11:01 am
>> see you in court. donald trump getting a trial date for the same time, an appeals court giving trump a reason to celebrate in a separate case for now plus new details in the moscow terror attack four suspects from the deadly assault appearing in court as isis-k claims credit for the attack. and the kremlin attempts to tie the massacre. do ukraine plus the new study >> suggests how abortion may be changing in the us after the decision that reversed roe versus wade this as the supreme corporate peers to hear another critical case this week, we're following these major developing stories and many more all coming in right here to cnn news central >> welcome to cnn news central. i'm jessica dean alongside boris sanchez here in washington and in three weeks, the first criminal trial or an ex-president is set to begin today. a judge ruling donald
11:02 am
trump's criminal hush money case will move forward with jury selection set to start on april 15th, and man trump was in the courtroom as the judge handed him that defeat. but while he was in that courtroom, his legal team got some good news in another case. >> that's right. his $464 million civil fraud bond was due today, but an appeals court has given him an additional ten days and also trim that bill by more than half to a much more manageable $175 million manageable for a billionaire, i suppose trump says he will pay that amount quickly cnn's kara scannell and paula reid are outside the courthouse in manhattan on the hush money case. kara you were inside for the hearing. bring us the details of what you saw oh, yeah, boris and jazz. so the judge held this hearing today because trump's lawyers said that the prosecutors in this case had withheld evidence that they should have gotten from federal prosecutors who have
11:03 am
brought their case against michael cohen's several years ago. so the judge brought everyone into try to get to the bottom of this and he petted for both sides questions about the timing of events and when they asked for certain information at the end of the day, the judge said that he found that prosecutors were not at fault for the late turnover of information. he says that they acted in good faith and it was at that point that he ruled against donald trump and said that this case would move forward. we're to jury selection on april 15th at that point, trump's shook his head, looking frustrated by that ruling and ultimately, you know, now this case is moving forward. his past attempts to delay have fallen flat and it was lawyers did make another effort with this judge to try to get him to hear arguments legal motions and find their attempts to say that the pretrial publicity is reason to delay this case, and the judge said he would accept briefs on this. but as of now, he said to everyone as we departed for the day, see you on april 15 and paula trump spoke within the
11:04 am
last hour or heat laid out a number of false hoods, but he seemed to think that this trial won't actually start on april 15th, >> if ever, is there any indication that's true >> look just nothing is for >> certain in trump's legal world today was supposed to be the first day of the first criminal trial against trump. and yet instead, we're here for this hearing on evidence and arguments for our postponement or even a dismissal. so all i can say right now for certain is that the judge has what this case on the calendar for juries selection to begin on april 15th in right now, there's no foreseeable legal reason that that would move, but we know the trump team is gonna avail themselves of every potential option to try to delay this. and again, we didn't expect this evidence dump from the justice department to delay the proceedings. so you never know what will happen if it has have right now, april 5, teeth appears to be the firm date on the idea that anything is possible and that anything can
11:05 am
happen. kara trump also, the door open to potentially testifying in the hush money trial. is that realistic >> oh i think it is realistic, boris, as we've seen in the two most recent trials that trump has faced, these were civil trials, but involving e jean carroll's defamation case, he took the stand and testified there, and he also testified in the civil fraud case that resulted in that massive judgment against him? now a criminal case is always a different context texts. he has a lot on the line, including potentially his freedom. but he has proven to be very determined and taking the stand and testify and it's something that his attorneys have had to grapple with knowing that he wants to testify in this case. he didn't testify in the first e jean carroll trial. he didn't even attend that trial and he has since said that he regretted that i think he if he says he wants to testify, think it's a high probability that he does unless his lawyers are able to convince him that the prosecution has improved their case and him taking the stand could only hurt him >> yeah. there
11:06 am
>> is no doubt that trump is very angry about this trial about his france situation, about all of it, frankly, based on his comments today and previously. but paula, he did get some good news today as well. he got essentially a financial lifeline from an appeals court in the civil case yeah, that's exactly right. >> but he is still frustrated. i mean, the civil fraud decision that cuts to the heart of who is purported to be for decades, it very successful. new york billionaire in the fact that he was not able to post that 464 million bond. that was a point of frustration and embarrassment to him, which is i think why we heard so much from him at his mini press conference. let's take a listen to what he said >> i don't have to sell anything because it's a phenomenon. i built a phenomenal company someday they'll actually report that. i built a phenomenal company
11:07 am
that's very low leverage, unbelievably low leverage with lot of cash light of everything else why should i let a cricket judge make a decision to give 450 million that allows me to spend very little money on my campaign. if i so choose, i'll be spending money on my campaign. >> i >> might spend a lot of money on my campaign but i should have that option >> yeah. you're getting this lifeline from the appeals court because earlier today, uh, when the proceedings got underway here at court and he was facing the possibility that the attorney general could begin the process of seizing his assets if he couldn't post that bond. so just to say we're taking a break inside hi, the court. we got the news at the appeals court had reduced the mountain. he has to post less than half of what he initially i was going to be on the hook for. so that is a significant win for him because again, that he doesn't have to face the possibility that the attorney general would try to seize any of his assets. so getting a lifeline, but still clearly quite personal for him. this
11:08 am
issue? >> yeah. no doubt about it. and then just the hours up to that ruling, he was still in his team trying to find a way to pay that bond that seems somewhat impossible, right? paula reid, kara scannell. thanks so much for your reporting, their and for more on all of this. we are joined now by federal and white-collar criminal defense attorney caroline polisi, and cnn senior political analyst and senior editor for the atlantic. ron brownstein it's great to see both of you. ron, i want to start with you and zoom out big picture for just a moment and ask you, do any of these rulings today and anything that's happening today actually change things politically for donald trump. >> yeah, i think jessica, there is something of a disconnect between what is likely to move the last voters who will decide this election and the focus on all of the legal troubles. it's understandable former president facing unprecedented legal challenges, but short of a trial i'll on the january 6 riot and the efforts to overturn the election after
11:09 am
2020. i'm not sure any of these other legal proceedings are really going to move the needle that much. i mean, a conviction in the new york case obviously would not be beneficial to trump. >> but when you think about who are the the biggest bulk of voters that are movable here i think in the next seven months are, might black and hispanic voters without a college education, primarily men, many of them are living paycheck to paycheck. and the debate over things like taxes, inflation, and health care is more likely to move them. i think most of these proceedings, anything short of dealing with that core issue which the supreme court seems to be working to ensure will not happen before the november election >> so carolina, let's look at the hush money case and that trial start date of tax day, april 15 what should we expect? well, actually happen once that day arrives
11:10 am
>> yeah. well, don't expect to be hearing any evidence on that day. they're likely will be a lengthily voir dire process, meaning selecting a jury, finding citizens that can sort of put there any political bias i see side and do their civic duty with a open mind. but i think trump lucked out today on both fronts, like he didn't get i didn't think it was ever a possibility he was going to get the case dismissed. the hush money case. however, he did kick the can down the road a couple more weeks, which is a small victory. >> and caralyn, i'm curious if you would have made that same case that we heard from trump's attorneys today in that hush money case specifically around the release of the documents concerning michael cohen, essentially, the defense saying, oh, prosecution, you should have brought these however ago and the prosecution saying you could have brought them at anytime, and the judge really going after the defense saying
11:11 am
they didn't have any evidence of any misconduct or anything like that? >> yeah. jessica was are real what we call bench slap today. i think team trump was a little caught off guard in how just how stern judgment sean was. he basically said you made some pretty heavy accusations here in your motion. essentially, they accused. da bragg of engaging in misconduct, even going so far as to intimate that perhaps they were sort of ink cahoots with the southern district of new york that they had held back this exculpatory information on purpose and sort of gamesmanship the way turns out the judge really admonish them saying, actually it's the other way around. you asked for this production late in the game, the da pursued his obligation to give you an handover that information under his discovery obligations in his request to the southern district. they are not the same
11:12 am
prosecutorial body. they are separate and distinct such that the da's office did nothing wrong here. but given the fact that there was this late production, it did merit a few more weeks for each side really to go over that information >> ron, i have to preface this next question with a fact check donald trump has repeatedly said that this is all election interference that they're going after his money they're trying to fill up his calendar with court dates to keep them off the campaign trail. he actually is only had two appearances on the campaign trail since super tuesday. and most, if not, all, i may be mistaken, but most if not all of his court appearances have been voluntary isn't actually had to be there nevertheless, the idea that he's going to be in court for a significant amount of time during the campaign i mean can't necessarily help him with voters, right? >> all right. well, in the republican primary bars, it
11:13 am
did, right. i mean, he was able to essentially make the case that they are going after me because it really wanted to silence you and i am bearing this cross on your behalf sometimes literally in memes by his by his supporters. >> i think >> in a general election, it is a more a complex kind of calculation in the sense that we do know in polling that there are substantial number of voters who said they would be uneasy about returning trump to the white house if he is convicted of a felony, i don't think this case will resound as powerfully as i said, as the january 6 case. but that reality is out there for him and he'd be in court is a reminder to voters on the fence about the broader kind of chaos that often attaches the trump and that prevailed through his presidency. i still think though if you look at the voters who really are likely to decide that for biden is underperforming now, it tends to be financially squeezed of votes footers and he is going to ultimately have to win the argument with trump about who
11:14 am
can improve their lives economically, more than that, they are going to look at this is disqualifying for him. i think the people who see this as disqualifying have largely moved not all of them, but i think the bulk of what he needs to divide needs to do is going to be on the economic and making your life better for friday >> and carolina's we look ahead now to april 15th when this this trial is now set to start, do you believe that it will begin then? obviously, paula reid had that caveat that you'd never know trump legal world. what what can happen. it was supposed to start today, but april 15th at walk us through what it's going give me like in those days of putting together a jury for this case >> yeah. i mean, i'm i'm with paul and never say never, but i think at least with this issue, the judge is set up with further discovery i think they made exhaustive motions in limine a, which he hasn't is continuing to roll on so i mean barring potentially trump trying to change attorneys. i mean, that's the only thing i could think of that would sort
11:15 am
of give him at least a colorable argument to kick it down the road one more time. look for better or for worse. this is the case that is going to be the first criminal trial of former president trump. it's gotten sorted for the bad rap. but alvin bragg has really tried to elevate his language surrounding what this case is about. we're referring to it as a hush money case, but he has said adamantly this is not a sex for money case. this is an election interference case, trying to sort of elevate the issues around there. and it really play is right. they, they are charging a theory of their case involves election interference. they they kicked it up with these misdemeanor charges to felonies by trying to argue that the the misstatements in the business records for the purpose of furthering another crime i'm which was election interference, which was hiding this hush-money payout, payout
11:16 am
to stormy daniels just in october, the october surprise in order to keep that from the public. and that wasn't election. you'd federal election law violation. so there's some thorny legal issues here, but i think alvin bragg's offices is ready to go >> it is a complicated case to say the least, caroline polisi, ron brownstein. thank you both thank you >> just moments away on cnn news central officials in russia say that several more people were involved in friday's deadly terror attack at a concert hall. we're following these developments will have an update. just a few minutes away, and the white house just weighed in on israeli prime minister benjamin netanyahu's decision to cancel a delegation it's trip to dc. here's white house national security communications adviser john kirby, just moments ago were >> kind of perplexed by this a couple of points that need to

>> here today, russia's investigative committee is asking the court to arrest three more people in connection with friday's brutal terror attack on a concert hall. it comes after four suspects it's time to the massacre, appeared in court sunday, russian state media saying three of the men have pleaded guilty to all charges. isis has claimed >> responsibility for friday's rampage, which russia says killed 139 people including kids it was the deadliest terror attack in russia in two decades cnn's matthew chance in moscow forests, matthew, what are investigators saying about all of this? >> well, i mean, look, i mean, this is a massive nationwide investigation that's continuing. we've seen seven people now appear in court in court, including the four attackers who are suspected of actually
11:34 am
essentially being electrocuted. one of them is shown having his ear cutoff whilst being interrogated by an investigator. and things like that, people being kicked and beaten. the kremlin. and we've asked them about this, have refused to comment on any reports of torture, but clearly, the russians want to send a potent message that despite all these reports that they didn't take the intelligence given to them by the united states seriously. they are now dealing with this in a ruthless, uncompromising way. and that definitely seems to be the message the kremlin and the security forces this is an investigators are putting across. there has been three
11:35 am
more people appear in court today as well linked with and charged. now with sort of assisting in this terrorist act. it's basically a father and two sons from the same family who are believed to have owned the car. it's a white car, white renault car, which the the gunman, the attackers escaped with and were eventually captured, captured in it's not clear whether they knew that the car was being used by the attackers are not, but nevertheless, they've been taken into court in moscow as well. and charged. now with sort of aiding and abetting a terrorist act. and so as i say, this is a big investigation by the russians. they're moving very quickly and they are not taking any chances or not being compromising at all with anybody who he's even got. a slight sense of suspicion hanging over them. >> and matthew is putin still blaming ukraine for the attack,
11:36 am
despite what we know well, i mean, yes, he is. i in fact, within the past few minutes, vladimir putin has been on state television again, talking about how he understands that or accepts that the attack was carried out by muslim fundamentalists by isis, the terror group that has claimed responsibility, repeated plea for carrying out this attack on this concert hall outside of moscow. but he said he doesn't just want to know. he doesn't just want to know who carried it out. he wants to know who ordered it. and so he's again, sort of like implying that it was kyiv if it was the ukrainian government that had something to do with orchestrating this attack. suddenly, of course, the authorities in kyiv have categorically denied >> matthew chance slide for us from moscow. thank you so much. there were some dramatic developments today at the united nations, the un security council approving a draft resolution for an immediate ceasefire in gaza now, the us abstained from that vote,
11:37 am
paving the way for it to pass. in a response is really prime minister benjamin netanyahu canceled a planned israeli delegation trip set for this week in washington i'm joined now by evelyn forecasts. she's a former deputy assistant secretary of defense for russia, ukraine, and eurasia, also, the executive director of the mccain institute. everyone. thank you so much. for being with us the us through john kirby at the national security council responded to this news of the canceled delegation by saying that the united states is perplexed by it. how do you read the state of us? israel relations right now? >> yeah, four as well. first of all, thanks for having me on today. second, i would say that the us government is coming out now much more publicly using the leverage it has to pressure prime minister netanyahu to come to the table and actually,
11:38 am
agreed to a ceasefire hostage, a hostage exchange, and to a long-term diplomatic solution that would result in a two-state outcome. and this is something that netanyahu has been resisting and the united states, reportedly behind the scenes, has been trying very hard but people like me have been and urging now for months that, that our government get out from behind the scenes and put the pressure on publicly. and that's what they did today >> it strikes me that you also had donald trump today. they're presumptive republican nominee for president calling on israel to finish up its war in gaza, saying that quote, the country's losing a lot of support. what does it tell you that even someone like donald trump, who touts his relationship with benjamin and yahoo is now hedging his support well, i don't know that he really is boris because if he's saying go and finish up
11:39 am
>> the job, then it sounds like he's actually citing with netanyahu. and let's not forget that the environment here is really weird because us-israeli relations, unfortunately, have become very a partisan polarized. this started when netayahu was unhappy with president obama's position on israel. and so he started to essentially just use the right as kind of support for his policies mirroring, i guess the fact that he had also moved to the right, but even farther to the right it didn't even the us has politically. and so donald trump is basically giving a little bit of a handout or an olive branch or i don't know what the word is, but he's he's actually supporting netanyahu who wants to go back in and finish the job. but the thing is, there's no finishing the job. you're not going to go into rafah and take out every lap hamas terrorists fighter, it's impossible. so our government is saying, not the former president, the current government of the united states is saying, hold on a minute, we
