25%. still good, not great. i could go on and on here. i expect to to on and here because it is my show. they're looking still doing something with mortgage deduction paring it down a little bit. there are signs as well that the president now is talking about being open to shutting down the government in order to build his border wall. can you say, oh, i don't know, distraction? all of these things pitched together with the battle with mitch mcconnell and not expressing gratitude to mitch mcconnell, say whatever you will of him, people say he is globalist and i'm a globalist. i don't even know what a globalist is. i thought they were talking about my weight size. i let it go. but you know you get to washington to work with washington. is yeah, you are going to upset the cart, turn everything upside down. that is by the way to the president's credit, you have is it still work to get the same stuff done. not working with the people that

president trump. these are very decent, good guys. they both want tax reform. they both know it is in the interests of the american people. i don't see either one of them letting a personal dispute getting in the way of getting tax reform done. neil: but they haven't talked -- there isn't a lot of legislative days to get stuff done. so, when you're not talking to each other the last few weeks, i assume, at least at their level, nothing is getting done. >> got to remember, steve mnuchin and mitch mcconnell met on monday in louisville. neil: absolutely, you're right. >> they met about tax reform, tax reform and raising the debt ceiling. there are negotiations going on, maybe not every day between trump and mcconnell. neil: even during that one, i caught from mitch mcconnell that not all the news he reads is fake. he is chasing. president, frustrated with washington goes, he is shaving a lot. this habit of going after those within your own party, he is quite right to point out many in

angry they didn't come back to repealing and replacing obamacare after promising seven years, so some recriminations might be in order. one senator who i think for retaliatory reasons for things said about him during the campaign strikes back and doesn't vote for repeal and reform. if you're the president that will make you upset. neil: talking about john mccain? >> i don't blame mitch mcconnell for that. neil: mitch mcconnell voted for this. john mccain didn't. i understand that frustration. you know this environment. you have worked through it he and the hell it throws at you unjustifiably. in washington he comes there, in environment where you have very few friends. you're an entirely different character. people presumably on your side you will blame them for every screw-up. there will be screw ups. that will happen. he is quite right to express frustration. i wouldn't do it publicly and wouldn't be cursing out my friend, that is all i'm saying. >> what you said is fine.

health care revamp finally done if and when that happens. you have to go beyond that base, right? >> iguarranty you we'll raise the debt ceiling. i'm very confident we're going to get some tax reform done. i don't know whether it will be what we all want or what you and i want but we'll get something done. neil: here is where i predict, if i'm wrong, i will have all the tapes burnt. >> we'll have another interview. neil: they will get debt ceiling raised and hem and haw, there might be a temporary government shutdown but we'll get it done. we'll get a budget, but it will be half-assed, both parties blamed there. look at this, that it is christmastime. it is done. not happening this year. >> i do think, i think we'll get stuff done on tax reform. i would be amazed if the republican party didn't get -- we have an election in 2018. they have to get something done. neil: tell me about it. you have to. we're in the majority. we have the run of the table.

the guy was railroaded. that is another thing. senior staffer mike warren and and. amy, i think you heard my doubts, my concerns. i think this infighting and these mixed signals i'm getting on what will be included, how low the corporate rate goes, i know this is all negotiations but times are running out. i'm just worried that it is not going to happen this year. what do you think? >> i think those are valid concerns, most people, probably would agree with you in that area. however, you did mention earlier about the president throwing out red meat to the base, hopefully that base will put pressure on those senators who failed us with the repeal of obamacare. that way they step up when it is time for tax reform. this is important and vital. we have to get tax reform or the republicans are in trouble. neil: i totally agree with that. mike warren, i heard speaker

paul ryan saying tax reform will be easier than health care reform. on paper that makes sense. but i'm already seeing these wide divergences among super conservative republicans who want a big, big tax cut whether it is paid for right away, and moderates like mitch mcconnell, who has acrimonious relationship with the president who don't want it so big. there isn't a lot of wiggle room in those votes, that's why i'm leery. what do you say? >> first off i agree with you this sun likely to get done. the reason that is a couple weeks ago, white house saying mid-november, that is when we expect a tax reform bill on the president's desk. i talked with someone at the white house yesterday said, maybe a couple weeks after mid-november is more likely. that is sort of the canary in the coal mine on this. but i think the big fundamental problem besides all the personal infighting you talked about in the last segment is you have a republican party that has a bunch of divergent views on tax

reform, what kind, to what extent. this is a big problem. where a president of the same problem would be helpful to sort of iron out those details and sort of lead the charge on this. instead what you have is a president, i think you rightly point this out, neil, crusading against the leadership and establishment in his open party, the people he needs to help usher this through. neil: when he is going after chuck schumer, they're a fine one to talk about excessive spending or running up the debt but then when you go after people on your team, i mean, i wouldn't do that with fellow fox anchors. varney i would, i would do it with varney. i got ahead of myself there, amy, i'm thinking, i'm just worried about the ill will there. when i think of ronald reagan, what he did to get tax cuts through. forget about keeping republicans in line. crossing over getting better than 40 southern democrats in the house, so-called bow weevils to go through, wining and dining, getting drunk in the

west wing with tip o'neill getting it through, that is wheeling and dealing, getting it done, before people could tweet. >> right t was a different time, that is for sure. but i will tell you it is difficult to watch as a republican when the president was the then nominee, and i was in washington, d.c., and sitting across the table from a number of the house leaders, sitting across the table from some of the lobbyists who actually were not in favor of him actually becoming our president. have they ever really jumped on board? i think our president unfortunately not only has twitter, social media, the mainstream media going up against him but he still has some of our own party members who just aren't thrilled he is there. neil: what i want to get handle on, wish we had more time, mike, help me with this, when you say not likely this year, idea they got to do it next year. all rivalries come in. republicans don't want generous

tax cuts to the rich. others say if everybody doesn't get a tax cut we're not in on this at all. is there possibility next year, such efforts could implode. >> it is more likely. if it doesn't get done this year, less likely it will happen at all because it is an election year as you point out. again these members of congress, they weren't elected, many of them were in congress before donald trump was even on the political scene. they don't really owe any allegiance to the president's particular agenda. this is something the president has to sell to them. i think ultimately to the american people. he has got to be doing that. he has to be out there ahead of all of this, which he didn't do during the health care debate. i think that was a mistake. the white house is innallizing -- internalizing that to some level. but the president has an obligation to sell his prann which would required having a deeped thatting of it, which is not clear, which is the case of the health care plan that he

the fellow on the left a espn broadcaster not having to do with anything of the former confederate general and leader. connell mcshane details what erupted into a incredible soap opera story. what the heck? >> reporter: i like your rome in final days analogy. that is pretty much where we are. espn is taking a lot of heat for this. the reaction the company overreacted. this guy, play-by-play broadcaster, robert lee. he was supposed to work the university of virginia season opener, but because he has the same name as the confederate general they take him off the screen. the general whose statue has been center of controversy surrounding recent violence in charlottesville. that is very close to the university of virginia. read the statement from espn. we'll read it, and it said "we collectively made the decision with robert to switch games as the tragic events in charlottesville were unfolding simply because the coincidence

now the obstructionist democrats would like us not to do it but, believe me, we have to close down our government, we're building that wall. neil: all right. so you heard it there. this flies in the face of administration officials and top republicans, no the debt ceiling will get raised. no chance after government shut down. the president saying if the wall is not included in there, go ahead, we'll attempt a shutdown. there is no intention on republican or democrat sides to force a wall issue on budget matter that would delay increase in the debt ceiling. treasury secretary steve mnuchin has indicated there is support for clean debt ceiling increase. mitch mcconnell who is back and forth with president on other issues is confident the debt ceiling will be raised, it will be done. that will be that. maybe not quite so fast. what you saw last night mirrors what i'm hearing privately, white house sources and republicans on the hill, trump is not saying he will not accept a spending deal, unless democrats come out to agree to fund the wall. the problem democrats will not do this. there is nothing that the white house can give them, sun, moon, all-stars in the sky they will reject that. this puts republicans on the hill in awful position they will have to choose to follow the president, take this to a shutdown or push back fence -- against the president, and risk his wrath. neil: they might risk his wrath, is he trying to bite the hand legislatively tries to feed him? it's a beast, washington, you know it better than i, going against the people trying to get things done for you, you might point finger at them failing. that is fair. there are webness on the president's part. that was collect tiff failure. is this get to be really a

problem foe forward, especially for getting tabs cuts done, kind of stuff people have been, at least in investment community counting on? >> i think that trump right now is very frustrated right after the repeal fell through. he wants some sort of legislative victory. this is the one he wants right now. the issue here is republicans need eight senate democrats to get anything done on a spending deal. if it comes to a shutdown, since republicans control everything and congress and the white house, when it comes to shut down, social security checks, veterans benefits are halted, the public will probably blame party in power. that is republicans. this could backfire on midterm elections. republican leaders know that what they would prefer trump do, turn this energy to tax reform. they are going to need help getting tax cut through congress. so they would prefer he talk about that right now instead of the wall and a shutdown. >> that is what i will say, rachel. i will hear from the trumpers,

this event, disinvited last night, chose not to come, what? >> i was not invited but my gut told me not to show up. this will be the first time i did not show up for his rallies but i didn't think it was feasible because of the possible danger. i didn't want to cause, me to be cause of any demonstrations, riots and that type of thing. i missed not going. i've been to all of his rallyies but safety was more important to me right now, public safety. neil: but to be clear then, sheriff, it doesn't sound like anyone at the white house told you not to come? you made that decision? >> no one, yes, no one told me not to come, but no one told me said i was invited either. so it was, it was my decision not to go but i missed it. it was, a great evening for me.

i really appreciate the president's nice comments in support. one day i will go public and talk about the tremendous abuse of the process and they can do what they did to me, they can do it to anybody. so that is not coming up right now. we'll just see when i will be talking about it. neil: for those not familiar with the case, sheriff, but this all goes back to a judge back in 2013 said in an effort to go after undocumented immigrants you were routinely fingering those of latino descent, that it was essentially racist. they asked you to cease and desist. you were held ultimately in criminal contempt for not doing so, something that could land you in jail up to six months, maybe more. not away of the statutes but what is your reaction to that? >> first of all, it started 60

days after obama and holder took office. that's when this started. here we are, now, i'm being charged with a misdemeanor contempt of court, sentence would be same for barking dogs. they announced this the day before early voting. then they went again and charged me two weeks before you go to the polls. so this is strictly a political hit, and i will be talking about that in the future, because if they did to me, they can do it to anybody. so we'll see what happens when this thing is resolved. neil: sheriff, not too long after this sentence was handed down you did publicly acknowledge you might have violated that judge's order but it was not intentional. what did you mean by that? >> it was not intentional. my guys were doing their job. we had the authority under the program with i.c.e. to do this in seven and 2009. that was, this contempt, that

was the period they filed contempt against me but we had the authority to do that. i don't want to get too much into this legal situation right now, neil, but i will have my day to talk later on. neil: does it bother you that in the interim with all of this been sort of held up as poster boy for racism? american civil liberties union that criticized even the thought of the president pardoning you, that it would be account to official presidential endorsement of racism. what did you make of that? >> i will not get into the aclu, but they're part of this abuse of the progress or process and we'll talk about that later. she can say whatever she wants. of course they're going to against me. i'm like the poster boy. they have been after me since i started fighting the illegal immigration problem eight, 10 years ago, under the state law, which we had authority under federal law when they trained and swore in 150 of my officers.

as long as he is the president i will support him. i wished a lot of other people would do the same, including some republicans. neil: now, expressed frustration with republicans do they include john mccain? >> i'm not going to get into that situation but there is a few out there that talk, you know, talk public. there are some that don't talk about. they do it behind his back but why can't everybody get together? democrats and the republicans support our president? he is a great guy. he will go down as one of the greatest presidents we ever had. neil: last night, sheriff, as you know talked about building a wall, would even risk a government shut down to force fund to make that happen. what do you think of that? >> that is great. let me tell you why illegal immigration has gone down. because he talked about it. they're afraid now. that is how you do it, you talk about, they don't come across because they're know they will go to jail. talking about it is dig deterrents.

that is what he likes to do. it is really successful although he doesn't get any credit for speaking out. that is very important, whether foreign policy, domestic policy. hey, go public. tell everybody, when you can, i'm not talking about sensitive situations. let the people know what you're going to do, let the bad guys know. he loves the cops. i know that personally. he will back up the cops. and the veterans. he and the military today. so, that is at type of guy he is. why should he keep it quiet? every time he says something, whatever they do, they tear him apart. that's bad. neil: do you get a sense, sheriff, however this is resolved, maximum jail time, six months, if they ever enforce that, you're 85 years old. do you think a judge would enforce that? >> i have no idea. i had two good lawyers now. and we're in the process, but you know, hey, neil, i got, two parking tickets in my whole life.

think of that. two parking tickets, 55 years, joined the army when the korean war broke out. now i have to sit at a defense table as a criminal? when i did nothing wrong? come on! so -- neil: when you would round up illegals, what was the criteria that you used that became so controversial? what was it? >> first of all i had the authority, my people to do it because we had the authority to act as immigration officers. number two, there were certain criteria. we didn't go around stopping people because of their color. we stopped them on a violation of law and pursuant to that, if they're here illegally, and supreme court said today, that you can do that, stop people and ask where they're from. so it is a very controversial situation. a lot of people don't understand it. so, i'm fighting it out and we'll see what happens. neil: are you after all of this bitter?

be pardoned by the united states. a matter of time given what's happened in charlottesville not around this time and certainly not last night. there's a lot of people wondering where does this go. telling me he had no conversation immediately prior to the visit or any head that this is going to be done at the president was going to say what he said last night. he wasn't surprised the president said it appeared he said not to come to last night's rally and then it would be a distraction and not good for the president appeared former senior adviser to the national editorial committee bonnie chen and independent women's forum president carrie lukas. i'll rate, let me get a handle of what is going on. one of the first thing that comes to mind is whenever you think about whether sheriff joe arpaio is pardoned or were never come in was bad to issue one,

right? >> well, it was good and bad. it was good for his base. 35%, 45% of americans support trumpet will support him. i too move legislative issues like tax cuts and tax reform across the finish line, he needs more than that. i wish president trump would lobby for tax cuts and tax reform at a time when we are really desperate to get those. neil: it is a distraction to his point on one of the things shared said that i didn't want to be that distraction and yet in the middle of the president address last night coming atop about north korean government shutdown because the money to fund a border wall. what did you make of that? >> i agree completely. the focus needs to be a very busy time. there's going to be a ton of things congressional republicans want to get done whether it's tax reform it's tax or former infrastructure and unfortunately this issue is a distraction and the more this product proactively and preemptively,

the more of an issue it becomes. i agree completely it's a distraction. the president is on firm ground when he talks about the economy and economic growth. neil: you know what i wonder about, time is wasting. another thing we are talking about in washington and now given the bad blood we've seen develop between mitch mcconnell and the president is yet another distraction. >> absolutely. but the congress and president need to win in any to show they can make some real positive policy change enacting tax reform is where that start. i think there's a bipartisan, even democrats know the tax code is incredibly counterproductive in terms of economic growth and job creation. they have to get something done that lower taxes and fight the tax code. that has to be the focus this fall. neil: i was thinking when having

sheriff joe arpaio here, that markets are down, depending what statistics you use on inauguration day or from election day. 40% or more along the border. does the president and if that is the case, do we need to build a wall to enforce that? >> he certainly gets credit among his base. the question is whether he gets credit outside of his base. to get tax reform and a lot of the things the tax panel has been talking that if they need more of that. he is going to need senators mike mcconnell and house leader paul ryan. this is the time to come together. i don't think we need the wall. i think he's done an effective job. neil: you know, you could look at this and say it might be a viable part of this. a lot of people say he's deemed a racist, just doing his job

going after illegals and it scared other sheriffs after the feds are coming after them to do their job. the results are the resulting he said he brought up the results to get a handle on illegal immigration in his county. does that speak to himself or would that be pardoned or not? >> i think this will always continue to be an issue. immigration is a challenging issue for the republican party. it has been for several years already. whether you take tougher immigration, whether it's legal or illegal immigration tone like the president has or whether you look more at the reform angle is folks like marco rubio have, what you see this is a very divisive issue. so if we move forward as a party in terms of getting things done, looking towards the fall, it's important for us to arrive at least at some healthy amount of agreement on the issue and to the extent that she rubs salt in the wind, it will get harder and

harder to do that. neil: now stepping back for a sheriff arpaio and you call this a distraction or legitimate issue and when the president should address with a pardon, we do know even the top of the border wall thing and risking government shutdown was opposite from what alone wasn't going to happen. there would be no government shut down. his own treasury secretary had indicated the debt ceiling would be raised and there be no government shutdown. you get a sense they are not along the same page. >> yeah coming you know, obviously a lot of miscommunication and they do need to focus on this. i think we can take some hope from this idea, these reports that at least adding things on paper, moving forward on a tax reform bill, fleshing out the tax principles put out earlier in the summer, that that process is heading forward. we all know that the white house has a little bit of trouble with message discipline and congress,

but what is important at the end of the day is getting a tax reform bill that accomplishes what it needs to. the good news is that process seems to be moving forward. neil: it is moving forward. i look at this as someone who sees taxes is having a big impact on the economy. we can argue sides in who gets what. i do think they are beneficial. i am worried that i don't think they are going to happen this year, so you are the experts. i read the prompter, so that makes me qualified. what i am wondering about is if it does get resolved in the next year, we don't just look at the legislative timetable, then what? >> and i think the 2018 elections might be a disaster for republicans. if they want to assure their majority rule in the house and senate, they better pass that thing and they better make it retroactive to january 1st.

that kind of power as we do as governors. i've never pardoned anyone as governor, but it is up to the person that has that power and it's up to the president of the united states. neil: if you had that power, would you pardon him? >> you know, that is a hypothetical for me to answer. it makes it really difficult because i wasn't in the courtroom. i just know what i've read in the paper and heard on the news in regards to all that. she'll explain you cannot profile people in the state of arizona. we were very, very clear when i signed that bill 1070 that if they were stopped they could ask for i.d. that's a federal law. you can ask for identification. we all get asked for i.d. if that case, there's an issue there. i don't sit in the courtroom. i'm not a judge, nor my lawyer. i know from my liquid ricers what i was told and i follow the law. neil: a lot of people focusing

on the president, but he singled out your two senators, never naming them, mccain or jeff flake. expressing frustration with them. would he think of that? >> well, coming from arizona and knowing personally both of the united states senators, it is difficult to hear. they are duly elected officials. go win there and go into a body by congress and that's the only thing you have. the art of making policy in moving america forward is the art of compromise. everyone needs to sit down and determine what they can give out. neil: the president doesn't like what jeff flake is doing and wants to run a primary challenge. is he hurting the party by advocating that? >> it's very disruptive old because it doesn't really service right now.
