh her recollection and review the document that she signed and then have her affirm or certify that's her signature on her document and then let her explain how she doesn't remember it. gregg: right. >> that wasn't done. gregg: here is a document. she signed it. it's sworn. it says i understand the

tutorial i received on classified documented. i can't put them in an unauthorized place, which is precisely what she did. but she apparently said, you know, i don't remember getting that tutorial. i don't remember remember signing this document. she actually signed two documents, chris. >> that's true. part of the documents say it doesn't matter if you don't remember. this still applies to you no matter what. you can't wiggle away from it. but the problem is that the agents doing the interview did not do that. gregg: because they were yucking it up, having a good time. and because peter struck was doing the interview, the top fbi official. and now we know that his texts, littered with i love hillary clinton texts to his lover, who was an fbi lawyer. i mean it's really astonishing stuff. >> it's disgusting. gregg: if you look up corruption in the dictionary, there should be a pick u picture of those fos

gregg: there will be no christmas shutdown for the federal government. the house and the senate a short

time ago approved a bill late this afternoon to fund the government through january 19th. with a few sweeteners for the military and child health care. president trump expected to sign the bill sometime tomorrow. joining me now to talk about that and the tax cuts, republican congressman keith rothfus. congressman, good to see you. >> good to see you. gregg: there have been more than 30 continuing resolutions over the last decade. i think it's five per year, to keep the government running. this one only lasted for what, 30 days. it's kind of like popping a rolaid. doesn't something need to be done longer than 30 days? >> absolutely. this has been a frustrating process. i looked at this issue since before i ran for congress. the last time everything was done on time was 1996 where all appropriation bills were passed by september 30th.

the year the house did the work by september 30th. unfortunately the senate did not. it stuck in the senate. this has been a serious issue for our defense budget making sure that our defense planners have the resources. we have people out in the field. i made a trip to the middle east right before thanksgiving. this is a serious situation that's frustrating to see the democrats holding the defense budget hostage, demanding more spending dollar for dollar or whatever their formula is. there's no correlation at all between maintaining a robust defense and what we're spending on the domestic side. that link has to be broken. gregg: you have to plan in advance. our military and defense, defense of americans out there suffers. i do want to ask you about the tax cuts. democrats continued to decry this but republicans say 80% of americans will see tax relief. and of course we've seen a bunch of major companies start cutting checks, $1,000 checks to send

out to their workers as bonuses. doesn't that undermine the democrats' plan? >> that's the sound of an economy revving up. we've been stuck going sideways for ten or 15 years. think of the kids who graduated in 2000 and have not seen a robust economy. there is direct and immediate help coming for the middle class. a single mom making $41 a year is going to see more than $1,300 back a year. the family of four making 73,000-dollar is going to see more coming back. and then you have the economic growth that's going to kick in and we're seeing that, companies willing to make substantial investments in their infrastructure, from comcast and at&t, $1,000 going to employees. this is great news and the beginning of making this country prosperous again. gregg: i think it was john kennedy who said a rising tide

lifts all boats. and that's the whole point of this. that if you grow gdp, it expeninsula the company, investing in companies, expanding the companies, hire more employees and the economy becomes far more robust and in the long run the treasury benefits with increased revenue. >> it's true. it happened in the 1960s, happened in the 1980 and 1990s under president clinton and a republican congress. remember when president clinton promised a tax cut, got to congress and said he couldn't do it. in 1994 they did the middle class cut and the revenue to the treasury went significantly up and into surplus. but the rising tide does lift all boats and that's what this tax bill is all about. >> congressman, thank you so much for being with us tonight. appreciate it. >> thank you and merry

the presidential palace in in kabul. joining me you. former u.s. ambassador to the united nations, john bolton a senior fellow at the american enterprise institute. always a pleasure to see you. happy holidays, merry christmas to you. every american president i can think of promised to recognize jerusalem as the capital and move or embassy there. none of them kept their promises. this president did. >> this is an act of theater. the vote in the security council earlier this week was the first act, this is the second act. this vote in particular will have no meaning, no consequence, no significance. it's outrageous that a decision by two governments with to be united states and israel, where to put our embassy in israel's

capital city should even be a discussion item at the u.n. but i think the president, despite how reflective this is of the culture and anti-israel feeling in new york, not to mention anti-u.s. feeling, i think the president actually scored a victory here and has a real opportunity going forward. it's true the vote was overwhelmingly against the u.s. decision to recognize jerusalem as the capital. but when you count the abstentionance the governments that didn't bother to show up to vote, it amount to 56 plus 9 who actually voted against the resolution. that number is much higher than i expected or predicted on various fox news shows. i thought the vote against would be 170,80 and i thi that abstention rate reflects what trump said and what ambassador haley said, that there would be

consequences for those countries that voted against what the united states had done. i think there should be financial consequences for the u.n. as well. gregg: why should we give billions of dollars to people who don't like us very much and vote against us in the u.n. all of the time. let me move on to something else. this report of when he was president, president obama decided to go easy on the terrorist organization hezbollah so that he could curry favor with iran in the nuclear deal. what do you make of that? >> well jo, you know, if this sy is close to being true, it's explosive. it's in politico, so i take it with a grain of salt. we should follow the suggestion of the republican of north carolina who said we should have a congressional investigation, involve the judiciary committee as the foreign affairs committee. it's inexcusable for any administration to hold back on hezbollah, let alone as an act

of appeasement in what was already a broader act of appeasement to negotiate this nuclear deal with iran. there are always needs between law enforcement and intelligence and maybe there was some of that here. but that doesn't mean you shut down an dea operation. it means you tailor it more carefully. there's no excuse not to take the fuelest measures we can against hezbollah. gregg: i have to ask you about north korea. there's a report on that country that the united states is considering what's referred to as a bloody nose attack against the country to sort of knock out their nuclear program. can that be done, and if it can, good idea, bad idea or would it make matters worse? >> i think unless we get a dramatic development where china takes out the north korean regime or agrees to reunite the two kre koreas, we're down to te choice soon.

either we accept north korea with the nuclear weapons or consider military force. the pen gone ought to be doing contingency planning. do you want to wait for five years to go by and north korea have 100icbms with thur mo nuclear weapons that can hit the united states? neither aption is attractive. defending the american people is the first responsibility of the u.s. president. gregg: the problem is all of the artillery aimed at seoul which is minutes away. >> that's a problem. you can't knock all of that out before they start firing and murdering people. >> don't under estimate our naval capabilities. we should do everything we can to protect the south koreans and i think that's what the pen gone ipentagonis looking at right no. gregg: thanks for being with us. >> merry christmas. coming up next, hillary clinton now planning to hit the campaign trail in 2018.

but she never won a competitive race. and she hurt the democratic party when they felt they were certain to win. the "new york times" was calling around trying to find anyone who would back up her husband bill clinton on sexual abuse allegations and they couldn't find one. the clintons cash is spent. and they won't be very helpful except for the diehard already on the democratic band wagon. >> she lost to a rookie the first time around. a total amateur. gregg: and he didn't have much of an organization it was all done on instinct and spirit. mark: she spent a billion dollars at least. gregg: her name is synonymous with scandal. mark: she had the greatest

political consultant in the world living in her own house. she should have been begging him, coach me, teach me. gregg: he was telling her to campaign in the midwestern northern states. chris: after barack obama was elected president he had date ra gurus -- data gurus in the silicon valley. and they forgot the human touch. hillary clinton lacks that. democrats should beware of her reappearing. gregg: no one sees her trying to be funny in public.
